NO. 32 OF 2005\n             = = = = = = = = = = = = = = =\n        Dated this the 6th day of October, 2009.\n\n                      J U D G M E N T\n<\/pre>\n<p>      This appeal is preferred against the order of the<\/p>\n<p>Subordinate Judge, Ottappalam in E.A.559\/95 in E.P.74\/95 in<\/p>\n<p>O.S.16\/95.    The applicant before the court below is the<\/p>\n<p>purchaser of the property and he has moved the claim<\/p>\n<p>application to establish that he is the owner in possession of<\/p>\n<p>the property and therefore the said property cannot be sold<\/p>\n<p>in execution of the decree. As per the provisions under the<\/p>\n<p>Code of Civil Procedure as amended especially under Or.21<\/p>\n<p>Rule 58(2) the courts are competent to consider the question<\/p>\n<p>regarding the same and the parties are precluded from filing<\/p>\n<p>separate suits.   Order 21 Rule 58 is just like a provision<\/p>\n<p>under Order 21 Rule 101 where all disputes with respect to<\/p>\n<p>title also can be considered by the Court which arises in the<\/p>\n<p>case.    Now the following facts are very relevant for the<\/p>\n<p>proper determination of the case.\n<\/p>\n<p>Ex.F.A. NO. 32 OF 2005<br \/>\n<span class=\"hidden_text\">                                 -:2:-<\/span><\/p>\n<p>      2.   The claimant gets right over the property by<\/p>\n<p>virtue of an assignment deed executed by the judgment<\/p>\n<p>debtor in O.S.16\/95 dated 9.11.1994. The plaintiff\/decree<\/p>\n<p>holder institutes a suit before the Court for realisation of the<\/p>\n<p>money with a prayer to attach the property and the Court<\/p>\n<p>attaches the property on 13.1.1995.              It has to be<\/p>\n<p>remembered that on the date of the attachment of the<\/p>\n<p>property it has already been sold in favour of the claimant as<\/p>\n<p>per an assignment deed dated 9.11.1994.           It is a settled<\/p>\n<p>position of law that the attachment before judgment does<\/p>\n<p>not confer any title, charge, lien or priority in the property in<\/p>\n<p>favour of the person attaching the property. So the mode of<\/p>\n<p>challenge in these types of transfers may be confined to one<\/p>\n<p>as a fraudulent transfer as contemplated u\/s 53 of the<\/p>\n<p>Transfer property Act or challenging the same as a sham<\/p>\n<p>transaction.   So far as the present case is concerned the<\/p>\n<p>attempt of the decree holder in the case is to establish that it<\/p>\n<p>is a fraudulent transfer. It is a settled position of law that<\/p>\n<p>fraud cannot be inferred from conjectures and surmises. It<\/p>\n<p>Ex.F.A. NO. 32 OF 2005<br \/>\n<span class=\"hidden_text\">                                -:3:-<\/span><\/p>\n<p>can be remembered that O.S.16\/95 is instituted for<\/p>\n<p>realisation of some amount due under an agreement<\/p>\n<p>between the plaintiff and the defendant in the suit.     It is<\/p>\n<p>stated that there is an undertaking in that agreement that<\/p>\n<p>the defendant will not transfer the property.    But that by<\/p>\n<p>itself cannot deprive the right of a person who had purchased<\/p>\n<p>the property parting with valuable consideration and without<\/p>\n<p>notice of the agreement. The agreement relied upon is not a<\/p>\n<p>registered one so as to bring into the question of a public<\/p>\n<p>notice. It is a private agreement between two parties and a<\/p>\n<p>person who purchased the property will be made to believe<\/p>\n<p>that there is no such liability on the property. The mode of<\/p>\n<p>finding out the encumbrance on the property is by applying<\/p>\n<p>for an encumbrance certificate and when the document is not<\/p>\n<p>registered, one would not be able to find these types of<\/p>\n<p>undertakings    or other    things   from the encumbrance<\/p>\n<p>certificate. Just because a property has been purchased or<\/p>\n<p>just because anything has been given by somebody one<\/p>\n<p>cannot affix the notice on the purchaser regarding the said<\/p>\n<p>Ex.F.A. NO. 32 OF 2005<br \/>\n<span class=\"hidden_text\">                                -:4:-<\/span><\/p>\n<p>terms and conditions.     When it is so a fraud cannot be<\/p>\n<p>inferred. It has to be remembered that the assignment deed<\/p>\n<p>is dated 11.9.94 and the suit is instituted only in the year<\/p>\n<p>12.1.1995. A perusal of the discussions made by the learned<\/p>\n<p>Subordinate Judge would reveal that after the purchase of<\/p>\n<p>the property the claimant had paid tax and obtained Exts.A2<\/p>\n<p>and A3 receipts.     So it is proved that the claimant has<\/p>\n<p>purchased the property by virtue of the document and acting<\/p>\n<p>upon the basis of the same he did the mutation and had<\/p>\n<p>started paying revenue for the property. Except the mere<\/p>\n<p>ipsi dexit of the decree holder there is nothing to show about<\/p>\n<p>the fraudulent nature. Who is colluding with whom is still a<\/p>\n<p>misery in this case for the reason that the defendant in the<\/p>\n<p>suit had chosen to remain exparte thereby paving the way<\/p>\n<p>for the plaintiff to get a decree.     There is absolutely no<\/p>\n<p>charge decree as well. So in the light of all these factors and<\/p>\n<p>in the light of the specific provision under O.38 Rule 10 of<\/p>\n<p>the Code of Civil Procedure which specifically states that it<\/p>\n<p>will not bar the right of a party who is in possession of the<\/p>\n<p>Ex.F.A. NO. 32 OF 2005<br \/>\n<span class=\"hidden_text\">                                -:5:-<\/span><\/p>\n<p>property prior to the date of attachment, it is to be held that<\/p>\n<p>the claim petition has to succeed and that the order passed<\/p>\n<p>by the learned Subordinate Judge does not call for any<\/p>\n<p>interference and therefore the appeal fails and the same is<\/p>\n<p>dismissed under the circumstances without any order as to<\/p>\n<p>costs.\n<\/p>\n<\/p>\n<p>                           M.N.
