Special Civil Application No. 5834 of 2000<br \/>\n          MR DHARMENDU PANDYA for MR ASHISH M DAGLI for Petitioner<br \/>\n          MR MUKESH H RATHOD for Respondent<\/p>\n<p>     &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p>              CORAM : MR.JUSTICE RAVI R.TRIPATHI<\/p>\n<p>     Date of decision: 10\/01\/2002<\/p>\n<p>ORAL JUDGEMENT<\/p>\n<p>     1.The present petition is filed by the Gujarat<br \/>\n     State   Road   Transport   Corporation  challenging the<br \/>\n     judgement and award dated 20th October, 1999 passed by<br \/>\n the Labour Court, Rajkot, in Reference (LCR) No. 47 of<br \/>\n1996, whereby the Reference filed by the respondent<br \/>\nworkman is allowed by quashing and setting aside the<br \/>\norder of dismissal and he is ordered to be reinstated on<br \/>\nhis original post without back wages, but with continuity<br \/>\nof service and with penalty of stoppage of one increment<br \/>\nwith future effect.\n<\/p>\n<p>2.The case of the      petitioner    is   that   the<br \/>\nrespondent-workman was serving as a conductor for last 23<br \/>\nyears and on 23rd June, 1993, while he was on duty on<br \/>\nBhilkha-Rameshwar route, his bus was checked and he was<br \/>\nfound to have not issued tickets to a group of three<br \/>\npassengers despite of collecting fare from them.       The<br \/>\nrespondent-workman was chargesheeted and after holding<br \/>\nhim guilty, an order dated 19th July, 1994 was passed<br \/>\ndismissing him from service.      It was this order, which<br \/>\nwas the subject matter of the aforesaid Reference.     The<br \/>\nthe Labour Court ordered reinstatement without back<br \/>\nwages, but with continuity of service and the penalty of<br \/>\nstoppage   of   one increment with future effect was<br \/>\nsubstituted for the order of dismissal.\n<\/p>\n<p>3.It is surprising that the Labour Court, though,<br \/>\nrecording in its judgement and award that by Exh. 26,<br \/>\nthe petitioner-Corporation has produced the       default<br \/>\nrecord sheet, which contains as many as 44 defaults, has<br \/>\nnot taken the same into consideration. It is important<br \/>\nto note that out of these 44 defaults, earlier at two<br \/>\noccasions, penalty of dismissal was imposed. It is third<br \/>\ninstance of dismissal, still the Labour Court, Rajkot,<br \/>\nhaving taken a lenient view, has passed the aforesaid<br \/>\naward.\n<\/p>\n<p>4.Mr. Dharmendu Pandya for Mr.        Ashish Dagli,<br \/>\nlearned Advocate for the petitioner-Corporation, relied<br \/>\nupon a judgement of the Apex Court in the matter of<br \/>\n<a href=\"\/doc\/1441937\/\">Janatha Bazar (South Kanara Central Cooperative Wholesale<br \/>\nStores Ltd.) &amp; Ors. vs. Secretary, Sahakari Noukarara<br \/>\nSangha &amp; others<\/a>, reported in (2000) 7 SCC 517 and also a<br \/>\njudgement of the Apex Court in Civil Appeal No. 5630 of<br \/>\n2000 in the matter between <a href=\"\/doc\/636292\/\">Gujarat State Road Transport<br \/>\nCorporation vs. Prakash Ganesh Tankaria.    Mr.     Pandya<\/a><br \/>\nrelied upon the observations made by the Apex Court in<br \/>\nJanatha Bazar&#8217;s case (supra) in paragraph 8 of this<br \/>\njudgement, which reads as under :\n<\/p>\n<p> &#8220;8.In   case of proved misappropriation, in<br \/>\n         our view, there is no question of considering<br \/>\n         past record.     It is the discretion of the<br \/>\n         employer to consider the same in appropriate<br \/>\n         cases, but the Labour Court cannot substitute the<br \/>\n        penalty imposed by the employer in such cases.&#8221;\n<\/p>\n<p>5.The learned Advocate also relied       upon the<br \/>\njudgement of the Apex Court in the matter between<br \/>\n<a href=\"\/doc\/342526\/\">Karnataka State Road Transport Corporation vs.    B.S.<br \/>\nHulli Katti,<\/a> reported at 2001 (2) SCC 574.\n<\/p>\n<p>6.In view of the aforesaid judgements of the Apex<br \/>\nCourt, this petition is required to be allowed and the<br \/>\nsame is allowed.     The judgement and award dated 20th<br \/>\nOctober, 1999 passed by the Labour Court, Rajkot, is<br \/>\nquashed and set aside. Rule is made absolute.
