{"id":80605,"date":"2010-11-24T00:00:00","date_gmt":"2010-11-23T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/high-court-of-jammu-and-kashmir-at-vs-state-ors-on-24-november-2010"},"modified":"2017-06-13T11:54:48","modified_gmt":"2017-06-13T06:24:48","slug":"high-court-of-jammu-and-kashmir-at-vs-state-ors-on-24-november-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/high-court-of-jammu-and-kashmir-at-vs-state-ors-on-24-november-2010","title":{"rendered":"High Court Of Jammu And Kashmir At &#8230; vs State &amp; Ors on 24 November, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Jammu High Court<\/div>\n<div class=\"doc_title\">High Court Of Jammu And Kashmir At &#8230; vs State &amp; Ors on 24 November, 2010<\/div>\n<pre>       \n\n  \n\n  \n\n \n\n \n \n HIGH COURT OF JAMMU AND KASHMIR AT JAMMU.            \nCDLSW No. 81 OF 2010 AND LPASW No. 123 OF 2010         \nSatpaul Shamotra &amp; Ors. \nPetitioners\nState &amp; Ors \nRespondent  \n!Mr. I.H.Bhat, Advocate\n^NEMO  \n\nHonble Mr. Justice J.P.Singh, Judge.\nHonble Mr. Justice Hasnain Massodi, Judge. \nDate: 24.11.2010 \n:J U D G M E N T :\n<\/pre>\n<p>The Contractors engaged by the Government Medical<br \/>\nCollege, Jammu had employed the appellants for doing<br \/>\nannual service, maintenance\/running of Steam Boiler, Hot<br \/>\nWater Generator, Water Softening Plant, Electric Sub-<br \/>\nStation Cum Diesel Generator Sets, CSSD, Laundry and<br \/>\nKitchen etc.<br \/>\nTheir claim to regularization in Government Service<br \/>\nwas rejected by the Principal, Government Medical College,<br \/>\nJammu vide Office Order No. 175\/AHJ of 2000 dated<br \/>\n12.09.2000 while considering it, in compliance to the<br \/>\ndirections issued in their earlier Writ Petition SWP No.<br \/>\n1820\/99, on the ground that being not on the<br \/>\nestablishment of the Executive Engineer, Mechanical<br \/>\nHospital and Central Heating Division, Jammu, they were<br \/>\nnot entitled to entry or regularization in the Government<br \/>\nService.\n<\/p>\n<p>They filed another Writ Petition questioning the<br \/>\nrejection of their case, besides seeking issuance of<br \/>\ndirections to the State-respondents to take them in<br \/>\nGovernment Service, regularizing their past service.\n<\/p>\n<p><span class=\"hidden_text\">2<\/span><\/p>\n<p>Finding the plea untenable, their Writ Petition was<br \/>\ndismissed by a learned Single Judge of this Court vide<br \/>\nOrder dated 20.03.2009, however, with a direction to the<br \/>\nState-respondents to undertake the Selection process for<br \/>\nfilling up available posts created for the jobs, which the<br \/>\nappellants had been doing on behalf of the Contractors<br \/>\nengaged by the State Government, considering the<br \/>\nappellants too therefor, if found otherwise eligible.<br \/>\nAggrieved by the judgment, they have filed this<br \/>\nLetters Patent Appeal along with CDLSW No. 81\/2010<br \/>\nseeking condonation of 502 days delay in filing the Appeal.<br \/>\nAccording to the appellants, after getting information<br \/>\nregarding disposal of their Writ Petition, they delivered a<br \/>\nCertified copy of the judgment along with the relevant<br \/>\nrecords to their Counsel, Suresh Kumar, Advocate, without<br \/>\nany loss of time, instructing him to file Appeal against the<br \/>\njudgment. They were under a bonafide impression that the<br \/>\nAppeal stood so filed, which they, however, later come to<br \/>\nknow had not been so filed by their Advocate because of<br \/>\nhis domestic problems. Getting the brief back, the Appeal<br \/>\nwas filed through the appellants new Counsel.<br \/>\nWe have heard appellants learned counsel on the<br \/>\nmerits of the Appeal also to examine as to whether a case<br \/>\nfor Condonation of delay was made out.\n<\/p>\n<p>The view taken by the learned Single Judge declining<br \/>\nappellants entry into Government Service on the basis of<br \/>\ntheir past Service with the Contractor engaged by the<br \/>\nGovernment, is unexceptionable, in that, being the<br \/>\nemployees of the Contractor who had been allotted work by<br \/>\nthe Government, the appellants do not become entitled to,<br \/>\neither as of right or on preference, to entry into<br \/>\nGovernment Service, which in terms of the rules in force, is<br \/>\npermissible only by competition in selection.\n<\/p>\n<p><span class=\"hidden_text\">3<\/span><\/p>\n<p>That apart, the appellants have neither produced the<br \/>\nAffidavit of their Advocate-Suresh Kumar nor any other<br \/>\nmaterial to substantiate the plea of negligence of their<br \/>\ncounsel in not filing the Appeal.\n<\/p>\n<p>Even otherwise, after having handed over the brief to<br \/>\ntheir Counsel, within the time prescribed for filing Appeal,<br \/>\nno sufficient and plausible reason has been assigned by<br \/>\nthe appellants justifying huge delay of more than 500 days<br \/>\nin not finding out as to whether or not the Appeal had been<br \/>\nfiled by their Advocate. The Certified copy of the judgment<br \/>\nof the learned Single Judge, which has been annexed, with<br \/>\nthe Memo of Appeal, indicates it to be a fresh copy of the<br \/>\njudgment obtained on 27.09.2010, which fact too<br \/>\ndemonstrates that the plea projected by the appellants in<br \/>\nthe application that they had obtained the Certified copy of<br \/>\nthe judgment immediately after it was announced and<br \/>\nhanded over to their Advocate to file the Appeal, which was<br \/>\nlater given back to them, for engaging a new Counsel, is a<br \/>\nplea without substance, which appears to have been<br \/>\ncoined only with a view to facilitate the filing of the Appeal,<br \/>\nseeking Condonation of delay on flimsy grounds.<br \/>\nAfter having known about the judgment delivered by<br \/>\nthe Writ Court, the appellants were required to<br \/>\ndemonstrate due diligence in taking resort to the remedies<br \/>\navailable to them under law. There inaction in ensuring<br \/>\nfiling of the Appeal within the prescribed period of<br \/>\nlimitation and approaching the Court after a period of<br \/>\nabout 1= years, cannot thus be justified on the cause<br \/>\nprojected.\n<\/p>\n<p>Accordingly, finding that the view taken by the<br \/>\nlearned Single Judge, does not suffer from any error of law<br \/>\nwarranting hearing of the Appeal on merits, we find that no<br \/>\n<span class=\"hidden_text\">4<\/span><br \/>\nsufficient cause has been made out by the appellants for<br \/>\nCondonation of delay in filing the Appeal.<br \/>\nCDLSW No. 81\/2010 is, therefore, dismissed along<br \/>\nwith LPA(SW) No. 123\/2010.\n<\/p>\n<p>(Hasnain Massodi) (J.P.Singh)<br \/>\nJudge Judge<br \/>\nJammu:\n<\/p>\n<p>24.11.2010<br \/>\nPawan Chopra  <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jammu High Court High Court Of Jammu And Kashmir At &#8230; vs State &amp; Ors on 24 November, 2010 HIGH COURT OF JAMMU AND KASHMIR AT JAMMU.
