Mehta (as he<br \/>\nthen was)] who decided the matter being<br \/>\nSpecial Civil Application No.10077 of 2003.<br \/>\n The Court was pleased to pass the following order:\n<\/p>\n<p> For<br \/>\nthe reasons stated above, the impugned  order       at<br \/>\nAnnexure &#8221; A&#8221; is required to be quashed and set aside  and<br \/>\naccordingly, it is ordered  to  be  quashed  and  set  aside.    The<br \/>\n respondents  are  directed to reinstate the petitioner  on  her<br \/>\noriginal  post  with  continuity  of service  with  all the<br \/>\nincidental benefits including full<br \/>\nback wages.&#8217;    (emphasis supplied)<\/p>\n<p>The<br \/>\nlearned advocate for the petitioner submitted that against this<br \/>\njudgement and order the respondents preferred Letters Patent Appeal<br \/>\nbeing Letters Patent Appeal No.1821 of 2004 and in that LPA, Hon&#8217;ble<br \/>\nDivision Bench passed an order on 20th<br \/>\nDecember 2004, wherein the relevant part of the order reads as under:\n<\/p>\n<p> In<br \/>\n view  of  the above, learned counsel Mr.Popat<br \/>\n    seeks permission to withdraw this appeal with  a  liberty     to<br \/>\napproach  the  learned  Single Judge by way of review    application<br \/>\nwith a request that delay in filing the  same    may be  condoned.<br \/>\nIf  the  review application is filed    within one month  from  today<br \/>\n with  an  application  for   condonation  of delay, then we request<br \/>\nthe learned Single    Judge to consider and decide the same in<br \/>\naccordance  with<br \/>\n     law after condoning the delay.\n<\/p>\n<p>The<br \/>\nvery fact that backwages were awarded by the judgement and order<br \/>\ndated  16 th<br \/>\nFebruary 2004 against which<br \/>\nLetters Patent Appeal was filed which too came to be disposed of as<br \/>\nwithdrawn by order dated  20 th<br \/>\nDecember 2004, and a review<br \/>\napplication which was filed also came to be disposed of by order<br \/>\ndated  12 th<br \/>\nApril 2006,<br \/>\nto ask for backwages in the year<br \/>\n2010 by filing a fresh petition is barred by gross delay and only on<br \/>\nthe ground of delay and laches the same is not entertained.  The same<br \/>\nis dismissed.  The Court restrains itself from imposing any cost.\n<\/p>\n<p>(RAVI<br \/>\nR.
