Ms. Khyati Hathi, learned advocate waives<br \/>\nservice of notice of Rule on behalf of respondent No.2 and Shri<br \/>\nAnshin Desai, learned advocate waives service of notice of Rule on<br \/>\nbehalf of respondent No.3.\n<\/p>\n<p>1.\tIn<br \/>\nfacts and circumstances of the case, with consent of learned<br \/>\nadvocates appearing for respective parties, present petition is taken<br \/>\nup for final hearing today.\n<\/p>\n<p>2.\tBy<br \/>\nway of this petition under Articles 226 and 227 of the Constitution<br \/>\nof India, petitioner herein has prayed for appropriate writ,<br \/>\ndirection or order quashing and setting aside the impugned order<br \/>\ndated 26.04.2010 passed by the State Government i.e. Additional<br \/>\nDevelopment Commissioner, State of Gujarat, Gandhinagar in<br \/>\nRevision\/Appeal No.20\/2010 by which the Appellate Authority has<br \/>\nallowed the said Appeal preferred by the respondent No.3 herein by<br \/>\nquashing and setting aside the order passed by the District<br \/>\nDevelopment Officer dated 18.01.2010 passed under Section 57 of the<br \/>\nGujarat Panchayat Act, which was passed removing the respondent No.3<br \/>\nas Sarpanch of Khorasa (Gir) Gram Panchayat.  Shri D.M. Thakkar,<br \/>\nlearned advocate appearing on behalf of the petitioner has vehemently<br \/>\nsubmitted that if the Appellate Authority was of the opinion that<br \/>\nreasonable opportunity was not given to respondent No.3 by the<br \/>\nDistrict Development Officer and\/or the order passed by the District<br \/>\nDevelopment Officer was in breach of principles of natural justice,<br \/>\nin that case, Appellate Authority ought to have remanded the matter<br \/>\nto the District Development Officer for passing appropriate order<br \/>\nafresh after giving reasonable opportunity to all concerned.  Shri<br \/>\nThakkar, learned advocate appearing on behalf of the petitioner has<br \/>\nalso tried to submit the case on merits with respect to the<br \/>\nallegations against respondent No.3, however, as this Court proposes<br \/>\nto remand the matter to District Development Officer, Junagadh, for<br \/>\npassing appropriate order afresh after giving opportunity to the<br \/>\npetitioner as well as respondent No.3 and all other concerned<br \/>\npersons, this Court is not further considering the submissions on<br \/>\nmerits.\n<\/p>\n<p>\tShri<br \/>\nAnshin Desai, learned advocate appearing on behalf of respondent No.3<br \/>\nhas stated at the Bar that respondent No.3 has no objection if the<br \/>\nmatter is remanded to the District Development Officer, Junagadh for<br \/>\nconsidering the proceedings under Section 57 of the Gujarat Panchayat<br \/>\nAct, after giving opportunity to all concerned inclusive of the<br \/>\npetitioner and respondent No.3.  He does not invite any further<br \/>\nreasoned order.  Under the circumstances, this Court is not further<br \/>\nassigning any reasoned order while modifying the order passed by the<br \/>\nAppellate Authority, impugned in the present petition and remanding<br \/>\nthe matter of District Development Officer, Junagadh.  Shri Desai,<br \/>\nlearned advocate appearing on behalf of respondent No.3 has stated at<br \/>\nthe Bar that respondent No.3 shall appear before the District<br \/>\nDevelopment Officer, Junagadh on 9th<br \/>\nAugust 2010 for making<br \/>\nsubmissions on merits as he has already filed a reply to the<br \/>\nshow-cause notice issued by the District Development Officer,<br \/>\nJunagadh.\n<\/p>\n<p>3.\tShri<br \/>\nDesai, learned advocate appearing on behalf of respondent No.3 as<br \/>\nwell as Shri Thakkar, learned advocate appearing on behalf of the<br \/>\npetitioner have jointly submitted that respective parties and\/or<br \/>\nother advocates shall make appropriate submissions before the<br \/>\nDistrict Development Officer, Junagadh on 09.08.2010 and let the<br \/>\nDistrict Development Officer, Junagadh pass an appropriate order in<br \/>\naccordance with law and on merits afresh.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, present petition succeeds in part.  The impugned<br \/>\norder passed by the Additional Development Commissioner, State of<br \/>\nGujarat dated 26.04.2010 passed in Appeal No.20\/2010 is hereby<br \/>\nmodified to the extent that matter is remanded to the District<br \/>\nDevelopment Officer, Junagadh for passing appropriate order afresh in<br \/>\naccordance with law and on<br \/>\nmerits and after giving an opportunity to the petitioner as well as<br \/>\nrespondent No.3 and\/or all concerned persons\/authorities.  Let<br \/>\nrespondent No.3 and the petitioner appear either in person or through<br \/>\nadvocates before District Development Officer, Junagadh for hearing<br \/>\non 09.08.2010 as agreed by the learned advocates appearing for<br \/>\nrespective parties and let the District Development Officer pass an<br \/>\nappropriate order in accordance with law and on merits and<br \/>\nconsidering the submissions made on behalf of respective parties.<br \/>\nThe aforesaid exercise shall be completed by the District Development<br \/>\nOfficer, Junagadh on or before 16.08.2010.  Rule is made absolute to<br \/>\nthe aforesaid extent.  No costs.
