        Judgment         debtor        in      E.P.No.316\/06    in\n\nO.S.No.124\/05       on     the     file   of    the     Sub  Court,\n\n<\/pre>\n
Thiruvananthapuram has filed this writ petition. Ext.P5<\/p>\n
order passed by the learned Sub Judge directing issue of<\/p>\n
warrant against him for realisation of the decree debt,<\/p>\n
negativing his plea of no means, is challenged in this writ<\/p>\n
petition.\n<\/p>\n
        2.    The learned Munsiff, after examining the<\/p>\n
materials produced by both sides, the decree holder and<\/p>\n
the judgment debtor, came to the conclusion that the<\/p>\n
petitioner\/judgment debtor has means to pay the decree<\/p>\n
debt and thereupon ordered for issuing warrant against<\/p>\n
him. Propriety and correctness of that order, Ext.P5, is<\/p>\n
impeached invoking the visitorial jurisdiction vested in<\/p>\n
this court under Article 227 of the Constitution of India.<\/p>\n
        3. I heard the counsel on both sides. No material<\/p>\n
whatsoever has been produced by the decree holder to<\/p>\n

                          :: 2 ::\n<\/p>\n
show that the petitioner\/judgment debtor since the date<\/p>\n
of the decree has the means to pay the amount of the<\/p>\n
decree or a substantial portion thereof and has refused or<\/p>\n
neglected to pay the same, is the submission of the<\/p>\n
learned counsel for the judgment debtor.        Relying on<\/p>\n
Ramatheerthan v. R.T.O. Trivandrum {1980 K.L.T.<\/p>\n
374}, the learned counsel for the judgment debtor<\/p>\n
contended that only in a case where it is established that<\/p>\n
the judgment debtor proceeded against in execution of a<\/p>\n
decree has means or has money to pay the decree debt, a<\/p>\n
warrant for his arrest can be issued by the Civil Court.<\/p>\n
The execution court, without adverting to that essential<\/p>\n
factor, which has to be satisfied in the issue of a warrant<\/p>\n
against the judgment debtor ,has passed Ext.P5 order,<\/p>\n
which, according to the learned counsel, is liable to be<\/p>\n
interfered with, exercising the extraordinary jurisdiction<\/p>\n
vested with this court. On the other hand, decree holder<\/p>\n
submitted that the petitioner\/judgment debtor was a<\/p>\n

permanent     employee    in   the  Agricultural  College,<\/p>\n
Vallayani, Thiruvananthapuram and after his retirement<\/p>\n
he is profitably engaged as a document writer. He has a<\/p>\n
document writer’s licence and he is attending the office of<\/p>\n
a licensed document writer as borne out by his own<\/p>\n
admission on examination before the court below,<\/p>\n
according to the learned counsel. After his retirement, he<\/p>\n
has also collected his gratuity and pensionary benefits, a<\/p>\n
substantial sum, is the case of the decree holder, which,<\/p>\n
however, is disputed by the learned counsel for the<\/p>\n
petitioner.\n<\/p>\n
        4. Perusing Ext.P5 order, it is seen that both the<\/p>\n
decree holder and also judgment debtor got themselves<\/p>\n
examined to substantiate the rival case canvassed by<\/p>\n
them before the execution court.     The learned Munsiff,<\/p>\n
who had opportunity to watch the demeanour of the<\/p>\n
witnesses found, the testimony of the decree holder<\/p>\n
reliable and convincing. Admittedly the judgment debtor<\/p>\n

                           :: 4 ::\n<\/p>\n
is a retired farm labourer in Agricultural College. He is<\/p>\n
attending to a document writer’s office and engaging<\/p>\n
himself as a document writer. He possesses a licence for<\/p>\n
writing document for presentation before the Registrar’s<\/p>\n
Office. It is a circumstance indicating that he is getting<\/p>\n
income which is more than sufficient to meet his<\/p>\n
livelihood.  Apart from his engagement as a document<\/p>\n
writer, being a retired farm labourer from a Government<\/p>\n
institution, he could be expected to collect his pension as<\/p>\n
well.  In that factual backdrop, the plea of ‘no means’<\/p>\n
canvassed by the said judgment debtor can never be<\/p>\n
accepted. Further more, the burden cast upon the decree<\/p>\n
holder, when a plea of ‘no means’ is raised to resist the<\/p>\n
execution of a decree is very little. He need only assert<\/p>\n
that the judgment debtor is possessed of sufficient means;<\/p>\n
and, when he has mounted the box and given evidence<\/p>\n
challenging the plea of ‘no means’ by the judgment<\/p>\n
debtor, the burden shifts on the judgment debtor to<\/p>\n

establish that he lacks ‘means’ to pay the decree debt.<\/p>\n
On the materials placed and the circumstances presented,<\/p>\n
the conclusion formed by the learned Munsiff that the<\/p>\n
judgment debtor is possessed of the means and, still,<\/p>\n
defaulted payment is unassailable.\n<\/p>\n
        5.   Learned counsel for the judgment debtor<\/p>\n
requested for an opportunity to discharge the decree debt<\/p>\n
in instalments. No doubt, in execution proceedings over<\/p>\n
a money decree, plea for discharge of the decree debt in<\/p>\n
instalments can be granted only with the approval of the<\/p>\n
decree holder.     Counsel for the decree holder has no<\/p>\n
objection in giving instalment facility, provided substantial<\/p>\n
amount is initially remitted by the judgment debtor.<\/p>\n
        6. Considering that the decree debt due as and<\/p>\n
when    Ext.P4    order  was    passed    was   more   than<\/p>\n
Rs.1,36,000\/-, I find that the request to discharge the<\/p>\n
decree debt in instalment can be extended to the<\/p>\n
judgment debtor only on condition of depositing a portion<\/p>\n

                          :: 6 ::\n<\/p>\n
of the decree debt at the first instance. The judgment<\/p>\n
debtor shall deposit Rs.25,000\/- towards the decree debt<\/p>\n
within one month from the date of this judgment as a<\/p>\n
condition precedent for having an instalment facility to<\/p>\n
discharge the balance amount due under the decree at<\/p>\n
the rate of Rs.10,000\/- per month, so that the entire<\/p>\n
decree   debt   is  discharged   in  12  equal   monthly<\/p>\n
instalments. In case on the 12th instalment, the balance<\/p>\n
amount due under the decree is found to be more than<\/p>\n
Rs.10,000\/- he shall remit the entire sum, irrespective of<\/p>\n
the amount of instalment fixed. Subject to the deposit of<\/p>\n
Rs.25,000\/- within the period fixed above, the instalment<\/p>\n
payment shall start from the month of April, 2010<\/p>\n
onwards. The instalment as above shall be paid on or<\/p>\n
before the 5th of every month, and in case the 5th of the<\/p>\n
month happens to be a holiday, he shall positively tender<\/p>\n
the amount on the next working day.      In the event of<\/p>\n
default of any instalment as ordered, it is open to the<\/p>\n

                           :: 7 ::\n<\/p>\n
decree holder to proceed with the execution to realise the<\/p>\n
amount outstanding as a whole. In the event of default in<\/p>\n
tendering initial deposit of Rs.25,000\/- or of any<\/p>\n
instalment, the court below shall straight away issue<\/p>\n
warrant on such a request being made by decree holder<\/p>\n
intimating the default in payment.\n<\/p>\n
        Subject to the above directions, the writ petition is<\/p>\n
closed.\n<\/p>\n<\/p>\n
