Saravanan for R-3, R-4 and R-5\n- - - - - - - -\n\n:ORDER\n<\/pre>\n<p>\t\tThe petitioner has approached this Court, with a prayer for issuance<br \/>\nof a Writ, in the nature of Mandamus, for directing  the respondents 1 and 2 to<br \/>\ndelete the entries of graduates under category 1,2,3 and 5 of Class II of<br \/>\nSection 19(a) of M.S.University Act from the Register of Graduates for the<br \/>\nelection of Senate members under the category of graduates, and for issuance of<br \/>\na Writ in the nature of Prohibition, restraining the respondents 1 and 2 from<br \/>\nregistering the graduates under categories 1,2,3 and 5 of Class II of Section<br \/>\n19(a) in the Register of Graduates for the category 4 of Class II of Section<br \/>\n19(a) of the Manonmaniam Sundaranar University Act.\n<\/p>\n<p>\t\t2. As regards the prayer of writ of Prohibition is concerned, the<br \/>\nsame stands adjudicated in W.A.(MD)No.331 of 2007 (H.MOHAMMED ALI ..VS.. S.<br \/>\nMARAGATHA SUNDARAM AND OTHERS) decided on 21.08.2007.  Therefore, this Court<br \/>\ncannot issue a Writ of Prohibition as prayed for.\n<\/p>\n<p>\t\t3. The writ, to challenge the constitutional validity of  Class II<br \/>\nof Section 19(a) of the Manonmaniam Sundaranar University Act is also prima<br \/>\nfacie not competent, as the petitioner has not impleaded the State of Tamil Nadu<br \/>\nas a party, it is not possible for the respondents 1 and 2, to delete the<br \/>\nentries, which are statutory entries under the Act.\n<\/p>\n<p>\t\t4. Otherwise also the only ground on which the constitutional<br \/>\nvalidity has been challenged, is that the representation of the graduate<br \/>\nteachers in the first respondent University is more than adequate.\n<\/p>\n<p>\t\t5. This cannot be a ground to challenge the constitutional validity<br \/>\nof the Statute. It is for the Legislature to decide the representation, this<br \/>\nCourt cannot hold a provision to be constitutionally invalid, merely because of<br \/>\nrepresentation of one category is more than the other \/ or a certain category<br \/>\ninadequately represented.\n<\/p>\n<p>\t\t6.
