No.6143 of 2011\n                                 AZAD PRASAD YADAV\n                                            Versus\n                                 THE STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>3.   26.04.2011.               Heard the learned counsels for the<\/p>\n<p>                   petitioner, complainant and the State.<\/p>\n<p>                               The petitioner being the husband is<\/p>\n<p>                   apprehending his arrest in complaint case in<\/p>\n<p>                   which      cognizance        has    been      taken     under<\/p>\n<p>                   Section 498A of the Indian Penal Code and<\/p>\n<p>                   Section 4 of the D. P. Act.\n<\/p>\n<p>                               The marriage was performed in 2004<\/p>\n<p>                   when       the     divorce     case     was      filed      on<\/p>\n<p>                   05.05.2009 whereas the present complaint was<\/p>\n<p>                   filed on 03.08.2009.\n<\/p>\n<p>                               In the circumstances, reconciliation<\/p>\n<p>                   is   not    possible     and   at     this   juncture      the<\/p>\n<p>                   petitioner is ready to pay Rs. 1,000\/- per<\/p>\n<p>                   month to the complainant from June, 2011 by<\/p>\n<p>                   depositing the same by the second week of<\/p>\n<p>                   every      month    in   the    bank    account       of   the<\/p>\n<p>                   complainant.         Learned        counsel      for       the<\/p>\n<p>                   complainant        undertakes      to   supply    the      bank<\/p>\n<p>                   account number to the learned counsel for<\/p>\n<p>                   the petitioner within a period of two weeks<\/p>\n<p>                   from today.\n<\/p>\n<p><span class=\"hidden_text\">                             2<\/span><\/p>\n<pre>                  The       aforesaid         payment    will     be\n\n        subject        to   any    order      being     passed    in\n\n<\/pre>\n<p>        matrimonial or maintenance proceedings.<\/p>\n<p>                  Taking into the aforesaid stand of<\/p>\n<p>        the   petitioner,         let   the    petitioner,    above<\/p>\n<p>        named, be released on bail in the event of<\/p>\n<p>        arrest or surrender before the learned court<\/p>\n<p>        below within a period of twelve weeks from<\/p>\n<p>        today     in    connection       with    complaint       case<\/p>\n<p>        no.948 of 2009 on furnishing bail bond of<\/p>\n<p>        Rs.10,000\/-(Ten Thousand) with two sureties<\/p>\n<p>        of the like amount each to the satisfaction<\/p>\n<p>        of the learned S.D.J.M., Nawada, subject to<\/p>\n<p>        the conditions as laid down under Section<\/p>\n<p>        438(2) of the Code of Criminal Procedure.<\/p>\n<pre>U.
