PUBLIC PROSECUTOR for Respondent(s) :\n1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 14\/07\/2011\n \n\nORAL\nORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>\tMr.Jani, learned Additional<br \/>\n\tPublic Prosecutor, waives service of notice of Rule on behalf of<br \/>\n\trespondent-State.\n<\/p>\n<p>By<br \/>\n\tway of present application, filed under Section 389 of the Code of<br \/>\n\tCriminal Procedure, 1973, the applicants have prayed to suspend the<br \/>\n\tsentence imposed by the learned Sessions Judge, Rajkot by order<br \/>\n\tdated 16th June, 2011 passed in Sessions Case No.165 of<br \/>\n\t2009 and further prayed to release them on bail pending hearing and<br \/>\n\tfinal disposal of the Criminal Appeal.\n<\/p>\n<p>Heard<br \/>\n\tMr.Mahesh Pujara for Mr.Ashish Dagli, learned counsel for the<br \/>\n\tapplicants and Mr.H.L. Jani, learned Additional Public Prosecutor<br \/>\n\tfor respondent-State.\n<\/p>\n<p>Mr.Pujarat<br \/>\n\tsubmitted that the applicants are convicted by the learned Sessions<br \/>\n\tJudge, Rajkot for the offence punishable under Sections 325 of the<br \/>\n\tIndian Penal Code and sentenced to undergo rigorous imprisonment for<br \/>\n\ta period of three years with fine of Rs.5,000\/-, and in default of<br \/>\n\tpayment of fine, sentenced to undergo simple imprisonment for a<br \/>\n\tfurther period of three months. Mr.Pujarat has further contended<br \/>\n\tthat the applicants have already paid the fine amount. They are on<br \/>\n\tbail during the trial and at present also, they are on bail till<br \/>\n\t16th July, 2011. He, therefore, prayed to release the<br \/>\n\tapplicants on bail.\n<\/p>\n<p>Heard<br \/>\n\tMr.Jani and perused the papers produced before me. Looking to the<br \/>\n\tconviction imposed upon the applicants and as they have already paid<br \/>\n\tthe fine amount as also they are on bail, I am of the opinion that<br \/>\n\tthis is a fit case to allow. Hence, the present application is<br \/>\n\tallowed to the extent of releasing the applicants on bail. The<br \/>\n\tapplicants are ordered to be released on bail on their furnishing<br \/>\n\tpersonal bond of Rs.5,000\/- (Rupees Five Thousand Only) each and<br \/>\n\talso surety of the like amount by each of the accused. Bail before<br \/>\n\tthe concerned trial Court. Rule is made absolute to the aforesaid<br \/>\n\textent.\n<\/p>\n<p>\t\tDirect<br \/>\n\tService is permitted.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
