(ORAL)\n<\/pre>\n<p>       This   appeal   has   been     filed   against    the    concurrent<\/p>\n<p>judgments of the Courts below dismissing the suit of the<\/p>\n<p>appellant for prohibitory injunction against the respondents while<\/p>\n<p>allowing the counter claim of the appellant regarding her<\/p>\n<p>possession over the disputed house. It is not disputed that the<\/p>\n<p>property in dispute was owned by Amar Singh. The contesting<\/p>\n<p>respondents are his daughters. The appellant&#8217;s claim is that he<\/p>\n<p>has purchased the property in dispute from the nephew of Amar<\/p>\n<p>Singh. Both the Courts below found that the said nephew had no<br \/>\n<span class=\"hidden_text\"> RSA No.417 of 2008                                       -2-<\/span><\/p>\n<p>right title in the interest of property. Any alienation made by him<\/p>\n<p>would not have any effect on the rights of the contesting<\/p>\n<p>respondents. The following questions have been proposed:<\/p>\n<blockquote><p>             i) Whether the respondent No.2 was owner of the<\/p>\n<p>               disputed house?\n<\/p><\/blockquote>\n<blockquote><p>             ii)Whether the respondent No.2 has executed an<\/p>\n<p>               agreement to sell the said house in dispute in favour<\/p>\n<p>               of the appellant?\n<\/p><\/blockquote>\n<blockquote><p>             iii)Whether the respondent No.2 executed a receipt dt.<\/p>\n<p>               28.08.2003 regarding receipt of earnest money?<\/p>\n<\/blockquote>\n<blockquote><p>             iv)Whether Rakesh is legally entitled to transfer his<\/p>\n<p>               house in favour of the respondent No.2?<\/p>\n<\/blockquote>\n<blockquote><p>             v)Whether the appellant is owner of the disputed<\/p>\n<p>               house?\n<\/p><\/blockquote>\n<blockquote><p>             vi)Whether counter claim filed by the respondents is<\/p>\n<p>               maintainable?<\/p><\/blockquote>\n<p>             All the questions are pure questions of fact.
