However, the Bank has not taken any decision nor the Bank has<br \/>\n\tcommunicated any decision to the petitioner and prior thereto, the<br \/>\n\taction under Section 13(4) of the Act is contemplated to be taken<br \/>\n\tand therefore, this petition.\n<\/p>\n<p>It<br \/>\n\tis true that as per Section 13(3A) of the Act, it is required for<br \/>\n\tthe Bank to take the decision.  However, after the decision is taken<br \/>\n\tfor ventilating the grievance against such decision, the petition is<br \/>\n\tnot maintainable, but only after the measure is taken under Section<br \/>\n\t13(4) of the Act, the grievance can be raised by the petitioners by<br \/>\n\tway of an Appeal under Section 17 of the Act.\n<\/p>\n<p>As<br \/>\n\tthe petitioners have not produced the decision of the Bank, this<br \/>\n\tCourt is not in a position to examine the said aspects. Further, the<br \/>\n\tfact remains that the matter is pending before the DRT in the<br \/>\n\tOriginal Application made by the Bank for recovery of the amount and<br \/>\n\tthe petitioner has also filed counter claim.\n<\/p>\n<p>Mr.Jani,<br \/>\n\tlearned counsel appearing for the petitioners additionally contended<br \/>\n\tthat as the counter claim is pending before the DRT, the Bank be<br \/>\n\tprohibited from taking any action whatsoever under the Act.\n<\/p>\n<p>I<br \/>\n\tam afraid such can be accepted by this Court, more particularly when<br \/>\n\tthe matter is at large pending before the DRT.  If the petitioners<br \/>\n\thave any right in law, it may move the DRT.  The pendency of the<br \/>\n\tOriginal Application or the counter claim therein cannot operate as<br \/>\n\tabsolute bar to the Bank from resorting to the provisions under the<br \/>\n\tAct unless it is prohibited by express order of the Forum, which is<br \/>\n\tDRT who is seized with the proceedings.\n<\/p>\n<p>Hence,<br \/>\n\tthe present petition is dispose of with the observation and<br \/>\n\tdirections that if the Bank has not considered the reply of the<br \/>\n\tpetitioner dated 14.10.2008, copy whereof is produced at<br \/>\n\tAnnexure-A\/2, which has been received by the Bank by R.P.A.D post,<br \/>\n\tthe same shall be considered by the Bank and the decision shall be<br \/>\n\tcommunicated to the petitioners by RPAD Post. Till the aforesaid<br \/>\n\tdecision is taken by the Bank and communicated to the petitioners by<br \/>\n\tRPAD post, no action shall be taken by the Bank under Section 13(4)<br \/>\n\tof the Act for taking possession of the property in question.
