SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 19\/01\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>\tPresent<br \/>\n\tFirst Appeal  has been preferred by the appellant &#8211; original<br \/>\n\tclaimant  challenging the Judgement and Award dtd.3\/8\/2010 passed by<br \/>\n\tthe Motor Accident Claims Tribunal,  City Civil Court No.21 at<br \/>\n\tAhmedabad in Motor Accident Claim Petition No.179 of 2002 in so far<br \/>\n\tas holding the claimant negligent to the extent of 40% for the<br \/>\n\taccident in question.\n<\/p>\n<p>\tMr.Hiren<br \/>\n\tModi, learned advocate appearing on behalf of the\u00a0appellant &#8211;<br \/>\n\tdriver of the Scooter has submitted that  the tribunal has<br \/>\n\tmaterially erred in holding the driver of the Scooter negligent to<br \/>\n\tthe extent of 40%. It is submitted that undisputedly the appellant\n<\/p>\n<p>\t&#8211; driver of the Scooter, crossed the half road of<br \/>\n\tSarkhej-Gandhinagar Highway and entered the lane for two wheeler<br \/>\n\tand, therefore, the Tribunal has materially erred in holding the<br \/>\n\tappellant &#8211; driver of the Scooter negligent to the extent of<br \/>\n\t40%. No other submissions have been made.\n<\/p>\n<p>\tHeard<br \/>\n\tMr.Hiren Modi, learned advocate appearing on behalf of the appellant<br \/>\n\tat length and considered the impugned Judgement and Award passed by<br \/>\n\tthe Motor Accident Claims Tribunal,  more particularly, the<br \/>\n\tdiscussion of the learned Tribunal on the aspect of negligence, more<br \/>\n\tparticularly para 30 of the impugned Judgement and Award, which<br \/>\n\treads as under:-\n<\/p>\n<p>&#8220;30.\t\tConsidering<br \/>\nthe ratio of above noted authority case and as per my above<br \/>\ndiscussion and reasons, it is undisputed facts that the scooter came<br \/>\nfrom bye-road and has crossed the half road of Highway of<br \/>\nGandhinagar-Sarkhej and the scooter has been entered by crossing<br \/>\ndivider on highway road of Sarkhej-Gandhinagar and scooter was in<br \/>\nmiddle of highway road and going toward Gurudhawara approach road.<br \/>\nSo, in the instant case the scooterist has to take care and he could<br \/>\nhave to stop before entering on highway road that the highway road is<br \/>\nsafe for passing. But in the instant case the half of the road has<br \/>\ncrossed by the scooterist and at the relevant time the car was coming<br \/>\non straight highway road from Sarkhej-Gandhinagar and as per the<br \/>\nevidence of the driver of the car, he had seen the scooter at the<br \/>\ndistance of 25 ft. to 30 ft. so, in my view, if the motor car driver<br \/>\ncould have taken care and caution the accident would have avoided.<br \/>\nSo, considering the evidence is on record, in my view, in the instant<br \/>\ncase the scooterist and the driver of the motor car opponent No.1<br \/>\nboth are responsible for the accident. And I am relying on the<br \/>\naforesaid particular authority case the decision of Hon&#8217;ble Supreme<br \/>\nCourt reported in 2008 ACJ 2170 as discussed above and considering<br \/>\nthe ratio of this authority case and as per my above discussion and<br \/>\nreasons in my view, the scooterist is responsible for contributory<br \/>\nnegligence to the extent of 40% and the driver of the car opponent<br \/>\nno.1 is responsible for contributory negligence to the extent of<br \/>\n60%.&#8221;\n<\/p>\n<p>\tIt<br \/>\n\tis not in dispute that that the appellant, who was the driver of the<br \/>\n\tScooter, came from bye-road and the Maruti Car was  on the main road<br \/>\n\tand the appellant crossed half of the Highway and entered into the<br \/>\n\tsame by crossing divider on Highway road and the Scooter  was found<br \/>\n\tto be in the middle of the Highway road and Maruti Car was coming on<br \/>\n\tthe main road and therefore,  when the   Scooter was coming from<br \/>\n\tbye-lane and was passing through the main road, more care and<br \/>\n\tcaution was required to be taken  by the appellant, who came from<br \/>\n\tbye-lane  by driving scooter and was entering the main road by<br \/>\n\tcrossing divider on Highway road and when the Maruti Car was  on the<br \/>\n\tmain road.
