Misc.     No.31332        of   2008.    This       Court<\/p>\n<p>                 directed       the    trial     of   the     case     to     be<\/p>\n<p>                 expedited.\n<\/p>\n<p>                          The trial having not been concluded,<\/p>\n<p>                 petitioner has again moved for bail. This<\/p>\n<p>                 Court had called a report from the trial<\/p>\n<p>                 court as to how many witnesses have been<\/p>\n<p>                 examined in the case so far and how many<\/p>\n<p>                 charge     sheeted          witnesses   remain        to    be<\/p>\n<p>                 examined and within what time the same is<\/p>\n<p>                 likely to be concluded.\n<\/p>\n<p>                          From    the        report   dated     08.03.2011<\/p>\n<p>                 submitted by the trial court, it appears<\/p>\n<p>                 that 12 witnesses have been examined in the<\/p>\n<p>                 trial and 3 charge sheeted witnesses remain<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>to be examined and out of three, two are<\/p>\n<p>unofficial        witnesses      and    one    is   Officer<\/p>\n<p>Incharge.\n<\/p>\n<p>        A supplementary affidavit has been<\/p>\n<p>filed on behalf of              the petitioner today<\/p>\n<p>along with which a typed copy of the order<\/p>\n<p>sheet is annexed as Annexure-4. From the<\/p>\n<p>order   sheet       it     appears     that    P.W.11     and<\/p>\n<p>P.W.12 were examined by the trial court on<\/p>\n<p>22.12.2009         and      discharged.        Thereafter<\/p>\n<p>defence      filed     a    petition     for    recall     of<\/p>\n<p>certain      witnesses       but   the    same      was   not<\/p>\n<p>moved   and       remains      pending.   However,        the<\/p>\n<p>order     sheet        shows    that     the     case     was<\/p>\n<p>adjourned on several dates to enable the<\/p>\n<p>prosecution to produce remaining witnesses,<\/p>\n<p>but so far they have not produced any more<\/p>\n<p>witness in the trial.\n<\/p>\n<p>        In the circumstances, it is apparent<\/p>\n<p>that the prosecution is not interested in<\/p>\n<p>early disposal of the trial.<\/p>\n<p>        As    a    result,      the    application        is<\/p>\n<p>allowed. Let petitioner (Munna Mistry) be<\/p>\n<p>enlarged on bail on furnishing bail bond<\/p>\n<p>of Rs.10,000\/- (Rupees ten thousand) with<\/p>\n<p>two sureties of the like amount each to<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>     the satisfaction of F.T.C. III, Gaya in<\/p>\n<p>     Sessions Trial No.434\/09 arising out of<\/p>\n<p>     Konch        P.S.        Case     No.128\/2007)             with<\/p>\n<p>     conditions         as    laid    down    in    sub-section<\/p>\n<p>     (3)     of    Section       437     of       the    Code     of<\/p>\n<p>     Criminal Procedure as may be applicable<\/p>\n<p>     and also that one of the bailors shall be<\/p>\n<p>     a close relation of the petitioner. In<\/p>\n<p>     case of breach of any of the conditions<\/p>\n<p>     at any stage to the satisfaction of the<\/p>\n<p>     concerned      court       below,       it    shall    be    at<\/p>\n<p>     liberty       to        cancel    the        bail     of    the<\/p>\n<p>     petitioner and take steps for his arrest.<\/p>\n<p>                              (J.
