Justice R.BASANT\n\n Dated :31\/07\/2008\n\n O R D E R\n                          R.BASANT, J.\n                       ----------------------\n               Crl.M.C.Nos.2817 &amp; 2818 of 2008\n                   ----------------------------------------\n               Dated this the 31st day of July 2008\n\n                              O R D E R\n<\/pre>\n<p>     The common petitioners in these two cases face indictment<\/p>\n<p>in these prosecutions for offences punishable inter alia under<\/p>\n<p>Section 153(A) read with 149 I.P.C.\n<\/p>\n<p>     2.   The available co-accused have already been tried,<\/p>\n<p>found not guilty and acquitted. The petitioners have now come<\/p>\n<p>before this court to report to the court that they have settled<\/p>\n<p>their disputes with the alleged victims. Some of the offences are<\/p>\n<p>non-compoundable; but it is prayed that the dictum in <a href=\"\/doc\/1442974\/\">Madan<\/p>\n<p>Mohan Abbot v. State of Punjab<\/a> [2008 AIR SCW 2287] may<\/p>\n<p>be invoked and notwithstanding the fact that the offences are<\/p>\n<p>non-compoundable, powers under Section 482 Cr.P.C may be<\/p>\n<p>pressed into service to bring about premature termination of the<\/p>\n<p>proceedings.\n<\/p>\n<p>     3.   Notice was given to the learned Public Prosecutor.<\/p>\n<p>The learned Public Prosecutor points out that this is not a fit case<\/p>\n<p>where the dictum in Madan Mohan (Supra) can safely be<\/p>\n<p>invoked and applied. It is submitted that the offences alleged<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.2817 &amp; 2818 of 2008   2<\/span><\/p>\n<p>include the offence punishable under Section 153A I.P.C and it<\/p>\n<p>cannot be said that the dispute in this case is one which is<\/p>\n<p>personal and private between the parties who have settled the<\/p>\n<p>disputes.    In any view of the matter there is absolutely no<\/p>\n<p>justification in invoking the said dictum in this case, submits the<\/p>\n<p>learned Public Prosecutor.\n<\/p>\n<p>      4.    I have already adverted to the dictum in Madan<\/p>\n<p>Mohan (Supra) in the decision in Santhosh v.State of Kerala<\/p>\n<p>[2008(3) KLT 240] and it has been held that Madan Mohan<\/p>\n<p>(Supra) does not lay down an abstract principle of law that when<\/p>\n<p>composition of a non-compoundable offence takes place,<\/p>\n<p>conviction of law is found to be possible straight away powers<\/p>\n<p>under Section 482 Cr.P.C can be invoked to quash the<\/p>\n<p>proceedings against the indictees.      The acquittal of the co-<\/p>\n<p>accused cannot also deliver any advantage to the petitioners in<\/p>\n<p>the light of the decision in <a href=\"\/doc\/217622\/\">Moosa vs. Sub Inspector of Police<\/a><\/p>\n<p>[2006(1) KLT 552 (FB)]. I am in these circumstances satisfied<\/p>\n<p>that the prayer for invocation of the extraordinary inherent<\/p>\n<p>jurisdiction in favour of the petitioners to bring to premature<\/p>\n<p>termination the prosecutions under Section 153A I.P.C is not<\/p>\n<p>justified.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.2817 &amp; 2818 of 2008   3<\/span><\/p>\n<p>      5.
