Justice K.HEMA\n\n Dated :30\/06\/2010\n\n O R D E R\n                             K.HEMA, J.\n                          ------------------\n                      B.A. No. 3512 of 2010\n                 ------------------------------------\n               Dated this the 30th day of June, 2010\n\n                             O R D E R\n<\/pre>\n<p>      Petition for anticipatory bail.\n<\/p>\n<p>     2.   The alleged offences are under Sections 323, 324, 326<\/p>\n<p>and 452 read with Section 34 of the Indian Penal Code. According<\/p>\n<p>to prosecution, on 21.05.2010 at about 9 P.M.,         petitioners<\/p>\n<p>(accused nos. 1, 4, 2 and 3 respectively), trespassed into the sit-<\/p>\n<p>out of the house of the de facto complainant and assaulted de<\/p>\n<p>facto complainant by using sticks and hand and thereby<\/p>\n<p>committed various offences.\n<\/p>\n<p>     3. Learned counsel for petitioners submitted that accused<\/p>\n<p>nos. 2 and 3 were injured in the incident. They were assaulted by<\/p>\n<p>de facto complainant by using an iron rod on their head and they<\/p>\n<p>also sustained injuries. They were hospitalised on the same night<\/p>\n<p>and they were discharged only on        22nd and 24th May, 2010.<\/p>\n<p>According to petitioners, the incident happened at a junction, not<\/p>\n<p>in the house, as alleged. But on knowing that petitioners were<\/p>\n<p>admitted in the      hospital, de facto complainant got himself<\/p>\n<p>admitted in hospital. He had not sustained any serious injuries,<\/p>\n<p><span class=\"hidden_text\">B.A. No. 3512 \/ 2010             2<\/span><\/p>\n<p>but a crime was registered on a statement given by him under<\/p>\n<p>Section 326 of the Indian Penal Code etc.<\/p>\n<p>      4. It is also submitted that false allegation is made that the<\/p>\n<p>incident happened inside the house of the de facto complainant,<\/p>\n<p>for the purpose of including the offence under Section 452 of the<\/p>\n<p>Indian Penal Code. Petitioners apprehend that they will suffer<\/p>\n<p>irreparable injury and loss, if anticipatory bail is not granted. It<\/p>\n<p>is also pointed out by the learned counsel for petitioners that de<\/p>\n<p>facto complainant was actually attacking the accused in this case<\/p>\n<p>on the belief that they were spreading rumours about his wife.<\/p>\n<p>However, as per the allegation in the F.I. Statement, the motive<\/p>\n<p>alleged is as follows: de facto complainant, warned the accused<\/p>\n<p>not to spread rumours about his wife and also that he would<\/p>\n<p>complaint to the police if they continued to do so. Therefore,<\/p>\n<p>accused had enmity towards de facto complainant.<\/p>\n<p>      5. Learned Public Prosecutor submitted that de facto<\/p>\n<p>complainant has not sustained any grievous hurt and hence,<\/p>\n<p>offence under Section 326 of the Indian Penal Code is deleted.<\/p>\n<p><span class=\"hidden_text\">B.A. No. 3512 \/ 2010             3<\/span><\/p>\n<p>Iron rod and sticks were used for the offence and those are to be<\/p>\n<p>recovered, for which, petitioners interrogation is necessary, it is<\/p>\n<p>submitted.\n<\/p>\n<p>      6. On hearing both sides and on going through           the<\/p>\n<p>documents produced as well as the case diary in this case, it<\/p>\n<p>appears that second and third accused sustained injuries on their<\/p>\n<p>head and there is an allegation that they were assaulted using<\/p>\n<p>iron rod on 21.05.2010 at about 9 P.M. and they were<\/p>\n<p>hospitalised also. On going through the F.I. Statement in this<\/p>\n<p>case, it can be seen that de facto complainant          made an<\/p>\n<p>allegation that his two teeth were loosened in the assault and<\/p>\n<p>hence offence under Section 326 was included while registering<\/p>\n<p>the crime. But, the wound certificate relating to him shows that<\/p>\n<p>he had no injury to the tooth at all.\n<\/p>\n<p>      7. In such circumstances, it appears that petitioners have a<\/p>\n<p>strong and arguable case regarding the place where incident<\/p>\n<p>happened. The defence can be established only during trial. At<\/p>\n<p>the same time, considering the serious nature of the allegations<\/p>\n<p><span class=\"hidden_text\">B.A. No. 3512 \/ 2010                4<\/span><\/p>\n<p>made, I do not think that anticipatory bail will be the remedy.<\/p>\n<p>Petitioners have required for interrogation and recovery of the<\/p>\n<p>weapons allegedly used and hence following order is passed.<\/p>\n<p>         1.    Petitioner  shall   surrender      before   the<\/p>\n<p>                investigating officer within seven days from<\/p>\n<p>                today and co-operate with the investigation.<\/p>\n<p>          2.    On such surrender, if petitioners are arrested,<\/p>\n<p>                offence under section 452 will be treated as<\/p>\n<p>                not included for the purpose of bail.\n<\/p>\n<p>          This petition is disposed of.\n<\/p>\n<\/p>\n<p>                                         K.
