Justice ANTONY DOMINIC\n\n Dated :27\/11\/2007\n\n O R D E R\n                  ANTONY DOMINIC, J.\n\n\n              = = = = = = = = = = = = = =\n\n              W.P.(C) No. 33108 OF 2007 N\n\n              = = = = = = = = = = = = = =\n\n\n           Dated this the 27th November 2007\n\n                   J U D G M E N T\n<\/pre>\n<p>    Petitioner submits that petitioner was assigned 20<\/p>\n<p>cents of land in Survey No.401\/1 and 402 of Mulavukad<\/p>\n<p>Village and the complaint is that there has been<\/p>\n<p>reduction in the extent.    On this basis, petitioner<\/p>\n<p>sought for a survey of the property.   It is stated in<\/p>\n<p>Ext.P3 that pursuant to the order dated 29\/8\/05 of the<\/p>\n<p>District Collector, survey has in fact been completed<\/p>\n<p>and that the property has been fully measured.      But<\/p>\n<p>then the petitioner submits that no survey has in fact<\/p>\n<p>taken place and that, at any rate, no notice of any<\/p>\n<p>such survey was given to him.     It is complaining of<\/p>\n<p>that the petitioner has filed Ext.P4 to the District<\/p>\n<p>Collector  in   which  he   has   reiterated  all  his<\/p>\n<p>complaints.\n<\/p>\n<p>    2.   In view of the pendency of the matter before<\/p>\n<p>the District Collector, I dispose of this writ petition<\/p>\n<p>directing that the 1st respondent shall examine the<\/p>\n<p>W.P.(C)No.33108\/2007\n<\/p>\n<p>                          &#8211; 2 &#8211;\n<\/p>\n<p>grievance of the petitioner as highlighted in Ext.P4,<\/p>\n<p>and   if   satisfied, direct   a fresh   survey to   be<\/p>\n<p>conducted. Before any such decision is taken on Ext.P4,<\/p>\n<p>parties affected by such decision should also be put on<\/p>\n<p>notice and their views have to be ascertained.
