JUSTICE MOHIT S. SHAH)<\/p>\n<p>1.\t\tThis<br \/>\nappeal is directed against the judgment dated 25th<br \/>\nNovember, 1996 of the learned Single Judge dismissing the petition<br \/>\nfiled by the appellant.  The appellant had filed the Special Civil<br \/>\nApplication challenging the order of eviction from the Government<br \/>\nquarters.  The learned Single Judge dismissed the petition on the<br \/>\nground that the petitioner had no legal right to retain the<br \/>\npossession of the Government quarters after he acquired his own<br \/>\npremises in the city of Ahmedabad.  While dismissing the petition,<br \/>\nthe learned Single Judge also directed the petitioner to vacate the<br \/>\nquarters forthwith and also directed the petitioner to pay costs of<br \/>\nRs.2,000\/- to the State Government.\n<\/p>\n<p>2.\t\tThis<br \/>\nLetters Patent Appeal came to be admitted on 14th<br \/>\nFebruary, 1997 when the appellant was represented by his learned<br \/>\nadvocate Mr. J.V. Desai.  Unfortunately, upon the sad demise of Mr.<br \/>\nJ.V. Desai, the Registry sent a notice to the appellant on 04th<br \/>\nAugust, 2008.  As per the office endorsement, the notice could not be<br \/>\nserved as the appellant was not found (he has sold his house).  In<br \/>\nview of this development, we would have ordinarily called upon the<br \/>\nrespondent authorities to find out the present address of the<br \/>\nappellant.  However, considering the fact that what is challenged in<br \/>\nthis appeal is the order of the learned Single Judge dismissing the<br \/>\npetition and requiring the appellant   petitioner to vacate the<br \/>\nGovernment quarters and the appellant has obviously already vacated<br \/>\nthe Government quarters, we do not think any useful purpose would be<br \/>\nserved by keeping this appeal pending.  The appeal is accordingly<br \/>\ndismissed as infructuous.\n<\/p>\n<p>\t\tCivil<br \/>\nApplication for stay is also dismissed.\n<\/p>\n<p>\t\t\t\t\t\t\t(<br \/>\nMohit S.
