JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\nDate\n: 12\/05\/2010 \n\n \n\n \n \n\n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>\tThis<br \/>\n\tpetition has been filed under Article 226 read with Articles 21 and<br \/>\n\t22(5) of the Constitution of India with a prayer to quash and set<br \/>\n\taside order of detention dated 19.01.2010 passed by the Commissioner<br \/>\n\tof Police, Ahmedabad, in exercise of powers under the provisions of<br \/>\n\tthe Gujarat Prevention of Anti-Social Activities Act, 1985 ( the<br \/>\n\tAct  for short).\n<\/p>\n<p>\tThe<br \/>\n\tdetenu has been branded as a `bootlegger&#8217;, within the meaning of<br \/>\n\tSection 2(b) of the Act, as he has been found to be involved in an<br \/>\n\toffence under the Bombay Prohibition Act.\n<\/p>\n<p>\tWhile<br \/>\n\tpassing the order of detention dated 19.01.2010, which was executed<br \/>\n\ton the same day, the detaining authority has taken into<br \/>\n\tconsideration that one offence under the Bombay Prohibition Act has<br \/>\n\tbeen registered against the detenu and that the activities carried<br \/>\n\ton by him are detrimental to the maintenance of public order, and<br \/>\n\tprejudicial to public health.\n<\/p>\n<p>\tI<br \/>\n\thave heard Mr.Banna Dutta, learned advocate for Mr.A.R.Shaikh,<br \/>\n\tlearned counsel for the petitioner, Ms.Vandana Bhatt, learned<br \/>\n\tAssistant Government Pleader, and perused the averments made in the<br \/>\n\tpetition and documents on record.\n<\/p>\n<p>\tIt<br \/>\n\tis submitted by the learned counsel for the petitioner that merely<br \/>\n\tby registration of one offence under the Bombay Prohibition Act, it<br \/>\n\tcannot be said that  public order  has been disturbed by the<br \/>\n\tdetenu. Moreover, no statements of witnesses to substantiate these<br \/>\n\tallegations have been recorded by the detaining authority           <\/p>\n<p>\t            so as to arrive at a subjective satisfaction that the<br \/>\n\tactivities of the detenu are detrimental to public order and<br \/>\n\tprejudicial to public health, therefore, the petition may be<br \/>\n\tallowed.\n<\/p>\n<p>\tThe<br \/>\n\tlearned Assistant Government Pleader has supported the order of<br \/>\n\tdetention and prayed for dismissal of the petition.\n<\/p>\n<p>\tHaving<br \/>\n\theard the learned counsel for the respective parties and having<br \/>\n\tperused the averments made in the petition as well as the contents<br \/>\n\tof the impugned order, and other documents on record, in the<br \/>\n\tconsidered view of this Court, in order to arrive at a subjective<br \/>\n\tsatisfaction that the activities alleged to be carried on by the<br \/>\n\tdetenu, namely `bootlegging&#8217;, are prejudicial to the maintenance of<br \/>\n\tpublic order and prejudicial to public health, the detaining<br \/>\n\tauthority must rely upon cogent and credible evidence, and material<br \/>\n\ton record. It must be taken into consideration by the detaining<br \/>\n\tauthority that the activities of the detenu, either directly or<br \/>\n\tindirectly, are likely to cause harm, danger or alarm, or feeling of<br \/>\n\tinsecurity among the general public or a grave danger to life,<br \/>\n\tproperty or public health. While undertaking this exercise, the<br \/>\n\tdetaining authority must draw a clear line between cases falling<br \/>\n\twithin the category of breach of law and order, and breach of<br \/>\n\tpublic order. In the present case, the said exercise does not seem<br \/>\n\tto have been done by the detaining authority, as there is nothing on<br \/>\n\trecord to suggest that the activities of the detenu have given rise<br \/>\n\tto a feeling of alarm in the public or posed a grave danger to<br \/>\n\tpublic order or public health. It cannot be said that merely by<br \/>\n\tregistration of one offence under the Bombay Prohibition Act, the<br \/>\n\tactivities of the detenu are causing insecurity, and fear among the<br \/>\n\tgeneral public or are detrimental to public health or maintenance of<br \/>\n\tpublic order.\n<\/p>\n<p>\tThe<br \/>\n\tSupreme Court, in Darpan @ <a href=\"\/doc\/1753534\/\">Dharban Kumar Sharma v. State of Tamil<br \/>\n\tNadu and Ors.<\/a> (2003)2 SCC 313 has laid down that there should be<br \/>\n\tmaterial on record to show that the incidence and activities of the<br \/>\n\tdetenu are so grave as to disturb the even tempo of life of the<br \/>\n\tcommunity in the locality, or disturb the general peace and<br \/>\n\ttranquility, or create a sense of alarm and insecurity in the<br \/>\n\tlocality.\n<\/p>\n<p>\tHaving<br \/>\n\tperused the contents of the impugned order of detention and the<br \/>\n\tdocuments annexed to the petition, there is no material on record to<br \/>\n\tindicate that the activities of the detenu fall in this category.<br \/>\n\tThe registration of one prohibition case by itself cannot be<br \/>\n\tconsidered to be a breach of public order, and nor is there any<br \/>\n\tmaterial on record to show that the same has adversely affected the<br \/>\n\tmaintenance of public order.\n<\/p>\n<p>\tIn<br \/>\n\tview of the above, the petition is allowed. The impugned order of<br \/>\n\tdetention dated 19.01.2010 passed by the Commissioner of Police,<br \/>\n\tAhmedabad, is quashed and set aside. The detenu is ordered to be set<br \/>\n\tat liberty forthwith, if not required in any other case. Rule is<br \/>\n\tmade absolute accordingly.
