On the ground that he<br \/>\nhad remained absent from duty unauthorizedly, charge-sheet was issued<br \/>\nto him and ultimately, vide order dated 01.10.1991, he was dismissed<br \/>\nfrom service. Against the said action of the respondent, the<br \/>\npetitioner raised a dispute, which, ultimately, culminated into a<br \/>\nreference before the Court below. The Labour Court, after considering<br \/>\nthe evidence on record, dismissed the Reference but, granted a<br \/>\nlump-sum compensation of Rs.30,000\/- to the petitioner, by way of the<br \/>\nimpugned award. Being aggrieved by the same, the petitioner has<br \/>\npreferred the present petition.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. It appears from the record that the petitioner was<br \/>\nirregular and demonstrated indiscipline during his service with the<br \/>\nrespondent-Company. The petitioner was warned to improve his behavior<br \/>\nand conduct on not less than forty (40) different occasions by the<br \/>\nrespondent-Company. He was also suspended in the past. The petitioner<br \/>\nhad also remained absent from duty unauthorizedly for a period of<br \/>\nmore than ten years.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above factual aspects, the Reference was rejected by the<br \/>\nLabour Court. I have gone through the impugned award and I find that<br \/>\nno illegality or impropriety has been committed by the Labour Court<br \/>\nwhile rejecting the Reference of the petitioner. I am in complete<br \/>\nagreement with the reasonings given by the Labour Court and hence,<br \/>\nfind no reasons to interfere with the same. In fact, the petitioner<br \/>\nhas been awarded Rs.30,000\/- as lump-sum compensation looking to the<br \/>\nlong period of service, which, in my opinion, is just and<br \/>\nappropriate.\n<\/p>\n<p>5.\tFor<br \/>\nthe foregoing reasons, the petition is dismissed. It is, however,<br \/>\nclarified that if the said amount of Rs.30,000\/- [Rupees Thirty<br \/>\nthousand only] and other dues, if any, have not been paid to the<br \/>\npetitioner, then the same shall be paid within a period of two months<br \/>\nfrom today. With the above direction, the petition stands disposed<br \/>\nof. Rule is discharged. Interim relief, if any, stands vacated. Mr.<br \/>\nVarun K.
