JUSTICE P.SATHASIVAM           \n\nC.R.P.NO.  232 OF 2002  \n\n1.K.S.Subramanian  \nSon of K.S.Sankaran \n5, Second Cross Street \nRamappa Nagar, Perungudi   \nChennai 96 \n\n2.V.Vasanthi Devi\nD\/o P.V.Dass \n2A Palace View apartments  \n88, santhome High Road  \nR.A.Puram, \nChennai 28                                      ..Petitioners\n\n               - Vs -\n\nNIL                                              ..Respondent \n\n!For petitioners: Mr.K.Chandru\n                 Senior counsel for\n                 Mr.R.Yashod Varadhan  \n\nPetition is filed under Article 227 of the Constitution of\nIndia against the order dated 24.9.2001 in H.M.O.P.No.58 of\n2001 on the file of Sub-court, Poonamallee.\n\n:ORDER  \n<\/pre>\n<p>Aggrieved by the order of the Subordinate Judge,<br \/>\nPoonamallee dated 24.9.2001 made in H.M.O.P.No.  58 of 2001<br \/>\ndismissing the joint petition filed for divorce by consent<br \/>\nunder Section 13 B of the Hindu Marriage Act, 1955, the<br \/>\npetitioners have preferred the above revision under Article<br \/>\n227 of the Constitution of India.  The petitioners have filed<br \/>\nthe said O.P.  before the Subordinate Court, Poonamallee under<br \/>\nSection 13 B for divorce by mutual consent.  In the said<br \/>\npetition, it is stated that the petitioners got married on<br \/>\n22.9.1960 at Dindigul as per customary rituals under Hindu<br \/>\nMarriage Act, 1955.  After the said marriage, they lived<br \/>\ntogether at various places and they last resided at No.5, 2 nd<br \/>\nCross Street, Ramappa Nagar, Perungudi, Chennai 600 096 which<br \/>\nis the house built and owned by the first petitioner.  They<br \/>\nhave one son and one daughter born out of their wed lock.  The<br \/>\nson is aged 39 years and is married and is now teaching at<br \/>\nCanada in a University and is well settled.  Their daughter is<br \/>\naged about 31 years who is also highly qualified and is<br \/>\nmarried to the citizen of U.S.A.  and is also settled in<br \/>\nU.S.A.  It is further stated that the petitioner could not<br \/>\nlive with each other as serious differences have crept in<br \/>\nbetween them on many personal and other issues which could not<br \/>\nbe reconciled.  Therefore, the second petitioner took up a<br \/>\nseparate residence at Flat 2 A Palace view Apartments, 88 ,<br \/>\nSanthome High Road, R.A.  Puram, Chennai 600 028 and started<br \/>\nliving from that place since 15.1.2000 .\n<\/p>\n<p>2.Ever since the second petitioner took up separate<br \/>\nresidence, the petitioners have had deep discussions and<br \/>\ndeliberations and found that they are not compatible to each<br \/>\nother and they cannot continue the marriage any more.  The<br \/>\nPetitioners have been living separately for a period of more<br \/>\nthan one year prior to the presentation of this petition.  The<br \/>\nfirst petitioner is a retired official from the Asian<br \/>\nDevelopment Bank at Manila and is a pensioner and the second<br \/>\npetitioner is a retiree from the Tamil Nadu Government service<br \/>\nand she is also a pensioner.  Both of them do not have any<br \/>\nliability to maintain each other and they have no claim or<br \/>\nobligation to be performed by any one to the other petitioner.\n<\/p>\n<p>3.In these circumstances they filed a petition under<br \/>\nSection 13 B of the Hindu Marriage Act to dissolve their<br \/>\nmarriage mutually.\n<\/p>\n<p>4.After taking me through the various averments made<br \/>\nin the joint petition, their statements before the Court and<br \/>\nthe relevant provision namely Section 13 B of the Hindu<br \/>\nMarriage Act, Mr.K.Chandru, learned Senior Counsel would<br \/>\ncontend that inasmuch as the petitioners have satisfied and<br \/>\ncomplied with the mandatory provision, the Subordinate Judge<br \/>\nought to have granted divorce by consent as claimed by the<br \/>\npetitioners.\n<\/p>\n<p>5.I have already referred to the necessary averments<br \/>\nmade in the joint petition filed by both the parties.  Apart<br \/>\nfrom the assertion that they were living separately for more<br \/>\nthan a period of one year prior to the filing of the present<br \/>\npetition, they also highlighted that their misunderstanding<br \/>\nand difficult to rejoin.  They also stated that they are not<br \/>\ndepending on any one and they are getting sizeable income by<br \/>\nway of retirement benefits.  Having seen the necessary<br \/>\naverments in the petition and their statements as P.W.1 and<br \/>\nP.W.2, the learned Subordinate Judge by noticing that both of<br \/>\nthem chatting with each other prior to their evidence by<br \/>\nsuspecting their bona fides dismissed the said application.<br \/>\nThe reasoning in the conclusion of the learned Subordinate<br \/>\nJudge cannot be sustained for the following reasons.\n<\/p>\n<p>5.In this regard it is relevant to note Section 13 B<br \/>\nwhich enables the parties to seek for divorce by mutual<br \/>\nconsent.\n<\/p>\n<p>&#8220;13-B Divorce by mutual consent.-(1) Subject to the provisions<br \/>\nof this Act a petition for dissolution of marriage by a decree<br \/>\nof divorce may be presented to the district court by both the<br \/>\nparties to a marriage together, whether such marriage was<br \/>\nsolemnized before or after the commencement of the Marriage<br \/>\nLaws (Amendment)Act, 1976, on the ground that they have been<br \/>\nliving separately for a period of one year or more, that they<br \/>\nhave not been able to live together and that they have<br \/>\nmutually agreed that the marriage should be dissolved.&#8221;<br \/>\nIt is clear from sub-section (1) of Section 13 B that a<br \/>\npetition for dissolution of marriage by a decree of divorce<br \/>\ncan be presented on the ground that they have been living<br \/>\nseparately for a period of one year or more, that they have<br \/>\nnot been able to live together.  They must also allege and<br \/>\nprove that they have mutually agreed that the marriage should<br \/>\nbe dissolved.\n<\/p>\n<p>6.As stated earlier, the petitioners have fulfilled<br \/>\nthe conditions prescribed for divorce by mutual consent as<br \/>\nprovided in sub-section (1 ) of Section 13 B.\n<\/p>\n<p>7.Learned Senior counsel for the petitioner has also<br \/>\nbrought to my notice the Division Bench decision of this Court<br \/>\nreported in 1990 (1) L.W.  64 <a href=\"\/doc\/312139\/\">K.SANKARAN V.  S.  REVATHI.  In<\/a><br \/>\nthis case, the parties therein filed a joint petition under<br \/>\nSection 13 B of the Act for dissolution of marriage by decree<br \/>\nof divorce.  The Principa l Family Court, after entertaining<br \/>\nthe petition , adjourned it to a date six months later and on<br \/>\nthe adjourned date, on the parties appearing made efforts to<br \/>\nreconcile difference between the parties.  Since the efforts<br \/>\ndid not succeed the Family Court proceeded to examine the<br \/>\nparties.  Both the parties were examined as P.W.1 and P.w.2 .<br \/>\nThey explained the marriage and the subsequent development.<br \/>\nAfter noting their evidence the Principal Family court found<br \/>\nthat the incredients with reference to the parties not being<br \/>\nable to live together is not satisfied even though the other<br \/>\ningredients contemplated under Section 13 B do stand satisfied<br \/>\nand in this view the Principal Family Court dismissed the<br \/>\npetition for dissolution of marriage by a decree of divorce.<br \/>\nAgainst the said order the parties therein filed an appeal<br \/>\nbefore the Division Bench of this Court.  After considering<br \/>\nthe materials placed and Section 13 B the Division Bench has<br \/>\ncome to the following conclusion.\n<\/p>\n<p>&#8220;While this being so, we are not able to appreciate the<br \/>\nreasoning of the Principal Family Court that there is lack of<br \/>\nsubstantiation of this ingredient by the parties.  The<br \/>\nPrincipal Family Court adversely comments upon the<br \/>\nnon-disclosure of the reason by the respondent with reference<br \/>\nto her unwillingness to live with the appellant.  Whatever may<br \/>\nbe the reasons, psychological or otherwise, it stands<br \/>\nestablished that the parties, viz., the husband and the wife,<br \/>\nhave not been able to live together and they have been living<br \/>\nseparately for a period of more than a year and they have<br \/>\nmutually agreed that the marriage should be dissolved.  This<br \/>\nis all S.13-B of the Act requires and when the said ingredient<br \/>\nstands satisfied it is not possible to throw out the joint<br \/>\npetition.  That they were living together till 6.3.1987 is of<br \/>\nno relevance at all in this matter.  We are of the view that<br \/>\nthe Principal Family Court committed an error in dismissing<br \/>\nthe joint petition for dissolution of marriage by a decree of<br \/>\ndivorce for the reasons expressed by it.  The ingredients of<br \/>\nS.13-B of the Act having been made out and substantiated we<br \/>\nare obliged to countenance the prayer for dissolution of<br \/>\nmarriage by a decree of divorce.  Accordingly, this civil<br \/>\nmiscellaneous appeal is allowed, the judgment and decree of<br \/>\nthe Principal Family Court in M.O.P.No.586 of 1988 are set<br \/>\naside and we grant a decree for divorce dissolving the<br \/>\nmarriage of the appellant and the respondent.&#8221;\n<\/p>\n<p>8.The said conclusion of the Division Bench is<br \/>\ndirectly applicable to our case.  I have already referred to<br \/>\nthe claim of both parties as in the joint petition and in<br \/>\ntheir statement as P.W.1 and P.W.2.  As observed by the<br \/>\nDivision Bench whatever may be the reasons or psychological or<br \/>\nother wise, it stands established that the parties namely the<br \/>\nhusband and wife have not been able to live together and they<br \/>\nhave been living separately for a period of more than one year<br \/>\nand they have been mutually agreed that the marriage should be<br \/>\ndissolved.\n<\/p>\n<p>9.Here, in our case, both of them have established and<br \/>\nsatisfied the incredients of Sub-Section(1) of Section 13 B.<br \/>\nWhen the said incredients stands satisfied the Court below is<br \/>\nbound to accept the petition and grant relief of divorce by<br \/>\nmutual consent.  All other temporary action or activities in<br \/>\nthe Court hall are immaterial and alien for consideration.  I<br \/>\nam satisfied that the learned Subordinate Judge has committed<br \/>\nan error in dismissing the joint memo for dissolution of<br \/>\nmarriage for the reasons expressed by it.  The incredients of<br \/>\nSection 13 B of the Act having been made out and satisfied the<br \/>\nCourt has no other option except to accept the prayer for<br \/>\ndissolution of marriage by a decree of divorce.  Accordingly,<br \/>\nthe C.R.P.is allowed.  The judgment and decree of the<br \/>\nSubordinate Court, Poonamallee in H.M.O.P.No.  58 of 2001 is<br \/>\nset aside and a decree for divorce dissolving the marriage of<br \/>\nthe petitioners is granted.
