     Ext.P1 is a tender notice published by the respondent<\/p>\n
Panchayat for conduct of Jankar service, connecting<\/p>\n
Manjapetti Thekkekovilakam area. Petitioner was one of the<\/p>\n
bidders. In Ext.P2 judgment rendered by this court in WP<\/p>\n
(c).No.18729\/2008 filed by the petitioner, allowing the writ<\/p>\n
petition, this court held as follows;\n<\/p>\n
                       “For all these reasons, I am satisfied<\/p>\n
                       that the petitioner is justified in<\/p>\n
                       seeking confirmation of the auction in<\/p>\n
                       his favour. Therefore, the writ petition<\/p>\n
                       is disposed of directing that auction<\/p>\n
                       pursuant to Ext.P3 will be confirmed in<\/p>\n
                       favour of the petitioner. Panchayat is<\/p>\n

                      directed to require the petitioner to<\/p>\n
                      remit the EMD which it has refunded<\/p>\n
                      and confirm the auction in his name as<\/p>\n
                      expeditiously as possible, at any rate<\/p>\n
                      within 10 days of receipt of a copy of<\/p>\n
                      this judgment.<\/p><\/blockquote>\n
<\/blockquote>\n
                            Needless to say that the above<\/p>\n
                      directions     are    issued    on    the<\/p>\n
                      assumption that the petitioner satisfied<\/p>\n
                      all eligibility conditions of Ext.P3 and<\/p>\n
                      this is a matter for the Panchayat to<\/p>\n
                      examine and in case if he does not<\/p>\n
                      satisfy any of the eligibility conditions<\/p>\n
                      of Ext.P3, Panchayat will not be bound<\/p>\n
                      to confirm the auction.”<\/p><\/blockquote>\n
     2. In this writ petition, the complaint is that, by Ext.P3<\/p>\n
dated 19.7.2008, petitioner was called upon to comply with<\/p>\n
the requirements mentioned therein within 3 days. He is<\/p>\n

also asked to execute the agreement in a stamp paper<\/p>\n
worth 5% of the contract value and also to remit 50% of<\/p>\n
the bid amount. According to him, in terms of the tender<\/p>\n
notice his obligation is to pay    the amount only in four<\/p>\n
instalments and therefore the demand for payment of 50%<\/p>\n
is illegal.\n<\/p>\n
      3. The Panchayat has filed a counter affidavit, wherein<\/p>\n
it is stated that, in terms of the judgment, the Panchayat<\/p>\n
was required to complete the formalities within 10 days of<\/p>\n
the receipt of the judgment. The judgment was received by<\/p>\n
them on 18.7.2008 and it was thereafter the Panchayat has<\/p>\n
Ext.P3 required the petitioner to complete the formalities<\/p>\n
within 3 days. It is stated that on receipt of Ext.P3,<\/p>\n
petitioner had made Ext.R1 application dated 24.7.2008<\/p>\n
seeking extension of time till 27.8.2007 and that the<\/p>\n
Panchayat has granted time as requested for. It is stated<\/p>\n
that during the extended period, the petitioner did not<\/p>\n
comply with the directions in Ext.P3.\n<\/p>\n

     4. In so far as the demand for payment of 50% of the<\/p>\n
amount payable is concerned, referring to Ext.P1 tender<\/p>\n
notice, counsel for the Panchayat submits that clause 5<\/p>\n
provides that at the time of provisional confirmation, the<\/p>\n
successful bidder is required to remit one of the four<\/p>\n
instalments payable by him. It is stated that at the time of<\/p>\n
execution of the agreement, bidder is to remit the second<\/p>\n
instalment. Since the petitioner was to execute the<\/p>\n
agreement as directed by this court, in view of the fact that<\/p>\n
the petitioner had not made the initial payment,         the<\/p>\n
Panchayat required him to remit 50% towards the first and<\/p>\n
second instalments payable. Similarly, so far as the<\/p>\n
contention of the petitioner against the direction of the<\/p>\n
Panchayat to execute the agreement on a stamp paper<\/p>\n
worth 5% of the contract value, the counsel for the<\/p>\n
Panchayat has referred me to Ext.P1 and submits that it is<\/p>\n
one of the conditions of the tender itself.<\/p>\n

     5. I have considered the    submissions made by the<\/p>\n
petitioner and also the standing counsel who entered<\/p>\n
appearance on behalf of the Panchayat. In so far as the<\/p>\n
paucity of time pleaded by the petitioner, I must say that ,<\/p>\n
I do not find any substance in the contention. This is for the<\/p>\n
reason that, though initially by Ext.P3, the petitioner was<\/p>\n
granted only 3 days time which included a Sunday and a<\/p>\n
Hartal day, by Ext.R1 is dated 24.7.2008, at his request<\/p>\n
the Panchayat had extended time till 27.8.2008. If that be<\/p>\n
so,   petitioner   had sufficient time   to   complete     the<\/p>\n
requirements of Ext.P3. That apart in this writ petition filed<\/p>\n
on 30th July, 2008, the petitioner has not even mentioned<\/p>\n
about the filing of the request for enlargement of time by<\/p>\n
Ext.R1. Thus, since the Panchayat on their own extended<\/p>\n
time till 27.8.2007, the petitioner cannot      complain of<\/p>\n
paucity of time to comply with Ext.P3.\n<\/p>\n
     6. What remains is the objection of the petitioner<\/p>\n
regarding the demand of the Panchayat for remitting 50% of<\/p>\n

the bid amount. As already noticed, it is following Ext.P2<\/p>\n
judgment of this court that the Panchayat was required to<\/p>\n
execute the agreement with the petitioner. In terms of the<\/p>\n
schedule fixed in Ext.P1, by the time the agreement is<\/p>\n
executed, the bidder should have paid 50% of the amount<\/p>\n
due. If that be so, I cannot find fault with the Panchayat in<\/p>\n
directing the petitioner to pay 50% of the amount due.<\/p>\n
     7. Similar is the case with the direction to execute the<\/p>\n
agreement on a stamp paper worth 5% of the contract<\/p>\n
value, which also cannot be objected in the light of clause<\/p>\n
8 of Ext.P1.\n<\/p>\n
     On the whole, I am satisfied that there is absolutely no<\/p>\n
arbitrariness on the part of the Panchayat warranting<\/p>\n
interference.\n<\/p>\n
     Writ Petition fails and is dismissed.\n<\/p>\n<\/p>\n
