SHAH\n\t\t\n\t\n\n \n\nDate\n: 08\/11\/2011 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tThe<br \/>\npresent Criminal Revision Application under Section 397 read with<br \/>\nSection 401 of the Code of Criminal Procedure has been preferred by<br \/>\nthe petitioner &#8211; original complainant challenging the impugned<br \/>\njudgement and order dated 30\/10\/2001 passed by learned Sessions<br \/>\nJudge, Surat in Criminal Appeal No.20 of 2001 acquitting the accused<br \/>\npersons from the offences punishable under  Sections 341, 506 read<br \/>\nwith Section 114 of the Indian Penal Code.\n<\/p>\n<p>2.\t\tFacts<br \/>\nleading to the present Criminal Revision Application, in nutshell,<br \/>\nare as under :\n<\/p>\n<p>\t\tThe<br \/>\nrespondents &#8211; accused persons came to be tried by the learned<br \/>\nTrial Court for the offences punishable under Sections 188, 341, 506<br \/>\nread with Section 114 of the Indian Penal Code. The learned Judicial<br \/>\nMagistrate, First Class, Surat vide judgement and order dated<br \/>\n16\/03\/2001 acquitted the accused persons from the offence punishable<br \/>\nunder Section 188 of the Indian Penal Code, however, convicted the<br \/>\naccused persons for the offences punishable under Sections 341, 506<br \/>\nread with 114 of the Indian Penal Code and passed an order in<br \/>\nCriminal Case No.14013 of 1994 directing the accused persons to<br \/>\nundergo simple imprisonment for six months and fine of Rs.500\/- each.\n<\/p>\n<p>\t\tBeing<br \/>\naggrieved by and dissatisfied with the order of conviction passed by<br \/>\nthe learned Trial<br \/>\nCourt for the offences punishable under Sections 341,<br \/>\n506 read with 114 of the Indian Penal Code, accused persons have<br \/>\npreferred the Criminal Appeal No.20 of 2001 before learned Sessions<br \/>\nCourt, Surat. Simultaneously, original complainant had preferred<br \/>\nCriminal Revision Application No.58 of 2001 for enhancement of<br \/>\npunishment with respect to offences punishable under Sections 341,<br \/>\n506 read with 114 of the Indian Penal Code. Learned Sessions Court,<br \/>\nSurat vide judgement and order dated 30\/10\/2001 allowed the said<br \/>\nCriminal Appeal No.20 of 2001 and dismissed the Criminal Revision<br \/>\nApplication No.58 of 2001 preferred by the complainant, by quashing<br \/>\nand setting aside the order of conviction passed by learned Trial<br \/>\nCourt for the offences punishable under Sections 341, 506 read with<br \/>\n114 of the Indian Penal Code. Being aggrieved by and dissatisfied<br \/>\nwith the impugned judgement and order passed by the learned Sessions<br \/>\nCourt, Surat, the petitioner &#8211; original complainant has<br \/>\npreferred the present Criminal Revision Application under Section 397<br \/>\nread with Section 401 of the Code<br \/>\nof Criminal Procedure.\n<\/p>\n<p>3.\t\tMr.K.J.Panchal,<br \/>\nLearned advocate appearing<br \/>\non behalf of the petitioner has vehemently submitted that as<br \/>\nthe charge was not framed against the accused persons and thereafter<br \/>\ntrial has been vitiated. He has further submitted that as such the<br \/>\nInvestigating Officer was not examined by the prosecution and,<br \/>\ntherefore, this is a fit case to quash and set aside the order of<br \/>\nacquittal and to remand the matter for re-trial. No other submissions<br \/>\nhave been made.\n<\/p>\n<p>4.\t\tHeard<br \/>\nlearned advocate appearing on behalf of the respective parties and<br \/>\nconsidered the impugned judgement and order passed by both the Courts<br \/>\nbelow. The impugned judgement and order passed by learned Sessions<br \/>\nCourt, Surat is mainly assailed on the ground that Investigating<br \/>\nOfficer was not examined by the prosecution. However, it is required<br \/>\nto be noted that despite number of opportunities given to the<br \/>\nprosecution to bring the Investigating officer and to examine him,<br \/>\nthe prosecution failed to produce the Investigating Officer for<br \/>\nexamination and, therefore, being an old matter, learned Trial Court<br \/>\nhas no other alternative but to proceed further with the trial.<br \/>\nLearned Trial Court has considered another evidence on record and<br \/>\ncame to the conclusion that no case is made out against the accused<br \/>\npersons and the same is on appreciation of evidence, which is adduced<br \/>\nby the prosecution. At this stage, this Court is not required to<br \/>\n    re-appreciate the evidence on record. Under the circumstances,<br \/>\nsolely on the ground that Investigating Officer has not been<br \/>\nexamined, the impugned judgement and order passed by learned Sessions<br \/>\nCourt, Surat, is not required to be quashed as the learned Sessions<br \/>\nCourt has appreciated the other evidences on record.\n<\/p>\n<p>\t\tSo<br \/>\nfar as contention on behalf of the petitioner that charge was not<br \/>\nframed against the accused persons and the trial has been vitiated is<br \/>\nconcerned, it is required to be noted that the plea of the accused<br \/>\npersons were recorded. Under the circumstances, the impugned judgment<br \/>\nand order passed by the learned Sessions Court, Surat is not required<br \/>\nto be quashed and set aside in exercise of revisional jurisdiction.\n<\/p>\n<p>5.\t\tIn<br \/>\nview of the above, there is no substance in the present Criminal<br \/>\nRevision Application, which deserves to be dismissed and is<br \/>\naccordingly dismissed. Rule is discharged.
