GUPTA, MEMBER. \n\n \n\n\u00a0 \n\n \n\nHousing  allotment letter\nissued to the complainant indicating tentative price  complainant applying to\nthe Housing Board for certificates to mortgage the flat in the name of his\nemployer- the Madras Port Trust  certificates granted  complainant got loan\nfrom his G.P. Fund and made payment to\nthe Housing Board  for balance sought\none months time  no reply received. \n\n \n\n- No construction at the site where flat allotted  again letter to\nHousing Board for inspection  no\nresponse from Housing Board  complainant\nreceived notice cancelling the\nallotment on the ground that full price\nnot paid  protest lodged by the\ncomplainant, yet no reply  complaint for\ndeficiency in service. \n\n \n\n-State Commission holding that it was not required of the Housing Board\nto send reply- Held  approach of the\nState Commission was wrong  by the time complaint decided no flat available \naction of the Housing Board to give certificates when there was no flat and on\nthat basis flat mortgaged was not proper  meanwhile amount paid by the complainant was refunded\nwith 8% interest.  \n\n \n\n-National Commission allowing the appeal and directing payment of interest @ 18% per annum. \n\n \n\n  \n\n \n\n\u00a0 \n\n \n\nFor\nthe appellant : In person \n\n \n\n\u00a0 \n\n \n\nFor\nthe respondents : Mr. T.S. WADHWA,<br \/>\nJ.(PRESIDENT) <\/p>\n<p>\u00a0 <\/p>\n<p> It is the complainant<br \/>\nwho is in appeal before us. He is<br \/>\naggrieved by the order of the State Commission dismissing his complaint wherein he had alleged deficiency of service on the<br \/>\npart of the Tamil Nadu Housing Board (Housing Board).\n<\/p>\n<p> Complainant read an<br \/>\nadvertisement in the daily Hindu in<br \/>\nJuly 1991 which advertisement was given by<br \/>\nthe Housing Board. The<br \/>\nadvertisement was regarding construction of flats on invitation of<br \/>\napplications for allotment.\n<\/p>\n<p>Complainant, in terms of advertisement made an application for allotment<br \/>\nof flat and he had paid registration fee of Rs.5,000\/- on 21.8.91.<br \/>\nHe received a letter dated<br \/>\n20.4.92 from the Housing Board informing him that he had been<br \/>\nallotted an HIG C Type Flat No.19\/4,<br \/>\nFirst Floor. It was stated in the<br \/>\nletter that this flat was allotted to him under outright purchase basis and he<br \/>\nwas required to make the payment of tentative price of Rs.2,13,600\/- within one month of the receipt of the<br \/>\nallotment letter. This allotment was<br \/>\nreceived by the complainant on 1.5.92.<br \/>\nComplainant, thereafter wrote to the Housing Board conveying his<br \/>\nacceptance to the offer of allotment and at the same time required that he may<br \/>\nbe issued certificates in form A &amp; B for him to apply for loan as well<br \/>\nas a no objection from the Housing Board to mortgage the flat in the name of<br \/>\nhis employer &#8211; the Madras Port Trust.\n<\/p>\n<p>These forms were issued to him.\n<\/p>\n<p>Complainant made an application to the Madras Port Trust for<br \/>\nraising of loan and also obtained loan for G.P. Fund Account. On<br \/>\nthe basis of the loan received from<br \/>\nhis GPF A\/c complainant<br \/>\ndeposited a sum of Rs.72,600\/- with the Housing Board on 29.5.92. He sought for further one<br \/>\nmonths time to pay the balance<br \/>\namount. He did not receive any reply<br \/>\nthereto. He then visited the site<br \/>\nand found that Block No.19<br \/>\nwhere flat on the first floor<br \/>\nwas supposedly allotted to him had not been constructed at<br \/>\nall. He, therefore, wrote another letter to the Housing<br \/>\nBoard requesting for a date<br \/>\nbe fixed for inspection of the premises since that was necessary for<br \/>\ngrant of loan after mortgaging the flat. Again there was no response. Instead on<br \/>\n21.8.92 complainant received a<br \/>\nnotice from the Housing Board canceling<br \/>\nhis allotment altogether on the ground that<br \/>\ncomplainant had not paid full<br \/>\nprice of the flat. Complainant<br \/>\nprotested but he did not receive any reply.<br \/>\nHe, therefore, filed a complaint alleging deficiency in service on the<br \/>\npart of the Housing Board. He sought that the order canceling his allotment be revoked and that balance<br \/>\namount of Rs.1,36,000\/- be accepted or<br \/>\nin the alternative he may be granted other reliefs. It was submitted by the Housing Board that when the complainant did not stick to the condition of allotment inasmuch as he did not pay the<br \/>\nprice within one month on receipt of the allotment letter the allotment had to<br \/>\nbe cancelled. It is also<br \/>\nsubmitted that in the<br \/>\nadvertisement it was mentioned<br \/>\nthat the scheme would be finalised<br \/>\nonly after assessing the demand from the public and it was nowhere indicated<br \/>\nthat the flats were constructed and were readily available.<br \/>\nIt was thus submitted that the<br \/>\nallotment was cancelled as per rule and that therefore there was no deficiency<br \/>\nin service on the part of Housing Board as alleged.\n<\/p>\n<p> State Commission<br \/>\nupheld the contention of the Housing<br \/>\nBoard as to the plea that no response<br \/>\nwas necessary to be given by the Housing Board to the communication of the complainant. State Commission was of the view that Housing Board was not<br \/>\nrequired to reply to each and every communication received from the<br \/>\ncomplainant. We think that was unfortunate comment to make. It may be stated that Housing Bard is not<br \/>\nrequired to reply to every letter but<br \/>\nwhen letters of substance were written and<br \/>\ntime is sought for making payment<br \/>\nand also for inspection of flats for the purpose of raising loan it was the<br \/>\nduty of the Housing Board to respond to the complainant and to apprise him of<br \/>\nthe correct position. That admittedly<br \/>\nwas not done. State Commission noticed<br \/>\nthat on the date of allotment of the flat not an inch of the flat has been<br \/>\nconstructed. There is no explanation<br \/>\nforthcoming as to why certificates in<br \/>\nForm A &amp; B were issued by the Housing Board for the complainant to mortgage the flat for<br \/>\nraising loan from his employer, Madras Port Trust. We do not think it should be the case of the Housing Board that when there is no construction there<br \/>\ncould still be mortgage. We do not<br \/>\nthink in the circumstances of the case there is any other view possible except<br \/>\nto hold that Housing Board was deficient in service. It had rather misled the complainant and<br \/>\nother persons similarly situated. To our<br \/>\nspecific query it was submitted by the complainant who argued his case in<br \/>\nperson that at present no flat is available which could be allotted to him.\n<\/p>\n<p> It was then submitted before us by the complainant that<br \/>\nduring the pendency of the complaint the amount of Rs.72,600\/- paid by him was<br \/>\nrefunded to him on 12.1.96 with<br \/>\ninterest @ 8% per annum. In the case<br \/>\nof Haryana Urban Development Authority<br \/>\nvs. Darsh Kumar &#8211; Revision Petition No.1197\/98<br \/>\ndecided on 31.8.2001, in similar circumstances we had awarded interest @<br \/>\n18% per annum by way of compensation which includes interest at the Bank rate<br \/>\non fixed deposits at the relevant time<br \/>\nand 7% as cost of escalation.\n<\/p>\n<p> We,<br \/>\ntherefore, direct that the amount of Rs.72,600\/- paid by the complainant shall carry interest from the respective dates of deposits made,<br \/>\n@ 18% per annum till payment. From this<br \/>\nthe amount paid 12.1.96 with interest @ 8% shall stand adjusted. Housing Board shall calculate balance amount payable and shall pay the<br \/>\nsame within eight weeks from the date<br \/>\nof receipt of this order. Complainant<br \/>\nshall also be entitled to cost of this<br \/>\nappeal which we assess at Rs.5,000\/-.
