JUSTICE DINESH MAHESHWARI\n\n      Mr. Deelip Kawadia, for the petitioner.\n      Mr. Arun Bhansali, for the respondent No.1.                 .\n                                 ....\n\n      BY THE COURT:<\/pre>\n<p>            This matter was considered on 16.04.2009 and the<\/p>\n<p>      submissions as made by the learned counsel for the parties<\/p>\n<p>      were noticed and directions were issued thus,-\n<\/p>\n<blockquote><p>                  &#8220;Though the matter is listed for dictation of<br \/>\n            order; however, at request, learned counsel for<br \/>\n            the parties have been heard further.<\/p>\n<p>                   After attempting to argue for some more<br \/>\n            time, learned counsel for the petitioner-tenant<br \/>\n            submitted that having regard to the circumstances<br \/>\n            of the case, even if the petitioner is not able to<br \/>\n            make out a case for interference in the writ<br \/>\n            jurisdiction of this Court in the orders as passed<br \/>\n            by the Rent Tribunal and the Appellate Rent<br \/>\n            Tribunal, the petitioner seeks indulgence of<br \/>\n            granting of some more extra time beyond the<br \/>\n            statutory period to vacate the suit premises<br \/>\n            wherein he had been carrying on business for last<br \/>\n            over 30 years.        Learned counsel Mr. Arun<br \/>\n            Bhansali appearing for the respondent-landlord<br \/>\n            submits that the respondent shall not stand<br \/>\n            ceremonies and shall not oppose granting of<br \/>\n            some reasonable time to the petitioner so as to<br \/>\n            enable to make alternative arrangements but<br \/>\n            then, would make a prayer for allowing him<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>      enhanced mesne profits particularly during the<br \/>\n      period the petitioner would be retaining the shop,<br \/>\n      if indulgence is extended by this Court. Learned<br \/>\n      counsel appearing for the petitioner submits that<br \/>\n      the petitioner is ready to submit an undertaking to<br \/>\n      abide by the final orders to be passed in this<br \/>\n      matter. A specific undertaking may be submitted<br \/>\n      on behalf of the petitioner on or before<br \/>\n      20.04.2009.\n<\/p>\n<p>            List this matter for dictation of order on<br \/>\n      21.04.2009.&#8221;\n<\/p>\n<p>      The petitioner has now submitted an undertaking<\/p>\n<p>pursuant to the order dated 16.04.2009 stating thus,-\n<\/p>\n<blockquote><p>      &#8220;1.   That the matter was listed before this<br \/>\n            Hon&#8217;ble Court on 16.04.09 and both the<br \/>\n            parties agree to dispose of this writ petition<br \/>\n            on the following terms and conditions:-\n<\/p><\/blockquote>\n<blockquote><p>            (i)     The petitioner undertakes to hand-\n<\/p><\/blockquote>\n<blockquote><p>                    over the vacant and peaceful<br \/>\n                    possession of the shop premises, in<br \/>\n                    dispute to the respondent no.1, on or<br \/>\n                    before 30.6.2011. The respondent<br \/>\n                    no.1 shall not execute the impugned<br \/>\n                    decree till 30.6.2011.\n<\/p><\/blockquote>\n<blockquote><p>            (ii)    The petitioner undertakes to pay or<br \/>\n                    deposit the mesne profit at the rate of<br \/>\n                    Rs.2200\/- per month w.e.f. May, 2009<br \/>\n                    and will further continue to pay the<br \/>\n                    mesne profit each month by 15th day<br \/>\n                    of the next succeeding month or in<br \/>\n                    advance to the respondent.\n<\/p><\/blockquote>\n<blockquote><p>            (iii)   The petitioner further undertakes that<br \/>\n                    he shall not sub-let, assign or part<br \/>\n                    with the possession of the shop<br \/>\n                    premises or any part thereof in favour<br \/>\n                    of any one else and would not create<br \/>\n                    any third party interest in the same<br \/>\n                    during the aforesaid period.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                3<\/span><\/p>\n<blockquote><p>             (iv)   Learned counsel for respondent-\n<\/p><\/blockquote>\n<blockquote><p>                    landlord will give the details of his<br \/>\n                    bank account number in which the<br \/>\n                    aforesaid mesne profits, will be<br \/>\n                    deposited.\n<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>            It is, therefore, humbly prayed that<br \/>\n      application may kindly be allowed in light of<br \/>\n      aforesaid undertaking by the petitioner. The<br \/>\n      undertaking may kindly be taken on record and<br \/>\n      the writ petition may kindly be disposed in view of<br \/>\n      the agreement between both the parties.&#8221;<\/p><\/blockquote>\n<p>      Having regard to the facts and circumstances of the<\/p>\n<p>case, it appears appropriate to allow time to the petitioner to<\/p>\n<p>vacate the suit premises by 30th June 2011. Learned counsel<\/p>\n<p>for the respondent has rightly prayed for allowing to the<\/p>\n<p>respondent reasonable amount towards damages for use and<\/p>\n<p>occupation of the suit premises, particularly during the extra<\/p>\n<p>period to vacate as being allowed in this writ petition. It is<\/p>\n<p>stated that last paid rent has been @ Rs.700\/- per month.\n<\/p>\n<p>Having regard to the overall facts and circumstances of the<\/p>\n<p>case, it appears appropriate to allow mesne profits to the<\/p>\n<p>respondent from 1st May 2009 until the petitioner vacates the<\/p>\n<p>suit premises @ Rs.2,200\/- per month.\n<\/p>\n<p>      Of course, for no ground to interfere otherwise, this writ<\/p>\n<p>petition is dismissed; however, the petitioner is granted time to<\/p>\n<p>vacate the suit premises by 30th June 2011 on the following<br \/>\n<span class=\"hidden_text\">                                     4<\/span><\/p>\n<p>conditions:-\n<\/p>\n<blockquote><p>      (i)      The   petitioner     shall   personally   submit   an<br \/>\n               undertaking supported by affidavit before the Rent<br \/>\n               Tribunal within    three weeks from today to the<br \/>\n               effect that on or before 30th June 2011, he shall<br \/>\n               hand over peaceful and vacant possession of the<br \/>\n               suit premises to the plaintiff-respondent. He shall<br \/>\n               also undertake not to cause any damage to the<br \/>\n               suit premises nor to make any alteration and not<br \/>\n               to assign, sublet or in any manner part with<br \/>\n               possession to any other person and not to put the<br \/>\n               premises to any use other than the present use<br \/>\n               and not to cause any nuisance.\n<\/p><\/blockquote>\n<blockquote><p>      (ii)     The petitioner shall deposit within three weeks the<br \/>\n               arrears, if any, of the rent\/mesne profits and of the<br \/>\n               decreetal amount and         shall further pay to the<br \/>\n               landlord the amount for use and occupation of the<br \/>\n               suit premises at the rate of Rs. 2,200\/- (Two<br \/>\n               Thousand Two Hundred) per month with effect<br \/>\n               from 1st May 2009 or deposit this amount in the<br \/>\n               bank account of the landlord (particulars whereof<br \/>\n               are said to have already been furnished to the<br \/>\n               petitioner) month by month on or before 15th day<br \/>\n               of the next month.<\/p><\/blockquote>\n<p>      It is made clear that upon the petitioner&#8217;s failure to<\/p>\n<p>comply with any of the conditions aforesaid or violating any<\/p>\n<p>terms of the undertaking, the applicant-respondent No.1 shall<br \/>\n<span class=\"hidden_text\">                                      5<\/span><\/p>\n<p>      be entitled to get the Certificate of Possession executed<\/p>\n<p>      forthwith in accordance with law.\n<\/p>\n<p>            No costs.\n<\/p>\n<p>                                          (DINESH MAHESHWARI), J.\n<\/p>\n<p>\/Mohan\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Mohan Lal vs Dayal Singh &amp; Ors on 21 April, 2009 1 S\/2 S.B.
