RAMKUMAR, J.\n                    -------------------------------\n              Bail Application No.6464 of 2010\n              ---------------------------------------------\n             DATED: 19th day of October, 2010\n\n\n                             O R D E R\n<\/pre>\n<p>      Petitioner, who is the sole accused in Crime No.16\/2010 of<\/p>\n<p>Kunnamkulam Excise Range for           an offence punishable under<\/p>\n<p>Section 55(a) of the Abkari Act,     seeks his enlargement on bail.<\/p>\n<p>The petitioner was arrested on 20.8.2010.<\/p>\n<p>      2.    The   learned    Public    Prosecutor     on   instructions<\/p>\n<p>submitted that no final report has been filed even after 60 days of<\/p>\n<p>judicial custody of the petitioner. If so, by virtue of the proviso to<\/p>\n<p>sec.167(2) Cr.P.C. the petitioner is entitled to be released on bail<\/p>\n<p>as of right.\n<\/p>\n<\/p>\n<p>      3. Accordingly, the petitioner is directed to be released on<\/p>\n<p>bail on his executing a bond for Rs.3,00,000\/- (Rupees Three Lakh<\/p>\n<p>only) with two solvent sureties each for the like amount to the<\/p>\n<p>satisfaction of the J.F.C.M Court, Kunnamkulam and subject to the<\/p>\n<p>following conditions:-\n<\/p>\n<p>Bail Application No.6464 of 2010<br \/>\n<span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>             1. Petitioner shall report before the Investigating<\/p>\n<p>             Officer between 9 a.m. and 11 a.m. on all<\/p>\n<p>             Wednesdays.\n<\/p>\n<\/p>\n<p>             2. Petitioner shall not influence or intimidate the<\/p>\n<p>             prosecution witnesses nor shall he attempt to<\/p>\n<p>             tamper with the evidence for the prosecution.<\/p>\n<p>             3.   Petitioner shall make himself available for<\/p>\n<p>             interrogation as and when required by the<\/p>\n<p>             investigating officer.\n<\/p>\n<\/p>\n<p>             4.
