No.20129 of 2011\n                             Ramjee Manjhi @ Sadhujee\n                                           Versus\n                                   The State Of Bihar\n                                         -----------\n<\/pre>\n<p>2   14-07-2011               Heard learned counsel for the petitioner as well as<\/p>\n<p>                 learned Additional Public Prosecutor for the state.<\/p>\n<p>                             Allegedly, one stain gun, 9 pistols, 4 live cartridges<\/p>\n<p>                 and two empty cartridges kept in a Windauliya and three live<\/p>\n<p>                 bombs as well as some police dress were recovered from house<\/p>\n<p>                 of the petitioner.\n<\/p>\n<p>                             The contention of learned counsel for the petitioner is<\/p>\n<p>                 that the aforesaid recovery has been made in absence of the<\/p>\n<p>                 petitioner and as a matter of fact, this case is nothing but high-<\/p>\n<p>                 handedness of the police. It is also pointed out by him that<\/p>\n<p>                 earlier, the petitioner was booked several times by the police in<\/p>\n<p>                 false cases of Arms Act and dacoity and almost in all the cases,<\/p>\n<p>                 he has already been granted privilege of bail by this court and<\/p>\n<p>                 details of the aforesaid cases, have been pleaded at paragraph-<\/p>\n<p>                 14 of the bail petition. It is also pointed out by him that the<\/p>\n<p>                 petitioner is languishing in jail custody for three and a half years<\/p>\n<p>                 and uptill now, his trial could not be concluded and having more<\/p>\n<p>                 or less similar allegation, one co-accused, namely, Kamal Manjhi<\/p>\n<p>                 has already been granted bail by another bench of this court by<\/p>\n<p>                 order dated 04.02.2009 passed in Cr. Misc. No. 3556 of 2009.<\/p>\n<p>                             Taking into consideration the aforesaid submissions,<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>        particularly, keeping in mind the period of detention in jail<\/p>\n<p>        custody, let the petitioner, namely, Ramjee Manjhi @ Sadhujee<\/p>\n<p>        be released on bail on furnishing bail bonds of Rs 10,000\/- (ten<\/p>\n<p>        thousand) with two sureties of the like amount each in<\/p>\n<p>        connection with Sessions Trial No. 336 of 2009 arising out of<\/p>\n<p>        Wazirganj P.S. Case No. 152 of 2005 to the satisfaction of<\/p>\n<p>        Additional Sessions Judge-VI, Gaya subject to condition that one<\/p>\n<p>        of the sureties must be close relative of the petitioner who shall<\/p>\n<p>        swear an affidavit disclosing his relation with the petitioner and<\/p>\n<p>        furthermore, the petitioner shall attend the trial court on each<\/p>\n<p>        and every date regularly for a period of nine months and if he<\/p>\n<p>        fails to do so without any reasonable explanation, learned trial<\/p>\n<p>        court shall be at liberty to cancel the bail bonds of the petitioner.<\/p>\n<pre>AKV\/-                                  ( Hemant Kumar Srivastava,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ramjee Manjhi @ Sadhujee vs The State Of Bihar on 14 July, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
