 the compensation awarded by the Tribunal is not<\/p>\n
registration No.KA.01.F.llO5 came in a rash and<\/p>\n
negligent manner and dashed against their motor cycle.<\/p>\n
As a result, the claimant fell down and
\ninjuries. Hence, he filed a claim petition
\nMACT, Bangalore, seeking  it
\n?’. 10,00,000\/–. The Tribunal
\nand award has awarded corn_pensati’on of
\nwith interest at 6% pa.  lduaritum of
\ncompensation awarded”‘oyAtl1e the claimant is<\/p>\n
in appeal seekingenhancennentiof compensation.<\/p>\n
5. As therc\ufb02gs no regarding occurrence of
\naccident, negligence’ “a1’1d:V’liatbil.i’ty of the Insurance Co.,
\nthe only point that rernains my consideration in the<\/p>\n
appeal    <\/p>\n

just and “proper or does it call for <\/p>\n
–V enhancement?\n<\/p>\n
just and proper, it is on the lower side and therefore it is
\ndeserved to be enhanced.\n<\/p>\n
7. The claimant has sustained the following injuries:<\/p>\n
i. Type III B compound segmental fracture –<\/p>\n
right tibia.  Q
\nii. Type II Comminuted fracture distal\u00e9’ fe’Ii1url}” V.
\niii. Fracture acetabulum right. it   A
\niv. Central dislocation.\n<\/p>\n
Injuries sustained are eyfident <\/p>\n
certificate — Ex.P.5, discharge suinniariesv?  P136″ and<\/p>\n
R7, follow up summary with
\nnegatives —  _   record — Ex.P.19,<\/p>\n
OPD card —  and 23, CT scan<\/p>\n
films  by oral evidence of the
\nclaimant candid ‘dAolc_to-rd]examined as P.Ws.1 and 2<\/p>\n
respectively\u00bb. .,   in<\/p>\n
it   ‘+3 on the basis of his clinical examination<\/p>\n
 the of the hospital where the claimant was
\n treated and also on the basis of check x~ray, has stated
\n  evidence that there is disability of 49% to the<\/p>\n
 whole body and the Tribunal considered the disability<\/p>\n
at 35% to the whole body.\n<\/p>\n<\/p>\n
8. Considering the nature of injuries, 340,000\/–
\nawarded by the Tribunal towards pain and suffering is<\/p>\n
on the lower side and it is deserved to be enhanced by<\/p>\n
another Rs.10,000\/- and 1 award Rs.50,00pQ\/”}iV.<\/p>\n
this head.\n<\/p>\n
9. Claimant has produced medi’ca.1A_<\/p>\n
to ‘<'.2,98,495\/- and the  <\/p>\n
?.2,98,500\/- towards medical"expensesb is
\njust and proper and'~.nhe1\u00e9e.t;oife~:,\/:4.'ituidoes \ufb01otil call for<\/p>\n
enhancement.\n<\/p>\n
10.  inpatient on three spells<\/p>\n
in MS. Rlamaiah  and Ganga Hospital for about<\/p>\n
 p_  Cvonsid-eri_ngv the same, ?. 10,000\/W awarded by<\/p>\n
 the -towards incidental expenses such as<\/p>\n
conVeyancej_, nourishment and attendant charges is just<\/p>\n
 and proper and there is no scope for enhancement<\/p>\n
‘ll.’ this head.\n<\/p>\n
lg}. Claimant claims to have been earning Rs.4,500\/-<\/p>\n
l per month by doing business in selling butter and ghee.<\/p>\n
The same is not established by producing any
\ndocument. In the absence of proof of income, his
\nincome is assessed at ?.3,000\/~ per month as against<\/p>\n
32,000\/~ assessed by the Tribunal. Nature of.’g:in}’uries<\/p>\n
suggest, claimant must have been under”*r.estj’ and<\/p>\n
treatment for three months. Therefore…A4_:\u00a7A’~,9’i~CO_Q\/gg:” <\/p>\n

 l3′;*tfRs.3,OOO\/– per month. P.W.2, the doctor<\/p>\n
wlhol’ not treated the claimant has stated that<\/p>\n
 n_;c’i’aimant has suffered disability of 49% to Whole body<\/p>\n
 and Tribunal has rightly considered the loss of earning<\/p>\n
capacity at 35%. 80 loss of future income works out to<\/p>\n

Rs.1,63,800\/– [Rs.3,000\/– X 35\/100 X 12 X 13] and it is
\nawarded as against Rs.l,00,8000\/– awarded by the<\/p>\n
Tribunal .\n<\/p>\n

future medical expenses is just and proper. andth’ere’is 7<\/p>\n
no scope for enhancement.\n<\/p>\n
