Ms. Pathak for the applicants that the delay<br \/>\noccurred in filing the second appeal has been explained in para 6 of<br \/>\nthe application, from which it is clear that the said delay has<br \/>\noccurred due to the procedural formalities, which the applicants were<br \/>\nrequired to follow for filing the second appeal. According to Ms.<br \/>\nPathak, some latitude is required to be granted to the Governmental<br \/>\nAuthorities as they have to follow long procedure for filing appeals<br \/>\nin the High Court.\n<\/p>\n<p>3.\tHowever, Mr. Trivedi<br \/>\nhas strongly opposed the condonation of delay on the ground that the<br \/>\ndelay has not been sufficiently explained by the applicants. He has<br \/>\nalso submitted that merely because the applicants happened to be the<br \/>\nGovernment Authorities, that ground alone would not be sufficient to<br \/>\ncondone the delay, more particularly, when the delay is of 258 days.<br \/>\nHe also submitted that even on merits of second appeal there is no<br \/>\nsubstance and hence also the present application deserves to be<br \/>\ndismissed.\n<\/p>\n<p>4.\tHaving regard to the<br \/>\nsubmissions made by the learned advocates for the parties, it<br \/>\ntranspires that the applicants have sought to explain the delay which<br \/>\nhad occurred in filing the second appeal, as mentioned in para 6 of<br \/>\nthe civil application, however, from the bare reading of the said<br \/>\npara it transpires that  there was gross negligence and carelessness<br \/>\non the part of the concerned applicants in not taking the necessary<br \/>\nsteps for filing the second appeal immediately after the order of the<br \/>\nlower Appellate Court. It is needless to say that merely because the<br \/>\napplicants happened to be the Government Authorities, that would not<br \/>\nbe a ground to treat them differently from that of other litigants in<br \/>\ncase of condonation of delay. Though some latitude is not improper in<br \/>\ncase where the Government Authorities are the litigants, still the<br \/>\ndelay needs to be sufficiently explained by giving cogent reasons,<br \/>\nwhich the applicants have failed to explain in the instant case. As<br \/>\nrightly submitted by Mr. Trivedi, there is hardly any substance in<br \/>\nthe second appeal proposed to be filed by the applicants, inasmuch as<br \/>\nthe lower Appellate Court has fastened the liability on the<br \/>\napplicants only to the extent of 20% on each of the applicants out of<br \/>\nthe total amount of Rs.1,00,000\/- awarded towards the compensation<br \/>\nfor the death of Sarojben Bipinchandra Shah. The said liability<br \/>\nfastened by the lower Appellate Court on the present applicants being<br \/>\na very meager amount, there is hardly any substance in the second<br \/>\nappeal proposed to be filed against the said judgment and order of<br \/>\nthe lower Appellate Court. In that view of the matter, the present<br \/>\napplication deserves to be dismissed.\n<\/p>\n<p>5.\tFor the reasons<br \/>\nstated above, the delay having not been sufficiently explained by the<br \/>\napplicants and no sufficient cause having been shown by the<br \/>\napplicants to condone the delay occurred in the second appeal, the<br \/>\ncivil application deserves to be dismissed and is accordingly<br \/>\ndismissed with no order as to cost.\n<\/p>\n<p>(BELA<br \/>\nTRIVEDI, J.)<\/p>\n<p>jani<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court State vs Ranjanben on 6 May, 2011 Author: B.M.Trivedi,&amp;Nbsp;
