This matter also arises from<br \/>\nthe same Crime Register number and, therefore, is required to be<br \/>\nheard alongwith Criminal Misc. Application No.9522 of 2008 and,<br \/>\ntherefore, the papers of Cri.Misc.Appl.No.9524 of 2008 are called<br \/>\nfor, from the Registry and both the matters are heard together.\n<\/p>\n<p>4.\t\tLearned<br \/>\ncounsel for the applicants submitted that even if the case of the<br \/>\nprosecution is taken at its highest pitch, the amount involved in the<br \/>\noffence, is approximately Rs.19 Lacs, which is royalty amount of<br \/>\nexcavated boxide. Learned counsel for the applicants submitted that<br \/>\nsimilarly situated other co-accused in some other case have been<br \/>\nenlarged on bail by this Court vide order dated 20th<br \/>\nJune,2008 passed in Criminal Misc.Application No.7755 of 2008. Even<br \/>\notherwise also, as per statement made by learned counsel for the<br \/>\napplicants, these offences are punishable under Section 379 of the<br \/>\nIndian Penal Code. There is no antecedent of the applicants and the<br \/>\napplicants are ready and willing to deposit Rs.20 Lacs before the<br \/>\nGeologist, Office of Geologist, Mines and Mineral Department,<br \/>\nsituated at Seva Sadan No.3, Lal Bungalow, Collector compound,<br \/>\nJamnagar, and so, the applicants may be enlarged on bail.\n<\/p>\n<p>5.\t\tLearned<br \/>\nAdditional Public Prosecutor submitted that there is a prima facie<br \/>\ncase against the applicants and, therefore, they may not be enlarged<br \/>\non bail.\n<\/p>\n<p>6.\t\tHaving<br \/>\nheard the learned counsel for both the sides and looking to the facts<br \/>\nand circumstances of the case, statements of the witnesses, gravity<br \/>\nof the offence, quantum of punishment, the manner in which the<br \/>\napplicants are involved in the offence, as per the allegations of the<br \/>\nprosecution coupled with the fact that the there is no antecedent of<br \/>\nthe present applicants and looking to the evidence on record, and the<br \/>\nfact that other co-accused have been enlarged on bail vide order<br \/>\ndated 20th June,2008 passed by this Court in Criminal<br \/>\nMisc.Application No.7755 of 2008 coupled with the fact that the<br \/>\napplicants are ready and willing to deposit Rs.20 Lacs before the<br \/>\nGeologist, Office of Geologist, Mines and Mineral Department,<br \/>\nsituated at Seva Sadan No.3, Lal Bungalow, Collector compound,<br \/>\nJamnagar, this application is allowed. Upon depositing<br \/>\ntotal amount of Rs.20 Lacs for both the applicants, before the<br \/>\nGeologist, Office of Geologist, Mines and Mineral Department,<br \/>\nsituated at Seva Sadan No.3, Lal Bungalow, Collector compound,<br \/>\nJamnagar, the applicants are ordered to be released on bail in<br \/>\nconnection with the offence registered with Kalyanpur<br \/>\nPolice Station, Khambhalia, District: Jamnagar, bearing C.R.No.I ?<br \/>\n32 of 2007, on each of them executing a bond of Rs.5,000\/-<br \/>\n(Rupees Five Thousands only) with one surety of like amount to the<br \/>\nsatisfaction of the lower Court and subject to the conditions that<br \/>\nthey shall,<\/p>\n<p>(a)\tnot take undue advantage of their<br \/>\nliberty or abuse their liberty;\n<\/p>\n<p>(b)\tnot act in a manner injurious to<br \/>\nthe interest of the prosecution;\n<\/p>\n<p>(c)\tmaintain law and order;\n<\/p>\n<p>(d)\tshall deposit<br \/>\ntotal amount of Rs.20 Lacs for both the applicants before<br \/>\nthe Geologist, Office of Geologist, Mines and Mineral Department,<br \/>\nsituated at Seva Sadan No.3, Lal Bungalow, Collector compound,<br \/>\nJamnagar;\n<\/p>\n<p>(e)\tnot leave the State of Gujarat<br \/>\nwithout the prior permission of the Sessions Court concerned;\n<\/p>\n<p>(f)\tfurnish the address<br \/>\nof their residence at the time of execution of the bond and shall not<br \/>\nchange the residence without prior permission of this Court;\n<\/p>\n<p>(g)\tsurrender their passport, if any,<br \/>\nto the lower Court within a week.\n<\/p>\n<p>7.\tIf breach of any of the above<br \/>\nconditions is committed, the Sessions Judge<br \/>\nconcerned will be free to issue warrant or<br \/>\nto take appropriate action in the matter.\n<\/p>\n<p>8.\tBail before the lower Court having<br \/>\njurisdiction to try the case.\n<\/p>\n<p>9.\tThe aforesaid deposition of the<br \/>\namount, by the applicants is without prejudice to the rights and<br \/>\ncontentions of the applicants as well as receipt of the amount, by<br \/>\nthe office of Geologist, Mines and Mineral Department, is without<br \/>\nprejudice to the rights and contentions of the respondent.\n<\/p>\n<p>10.\tRule<br \/>\nis made absolute.
