M.A.Siddiqui,J.\n\n             Smt.N.K.Mann , Adv. for petitioner.\n\n             Shri S.K.Kashyap, GA for State\/respondent\n             no.1.\n\n             Shri T.Sheikh, Adv.for the objector\/respondent\n             no.2.\n\n        ORDER RESERVED ON 11\/02\/2011.\n\n        ORDER PASSED ON          18\/02\/2011.\n\n                              ORDER\n<\/pre>\n<p>(1)     This petition under Section 482 of Cr.P.C. has been<\/p>\n<p>        filed by the petitioners to invoke the extra ordinary<\/p>\n<p>        powers of this Court to quash the FIR in Crime No.<\/p>\n<p>        451\/2010 registered by Police Station- Gadarwara,<\/p>\n<p>        District- Narsinghpur for alleged offence under<\/p>\n<p>        Section 498-A\/34 of IPC and Section 3\/4 of Dowry<\/p>\n<p>        Prohibition     Act    and   also   the    subsequent<\/p>\n<p>        proceedings.\n<\/p>\n<p>(2)     In brief, the prosecution case is that petitioner no.1<\/p>\n<p>        Amit Kumar Soni is the husband, Anand Kumar<\/p>\n<p>        Soni petitioner no.2, is father-in-law and petitioner<\/p>\n<p>        no.3 Smt. Sangeeta Soni is wife of elder brother of<br \/>\n<span class=\"hidden_text\">                                  -2-<\/span><\/p>\n<p>      petitioner     no.1   Amit      Kumar      Soni,   Jethani     of<\/p>\n<p>      respondent no.2 Smt. Poonam Soni.\n<\/p>\n<p>(3)   Undisputedly, marriage of respondent Smt. Poonam<\/p>\n<p>      Soni took place in the year 2006 at Katni and she<\/p>\n<p>      resided in her nuptial house at Katni. As dispute<\/p>\n<p>      arose, respondent Smt. Poonam went to reside in<\/p>\n<p>      her   maternal        house      at     Gadarwara,      District-<\/p>\n<p>      Narsinghpur. Petitioner Amit Soni filed a case for<\/p>\n<p>      divorce under Section 13(1) of Hindu Marriage Act<\/p>\n<p>      on 18.5.10 in District-Katni for which respondent<\/p>\n<p>      Smt. Poonam was served notice on 13\/07\/10 and<\/p>\n<p>      on the next day she lodged FIR at Gadarwara Police<\/p>\n<p>      Station      for   which       Gadarwara       Police    Station<\/p>\n<p>      registered Crime No. 451\/10 under Section 498-<\/p>\n<p>      A\/34 IPC and Section 3\/4of Dowry Prohibition Act,<\/p>\n<p>      and afterwards filed challan. It is alleged that as per<\/p>\n<p>      FIR, the cruelty and demand of dowry took place at<\/p>\n<p>      Katni and nothing was done at Gadarwara, so<\/p>\n<p>      Gadarwara Court has no jurisdiction and falsely<\/p>\n<p>      report has been lodged in order to harass the<\/p>\n<p>      petitioner, so this FIR be quashed.\n<\/p>\n<p>(4)   Respondent         no.1   is   a      formal   defendant     and<\/p>\n<p>      respondent no.2 Smt. Poonam defended the case. It<\/p>\n<p>      is submitted on her behalf that though FIR contains<br \/>\n<span class=\"hidden_text\">                             -3-<\/span><\/p>\n<p>      no cause of action at Gadarwara, but FIR is not the<\/p>\n<p>      alone thing.   As per statement under Section 161<\/p>\n<p>      Cr.P.C. of respondent Smt. Poonam, petitioner no.1<\/p>\n<p>      and 2 came at Gadarwara and demanded Rs.One<\/p>\n<p>      Lac and motor cycle and said that if the demand is<\/p>\n<p>      not fulfilled, she will not be taken back to Katni,<\/p>\n<p>      and they after leaving her at Gadarwara went away.<\/p>\n<p>(5)   Learned counsel for petitioners submits that as per<\/p>\n<p>      FIR, no case is made out so proceedings should be<\/p>\n<p>      quashed. She submits that it is crystal clear that<\/p>\n<p>      after filing the case for divorce, a false case has<\/p>\n<p>      been registered to harass the petitioners and to take<\/p>\n<p>      revenge from them. Learned counsel has placed<\/p>\n<p>      reliance on a decision of Apex Court in Bhura Ram<\/p>\n<p>      &amp; Ors. vs. State of Rajasthan &amp; Anr. AIR 2008 SC<\/p>\n<p>      2666 in which it has been held for the purpose of<\/p>\n<p>      Ss.177 and 178 of Cr.P.C. that if all alleged acts as<\/p>\n<p>      per complaint relating to offence under Section 498-<\/p>\n<p>      A IPC took place in State of Punjab, complaint filed<\/p>\n<p>      in Court in State of Rajasthan where complainant<\/p>\n<p>      residing with her maternal relations, no cause of<\/p>\n<p>      action arose in Rajasthan, then the Magistrate at<\/p>\n<p>      that place had no jurisdiction to deal with the said<\/p>\n<p>      matter.   But, as per above discussion, as per<br \/>\n<span class=\"hidden_text\">                             -4-<\/span><\/p>\n<p>      statement under Section 161 Cr.P.C. of respondent<\/p>\n<p>      Smt. Poonam, the demand and harassment also<\/p>\n<p>      took place at Gadarwara when she was left by<\/p>\n<p>      petitioners no.1 and 2 and was threatened that if<\/p>\n<p>      demand of dowry of Rs. One Lac and motor cycle is<\/p>\n<p>      not fulfilled, then she will not be taken back to<\/p>\n<p>      Katni and they left her at Gadarwara, so above<\/p>\n<p>      ruling has no application in the instant case.<\/p>\n<p>(6)   As far as allegations in the FIR are concerned,<\/p>\n<p>      whether they are genuine or fake has still to be<\/p>\n<p>      decided. As far as exercise of powers under Section<\/p>\n<p>      482 Cr.P.C. are concerned, according to <a href=\"\/doc\/279427\/\">Zandu<\/p>\n<p>      Pharmaceutical Works Ltd.           and others vs.<\/p>\n<p>      Mohd. Sharaful Haque and<\/a> another (2005) 1 SCC<\/p>\n<p>      122 the Apex Court held that inherent jurisdiction,<\/p>\n<p>      though wide has to be exercised sparingly, carefully<\/p>\n<p>      and with caution and only when such exercise is<\/p>\n<p>      justified by the tests specifically laid down in S.482<\/p>\n<p>      Cr.P.C. Power to be exercised ex debito justitiae to<\/p>\n<p>      prevent abuse of process of Court, but should not<\/p>\n<p>      be exercised to stifle legitimate prosecution. If on<\/p>\n<p>      consideration of the allegations in the light of the<\/p>\n<p>      statement made on oath of the complainant, it<\/p>\n<p>      appears that the ingredients of the offence or<br \/>\n<span class=\"hidden_text\">                               -5-<\/span><\/p>\n<p>      offences are disclosed and there is no material to<\/p>\n<p>      show that the complaint is mala fide, frivolous or<\/p>\n<p>      vexatious, the proceedings cannot be quashed as<\/p>\n<p>      they are to be enquired into by the trial Court.<\/p>\n<p>(7)   Learned counsel for petitioners has submitted that<\/p>\n<p>      no case is there against petitioner no.3 as there is<\/p>\n<p>      no specific allegation against her. Reliance has been<\/p>\n<p>      placed on a decision of Apex Court in <a href=\"\/doc\/1067871\/\">Preeti Gupta<\/p>\n<p>      and Anr. vs. State of Jharkhand and Anr. AIR<\/a><\/p>\n<p>      2010 SC 3363 in which it has been held by the<\/p>\n<p>      Apex Court that where no specific allegations in<\/p>\n<p>      complaint are there against appellants, sister-in-law<\/p>\n<p>      and unmarried brother-in-law of complainant, then<\/p>\n<p>      complaint is liable to be quashed. But in the case in<\/p>\n<p>      hands, according to FIR and statement under<\/p>\n<p>      Section 161 Cr.P.C. of Smt. Poonam, there is<\/p>\n<p>      specific   allegation   that   petitioner   no.3   Smt.<\/p>\n<p>      Sangeeta Soni is the lady to whom the allegation is<\/p>\n<p>      that she is having illicit relations with petitioner<\/p>\n<p>      no.1 Amit Kumar Soni and she used to tease and<\/p>\n<p>      threaten respondent Smt.
