(Vatva) Police Station.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Mr.Vaibhav Vyas for the applicant accused referred to the<br \/>\n\tpapers and submitted that considering the nature of offence as well<br \/>\n\tas the fact that charge sheet is filed, present application may be<br \/>\n\tallowed.  He submitted that there are seven other cases, however,<br \/>\n\tpresent application may be allowed.\n<\/p>\n<p>Learned<br \/>\n\tAdditional Public Prosecutor Ms.Mini Nair resisted the application<br \/>\n\tand submitted that applicant is habitual offender as there are seven<br \/>\n\tother cases and there is one major case of decoit wherein he has<br \/>\n\tbeen arrested on the basis of C.C.T.V. Camera and, therefore,<br \/>\n\tconsidering the antecedents present application may not be allowed.\n<\/p>\n<p>In<br \/>\n\trejoinder, Mr.Vaibhav Vyas, learned advocate for the applicant, has<br \/>\n\tsubmitted that other co-accused has been released on bail.\n<\/p>\n<p>Having<br \/>\n\tconsidered learned advocate Mr.Vaibhav Vyas for applicant and<br \/>\n\tMs.Mini Nair, learned APP and having considered the nature of<br \/>\n\toffence and role attributed to the applicant, present application<br \/>\n\tdeserves to be allowed, subject to the conditions, in view of<br \/>\n\tantecedents which are required to be imposed as mentioned<br \/>\n\thereinafter.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No.22 of 2010 has<br \/>\n\tbeen registered with G.I.D.C. (Vatva) Police Station on his<br \/>\n\texecuting bond of Rs.5,000\/- (Rupees Five Thousand Only) with one<br \/>\n\tsolvent surety of the like amount to the satisfaction of the lower<br \/>\n\tCourt and subject to the conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution \twitnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tmark<br \/>\nhis presence before concerned Police Station on 1st Monday<br \/>\nof English calender month between 11:00 AM to 2:00 PM till the trial<br \/>\ncommences.\n<\/p>\n<p>(f)\tshall<br \/>\nnot enter into area of Vatva Police Station, except for the purpose<br \/>\nof marking presence or attending the court proceedings;\n<\/p>\n<p>(g)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(g)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>\tRule<br \/>\n\tis made absolute to the aforesaid extent.
