Looking to the issue involved<br \/>\nin the petition, the same is taken up for final hearing.\n<\/p>\n<p>2.\tHeard<br \/>\nMr.\tViral V. Dave, learned advocate appearing for the petitioner and<br \/>\nMr.Nikunt Raval, learned Assistant<br \/>\nGovernment Pleader, appearing for the respondents.\n<\/p>\n<p>3.\tThe<br \/>\npetitioner has filed this petition under Article 226 of the<br \/>\nConstitution of India praying for  a direction to the respondents to<br \/>\nproduce certified copy of the interim order dated 22.04.2003 before<br \/>\nthis Court. The petitioner has also prayed for quashing and setting<br \/>\naside the impugned order dated 22.04.2003 and to remand the matter<br \/>\nback to the respondent No.1 for deciding afresh.\n<\/p>\n<p>4.\tIt<br \/>\nis the case of the petitioner that the petitioner has not received<br \/>\nthe impugned order dated 22.04.2003. Even on application being made<br \/>\nby the petitioner, the certified copy of the order was not supplied<br \/>\nto the petitioner. Mr.Dave on instruction states that at the time of<br \/>\nfiling this petition, the certified copy of the order was received by<br \/>\nthe petitioner. Whether the petitioner has received the impugned<br \/>\norder or not, is a disputed question of fact, which cannot be decided<br \/>\nin this petition. It is required to be decided by the Appropriate<br \/>\nAuthority. Even otherwise, an alternative remedy is available to the<br \/>\npetitioner and the petitioner should challenge the impugned order<br \/>\nbefore the Appellate Authority. The question of limitation arises as<br \/>\nthe delay was caused in preferring appeal before the Appellate<br \/>\nAuthority. Now, however, the petitioner&#8217;s explanation is that the<br \/>\ncertified copy of the order is received by the petitioner and hence<br \/>\nthe limitation is counted from the date of receipt of the certified<br \/>\ncopy of the order.\n<\/p>\n<p>5.\tIn<br \/>\nabove  view of the matter, the petitioner is permitted to avail the<br \/>\nalternative remedy by way of filing an appeal against the impugned<br \/>\norder. If such an application is filed along with delay condonation<br \/>\napplication, the Appropriate Authority would consider the same<br \/>\nsympathetically and in view of the fact that the certified copy of<br \/>\nthe order is received by the petitioner. Appropriate Authority would<br \/>\nconsider the merits of the order and pass an appropriate order. While<br \/>\ndismissing the appeal on the ground of limitation.\n<\/p>\n<p>6.\tIt<br \/>\nis made clear that the Court has not gone into the merits of the<br \/>\nmatter and has not expressed any opinion on the merits of the matter.\n<\/p>\n<p>7.\tSubject<br \/>\nto the aforesaid direction and observation, this petition is,<br \/>\naccordingly, disposed of.
