Justice M.SASIDHARAN NAMBIAR\n\n Dated :26\/08\/2009\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.2698 of 2009\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioner is the third accused in S.T.No.<\/p>\n<p>638\/2008  on  the  file  of  Judicial  First  Class<\/p>\n<p>Magistrate&#8217;s Court, Ranni, taken cognizance for the<\/p>\n<p>offence under Section 58B of Kerala Abkari Act.<\/p>\n<p>Petitioner is the manufacturer of Dasamoolarishtam,<\/p>\n<p>which was seized by the police while accused 1 and<\/p>\n<p>2 were transporting it.    This petition is filed<\/p>\n<p>under Section 482 of Code of Criminal Procedure<\/p>\n<p>contending that offence under Section 58B of Abkari<\/p>\n<p>Act  is   not  at   all   attracted  as   medicinal<\/p>\n<p>preparations   are    exempted    and    in    such<\/p>\n<p>circumstances, the case is to be quashed.<\/p>\n<p>    2. Learned counsel appearing for the petitioner<\/p>\n<p>and learned Public Prosecutor were heard.<\/p>\n<p>    3. Before framing the charge, Magistrate has to<\/p>\n<p>hear the prosecution and the defence and decide<\/p>\n<p>whether an offence under Section 58B of Abkari Act<\/p>\n<p><span class=\"hidden_text\">CRMC 2698\/09             2<\/span><\/p>\n<p>is attracted or not. Petitioner is entitled to file<\/p>\n<p>a petition for discharge under Section 239 of Code<\/p>\n<p>of Criminal Procedure and raise all the contentions<\/p>\n<p>raised herein before the Magistrate.
