Opp.Parties\n                                    ----------------------------------\n<\/pre>\n<p>3.   18.10.2011                  Heard Mr. Dinu Kumar, learned counsel for the<\/p>\n<p>                   petitioner and the counsel for the State.\n<\/p>\n<p>                                 A show cause reply has been filed by the Collector<\/p>\n<p>                   of Jehanabad District and he is also present in person. From the<\/p>\n<p>                   reading of the show cause reply and its Annexures containing the<\/p>\n<p>                   order passed by him contained in Memo No. 710 dated 15.10.2011<\/p>\n<p>                   it becomes clear that the order of this Court as with regard to<\/p>\n<p>                   passing of the reasoned order on the representation of the<\/p>\n<p>                   petitioner has been complied, though belatedly. The explanation of<\/p>\n<p>                   the Collector of Jehanabad District in this regard is that the order<\/p>\n<p>                   of this Court was not made available to him earlier by the<\/p>\n<p>                   petitioner alongwith the representation and only after getting a<\/p>\n<p>                   copy of the contempt application he could know of the directions<\/p>\n<p>                   given in the order dated 19.11.2009 in C.W.J.C.No. 14603\/2006,<\/p>\n<p>                   the relevant portion whereof reads as follows:<\/p>\n<blockquote><p>                                 &#8220;In the opinion of this Court once the Collector has<br \/>\n                                 been made the prescribed authority in the circulars<br \/>\n                                 with regard to selection and appointment on the post<br \/>\n                                 of Anganwari Sevika, if any complaint with regard<br \/>\n                                 to selection\/ appointment is made by any person the<br \/>\n                                 same has to be looked into by the Collector. There is<br \/>\n                                 no counter affidavit by the respondent State which<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>                          could have shortened the process of litigation. This<br \/>\n                          Court is also not in a position to have the stand of the<br \/>\n                          respondent no.7. This is the opinion of this Court<br \/>\n                          keeping the writ application pending will not serve<br \/>\n                          any purpose, inasmuch as the someone has still to do<br \/>\n                          the exercise of fact finding.\n<\/p><\/blockquote>\n<blockquote><p>                           In that view of the matter, this Court would<br \/>\n                          dispose of the writ application with a liberty to the<br \/>\n                          petitioner to file a representation as against the<br \/>\n                          selection and appointment of respondent no.7 and in<br \/>\n                          the event such a representation is filed by the<br \/>\n                          petitioner alongwith a copy of this order, the<br \/>\n                          Collector of Jehanabad District will be under<br \/>\n                          obligation to decide the same in accordance with law<br \/>\n                          after affording opportunity of personal hearing to the<br \/>\n                          petitioner, respondent no.7 and the representative of<br \/>\n                          the Gram Panchayat concerned.
