Learned APP,<br \/>\nMr.J.K.Shah, waives service of notice of rule on behalf of State.\n<\/p>\n<p>\tThis is an<br \/>\napplication under Section 439 of Criminal Procedure Code praying for<br \/>\nregular bail in connection with offence registered with Sachin Police<br \/>\nStation, Surat vide C.R.No.I-9 of 2011 for the offences punishable<br \/>\nunder Sections 302, 114 and 188 of the Indian Penal Code.\n<\/p>\n<p>\tPrima-facie, it<br \/>\nappears that on the date of the incident, the accused-applicant in<br \/>\ncompany of other co-accused including the deceased were sitting<br \/>\ntogether having liquor. All of a sudden a quarrel took place between<br \/>\nthe deceased and co-accused who is said to have inflicted blows on<br \/>\nthe body of the deceased. Altercation was on a issue that who was<br \/>\nearning more. It is a case of the prosecution that at relevant point<br \/>\nof time, present applicant caught hold of the deceased and co-accused<br \/>\ninflicted knife blow on the body of the deceased.\n<\/p>\n<p>\tIn this background<br \/>\nof prosecution case, following aspects are taken into consideration.\n<\/p>\n<p>\tInvestigation is<br \/>\n\tover. Charge-sheet is filed.\n<\/p>\n<p>\tAccused is a young<br \/>\n\tboy aged about 21 years old.\n<\/p>\n<p>\t Role attributed<br \/>\n\tto the accused is that of catching hold of the deceased. Most<br \/>\n\timportantly, the incident occurred at a spur of moment. It was not a<br \/>\n\tpre-meditated or pre-planed act.\n<\/p>\n<p>\tConsidering<br \/>\nthe nature of offence and the role attributed, I am persuaded to<br \/>\nexercise my discretion in favour of the accused-applicant. Under the<br \/>\ncircumstances, accused-applicant is ordered to be enlarged on regular<br \/>\nbail in connection with offence registered with<br \/>\nSachin Police Station, Surat vide C.R.No.I-9 of 2011 on<br \/>\nhis executing a bond in the sum of Rs.15,000\/- (Rupees fifteen<br \/>\nthousand only) with one surety of the like amount to the satisfaction<br \/>\nof the lower Court and subject to the conditions that he shall:\n<\/p>\n<p>\tnot take undue<br \/>\n\tadvantage of his liberty or abuse his liberty;\n<\/p>\n<p>\tnot act in a<br \/>\n\tmanner injurious to the interest of the prosecution;\n<\/p>\n<p>\tmaintain law and<br \/>\n\torder;\n<\/p>\n<p>\tmark his presence<br \/>\n\tbefore the concerned Police Station for every 15 days between 10:00<br \/>\n\tam to 2:00 pm till trial commences;\n<\/p>\n<p>\tnot leave the<br \/>\n\tState of Gujarat without prior permission of the Sessions  Court<br \/>\n\tconcerned;\n<\/p>\n<p>\tfurnish the<br \/>\n\taddress of his residence at the time of execution of the bond and<br \/>\n\tshall not change the residence without prior permission of  this<br \/>\n\tCourt;\n<\/p>\n<p>\tsurrender his<br \/>\n\tpassport, if any, to the Lower Court immediately.\n<\/p>\n<p>\tIt goes without<br \/>\nsaying that any observations touching the merits of the case is<br \/>\npurely for the purpose of deciding the question of grant of bail and<br \/>\nshall not be construed as an expression of the final opinion in the<br \/>\nmain matter.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed,  the Sessions<br \/>\nJudge concerned will be free  to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>\tBail before the<br \/>\nLower Court having jurisdiction to try the case.\n<\/p>\n<p>\tRule is made<br \/>\nabsolute.
