Justice J.M.JAMES\n\n Dated :20\/07\/2006\n\n O R D E R\n                             J.M.JAMES, J.\n                               --------------\n                            B.A.4125\/2006\n                             ------------------\n       DATED THIS THE 20TH DAY OF JULY, 2006\n\n\n                               O R D E R\n<\/pre>\n<p>              The   petitioner   is   the   second   accused,   in<\/p>\n<p>C.R.No.18\/2004 of Paravur Excise Range.  The allegation is<\/p>\n<p>that the petitioner, along with the first accused, was found<\/p>\n<p>in   illegal   possession   of   thirty   liters   of   illicit   arrack,   on<\/p>\n<p>31.7.2004.   The  first accused was arrested on  the   same<\/p>\n<p>day.  The second accused could not be arrested.  The facts<\/p>\n<p>reveal, as submitted by the learned Public Prosecutor, that<\/p>\n<p>on   the   submission   of   the   first   accused,     the   second<\/p>\n<p>accused, the petitioner herein, is also implicated.   Hence<\/p>\n<p>the   petitioner   is   before   this   Court,   under   Section   438<\/p>\n<p>Cr.P.C.\n<\/p>\n<p>       2.     After hearing the counsel as well as the public<\/p>\n<p>Prosecutor, I direct the petitioner to surrender before the<\/p>\n<p>Judicial   Magistrate   of   First   Class,   North   Paravur,   on<\/p>\n<p>26.7.2006 at 11.00 a.m.,  and move an application for bail,<\/p>\n<p>in which event the learned Magistrate shall consider the<\/p>\n<p>B.A.4125\/2006<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>same and release the petitioner on bail, imposing such<\/p>\n<p>conditions   which   are   deemed   necessary.
