SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 08\/08\/2008 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tBoth<br \/>\nthese petitions are arising out of one common order passed by the<br \/>\nlearned Additional  District Judge, 3rd Fast Track Court,<br \/>\nRajkot dated 21\/07\/2008 below Exhs. 5, 6 and 7 in Civil Miscellaneous<br \/>\nAppeal No. 34\/2008.\n<\/p>\n<p>2.\tHeard<br \/>\nShri P.M. Thakker, learned Senior advocate appearing on behalf of the<br \/>\npetitioners-original appellants-defendants and Shri Ashish Dagli,<br \/>\nlearned advocate appearing on behalf of the respondent-original<br \/>\nplaintiff.\n<\/p>\n<p>3.\tThis<br \/>\nis a case where both the parties to the appeal are dissatisfied with<br \/>\nthe order passed by the learned appellate Court below Exhs. 5, 6 and\n<\/p>\n<p>7.   This Court also finds that an unique  order has been passed by<br \/>\nthe learned appellate Court and as such this Court is not satisfied<br \/>\nat all with the order passed by the learned appellate Court.\n<\/p>\n<p>4.\tAs<br \/>\nthere is broad consensus between the learned advocates appearing for<br \/>\nthe respective parties, under instructions from their respective<br \/>\nclients, this Court  is not assigning any further reasons and<br \/>\ndiscussing the matter at length.\n<\/p>\n<p>5.\tShri<br \/>\nP.M. Thaker, learned Senior advocate appearing on behalf of the<br \/>\npetitioners-original appellants-defendants and Shri Ashish Dagli,<br \/>\nlearned advocate appearing on behalf of the respondent-original<br \/>\nplaintiff have jointly submitted that the impugned order passed by<br \/>\nthe learned appellate Court below Exhs. 5, 6 and 7 in Civil<br \/>\nMiscellaneous Appeal No. 34\/2008 be modified to the extent directing<br \/>\nboth the sides to maintain status-quo i.e. not to use the disputed<br \/>\npremises in question till the final disposal of Civil Miscellaneous<br \/>\nAppeal No. 34\/2008 and it is requested to issue appropriate direction<br \/>\ndirecting the learned appellate Court to decide and dispose of the<br \/>\nappeal within the stipulated time.  It is submitted that the<br \/>\naforesaid would be without prejudice to the rights and contention of<br \/>\nthe respective parties and only by way of interim arrangement, till<br \/>\nthe appeal is disposed of.\n<\/p>\n<p>6.<br \/>\nAccordingly, both the Special Civil Applications are disposed of.<br \/>\nThe impugned order passed by the learned Additional District Judge,<br \/>\n3rd Fast Track Court, Rajkot dated 21\/07\/2008 below Exhs.<br \/>\n5, 6 and 7 in Civil Miscellaneous Appeal No. 34\/2008 is hereby<br \/>\nmodified to the extent that both the parties to the suit shall<br \/>\nmaintain status-quo with respect to the disputed property, meaning<br \/>\nthereby, nobody shall use the disputed property till the final<br \/>\ndisposal of Civil Miscellaneous Appeal No. 34\/2008 and  the rest of<br \/>\nthe order passed by the learned appellate Court in the impugned order<br \/>\nwith respect to restraining the parties from  transferring the<br \/>\ndisputed property shall remain operative.  The same would be without<br \/>\nprejudice to the rights and contention of the respective parties in<br \/>\nthe appeal.\n<\/p>\n<p>7.\tIn<br \/>\nthe facts and circumstances of the case, the learned District Judge,<br \/>\nRajkot is directed to see that Civil Miscellaneous Appeal No. 34\/2008<br \/>\nis decided and disposed of by the learned appellate Court within<br \/>\nthree months from the date of receipt of this order and\/or production<br \/>\nof the certified copy of this order.  The learned District Judge,<br \/>\nRajkot is also directed to see that Civil Miscellaneous Appeal No.<br \/>\n34\/2008 is posted for hearing before any other Judge as it appears<br \/>\nand so observed by the learned Additional District Judge, 3rd<br \/>\nFast Track Court, Rajkot that he has no time as he has several old<br \/>\nmatters on civil, criminal and claim side.
