It appears the petitioner\n\n\"was' \"co\"1'.re~spondence with the respondent for\n\nrest_ora_.t'ion.:'~\"of the pension, but however that has been\n\n   not adhered to. Hence the present petition for quashing\n\n\"~of'Annexure A and also for refixation of pension. O\n\n\n\n\n\nnotice the State Government has entered appearance\nand filed statement of objections. Learned counsel appearing for \nvehemently submits placing rel_iance \nof the Apex Court supporting  \nis not responsible for  of' and '\nif any amount is  ing.leXcegssl\"t.he\"satire cannot be\nrecovered. He further\nsubmits that the recovery was done in the year\"'--2007\nand the writ petition having been filed in \nis barred by laches. He further  \nquestion of restoration of   \n\ncircumstance does not arise,\n\n4. I have given my  Consideration.\nApparently, the petitioiner   for the folly\nof the admini-sytifatioiniiindeed the pay\nfixation is'  Administration and\nthe  the consolidated fund of the\nState.   this point of time it is rather\n\ntoo\u00abiatei'to pin \"poin_tas to who was responsible for fixing\n\n  .__of the petitioner with an additionai\n\ningremerii', -1'  however, the fact remains that on the\n\n basis ..o1f.:.1ast drawn salary the pension of the petitioner\n\nit \ufb01zwred. Indeed it is to be noticed that if the petitioner\n\n\n\n(3\n\nis not in any way responsible for wrong fixation___of the\npension the law is very clear that the said'\nwhich is paid in execs cannot be  \nfolly is attributed to the petitioner.\u00bb._In  it A\nit is not so. Hence I am of the  2\nare required to restore the\u00bbs:sfid>anioti.nt \nrecovered from the pe.titioner'. if\ufb02\u00e9iny decision is\nrequired one can refer  o'f_V_the Apex Court\nin several  referred :\n\n UNION or INDIA\n\nreported._ \"A521, the Apex Court has\n\nopined thatiitVvisV'not'.ope'n for the employer to recover the\n\namdt1nt~whielh'-hgismalready been paid as pension when\n\nA  foilgr is 'attribtited to the employee.\n\nA  Anidentical View has also been taken by the Apex\n\nvia the case of SAHIB RAM .vs. STATE or\n\n   reported in 11995 SCC (Suppl. 1) \u00a38. \/\ufb02\n\n\n\n5. Having regard to the law laid down, I  the\n\nView that there was no justification for the;\"'respenderi\u00abt_\n\nto recover the said amount.\n\nI'\n\n6. The next question would the the .'restoi?ati.o'n.do.--.V\n\nthe original pension. Viiadeed   the\n\nrespondents are required to\"\"1'ecaic\"uI_ate'an'd\"determine\nthe pension which is  fpetiigioner.
