Agrawal,J.\n<\/pre>\n<p>Hon&#8217;ble Abhinava Upadhya,J.\n<\/p>\n<p>     The present special appeal has been preferred against<br \/>\nthe judgment and order dated Ist July, 2010 passed by the<br \/>\nlearned Single Judge whereby the writ petition preferred by the<br \/>\npresent appellant has been dismissed. In the writ petition the<br \/>\npetitioner-appellant   has   challenged    the   order   dated   7th<br \/>\nSeptember, 2009 passed by the District Inspector of Schools,<br \/>\nMathura (in short the DIOS) directing for single operation of the<br \/>\nsalary account of the institution, namely, Brij Hitkari Inter<br \/>\nCollege, Bajna, District Mathura under the provisions of Section<br \/>\n3(3) of the Uttar Pradesh High School and Intermediate<br \/>\nColleges (Payment of Salaries of Teachers and other<br \/>\nEmployees) Act, 1971 (in short the Act).\n<\/p>\n<p>     It appears that in the said college the elections of the<br \/>\nCommittee of Management were not held within the specified<br \/>\nperiod prescribed under the Scheme of Administration and the<br \/>\nAuthorized Controller was appointed to hold elections. The<br \/>\nelections were held on 22.2.2009 in which Sri Santosh Kumar<br \/>\nAgarwal was elected as manager and his signature was also<br \/>\nattested by the DIOS on 28.2.2009. However, before the<br \/>\nrecognition of the election of the Committee of Management<br \/>\nand attestation of the signature of the duly elected manager, the<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>Additional Director of Education(Secondary) vide order dated<br \/>\n9.1.2009 transferred one Sri Virendra Singh, who was the<br \/>\nPrincipal of Sri Lakha Uchchattar Madhyamik Vidyalaya,<br \/>\nBeerbala, Harnaul, District Mathura as Principal of the College<br \/>\nin question. The Authorized Controller, who was managing the<br \/>\naffairs of the College, allowed Sri Virendra Singh to join the<br \/>\ninstitution as Principal on 17.1.2009 and his signatures were<br \/>\nalso attested by the DIOS on 20.1.2009.\n<\/p>\n<p>     The transfer of Sri Virendra Singh was challenged by Sri<br \/>\nChandra Pal Sharma, who was the senior most teacher of the<br \/>\nCollege in question by means of Civil Misc.Writ Petition No.<br \/>\n5128 of 2009. The Court vide order dated 30.1.2009 directed<br \/>\nthe parties to maintain status quo, as a result of which, Sri<br \/>\nChandra Pal Sharma continued to act as Officiating Principal.<br \/>\nSri Chandra Pal Sharma retired on 30.6.2009. Thereafter, the<br \/>\nnext senior most person, namely, Sri Nahar Singh Verma<br \/>\napproached this Court by means of Civil Misc. Writ Petition No.<br \/>\n32540 of 2009 in which this Court vide order dated 3.7.2009<br \/>\npassed an order of status quo. As the DIOS had attested the<br \/>\nsignatures of Sri Virendra Singh on 20.7.2009, Shri Nahar<br \/>\nSingh Verma was not recognized as Officiating Principal by the<br \/>\nDIOS whereupon he preferred another writ petition, being Civil<br \/>\nMisc.Writ Petition No. 36826 of 2009 which was dismissed by<br \/>\nthis Court on the ground that if the order of status quo is not<br \/>\nbeing complied with, the remedy lies by way of filing petition for<br \/>\ncontempt. For the reasons best known to him, Sri Nahar Singh<br \/>\nVerma did not file any contempt petition and he was satisfied<br \/>\nwith the affairs. In the meantime, the teaching and non-teaching<br \/>\nstaff of the college who were not getting the salary since<br \/>\nFebruary, 2009 on account of on going dispute between the<br \/>\nCommittee    of   Management        and   Sri   Virendra   Singh,<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>approached this Court by means of Civil Misc. Writ Petition No.<br \/>\n39768 of 2009 commanding the respondents to pay their<br \/>\nsalaries    as also the revised pay-scale as per 6th Pay<br \/>\nCommission. This writ petition was disposed of by this Court<br \/>\nvide judgment and order dated 4th August, 2009 with the<br \/>\ndirection to the DIOS to look into the grievance and do the<br \/>\nneedful. The DIOS in order to ensure the payment of salary to<br \/>\nthe teaching and non-teaching staff passed an order dated 7 th<br \/>\nSeptember, 2009 directing single operation of the salary<br \/>\naccount. The order dated 7th September, 2009 was challenged<br \/>\nbefore this Court by means of a writ petition by the present<br \/>\nappellant, which has been dismissed.\n<\/p>\n<p>      We have heard Sri V.K. Singh, learned counsel for the<br \/>\nappellant, Sri Vashistha Tiwari, learned counsel for respondent<br \/>\nno.5 and the learned Standing Counsel who represents<br \/>\nrespondent nos. 1 to 4 and have perused the judgment and<br \/>\norder dated 1.7.2010 passed by the learned Single Judge<br \/>\ngiving rise to the present appeal as also the grounds taken in<br \/>\nthe memo of appeal and the documents filed along with it<br \/>\nincluding the copy of the writ petition.\n<\/p>\n<p>      Sri V.K.Singh, learned counsel for the appellant submitted<br \/>\nthat as this Court in the writ petition filed by Chandra Pal<br \/>\nSharma had directed for maintaining the status quo on the post<br \/>\nof Principal which post was held by Sri Chandra Pal Sharma as<br \/>\nOfficiating Principal till his retirement to 30.6.2009 and<br \/>\nthereafter on 3.7.2009 another order of status quo was passed<br \/>\nby this Court in the writ petition filed by Sri Nahar Singh Verma<br \/>\nand as such he has not been appointed as Principal of the said<br \/>\ncollege. He further submitted that Sri Virendra Singh was<br \/>\ntransferred during the period when the Authorized Controller<br \/>\n<span class=\"hidden_text\">                                  4<\/span><\/p>\n<p>was appointed to hold election and, therefore, it cannot be said<br \/>\nthat the order of transfer is illegal as the Committee of<br \/>\nManagement        has not given its consent. He, therefore,<br \/>\nsubmitted that the order of single operation of the salary<br \/>\naccount is clearly illegal and without authority of law.\n<\/p>\n<p>      Having given our thoughtful consideration to the various<br \/>\nplea raised by the learned counsel for the appellants, we find<br \/>\nthat it is not in dispute that the present appellant had not<br \/>\nchallenged the order of transfer of Sri Virendra Singh on the<br \/>\npost of Principal of the College in question. That being the<br \/>\nposition,    the signature of Sri Virendra Singh having been<br \/>\nattested by the DIOS on 20.1.2009 that has to be given full<br \/>\neffect to and the order of status quo passed in the writ petition<br \/>\nfiled by Sri Chandra Pal Sharma became in effective after the<br \/>\nretirement of Sri Chandra Pal Sharma on 30.6.2009. The order<br \/>\nof status quo passed by this Court in the writ petition of Sri<br \/>\nNahar Singh Verma on 3.7.2009 would not come to the rescue<br \/>\nof the present appellant as from 1.7.2009, Sri Virendra Singh<br \/>\nwould be deemed to be the Principal of the said College<br \/>\nbecause there was no interim order in favour of Sri Nahar Singh<br \/>\nVerma at hat point of time. Moreover the writ petition filed by Sri<br \/>\nNahar Singh Verma challenging the action of the education<br \/>\nauthorities in not permitting him to continue as officiating<br \/>\nPrincipal and on the other hand permitting Sri Virendra Singh to<br \/>\ncontinue as Principal came to be dismissed by this Court on<br \/>\n23.7.2009.\n<\/p>\n<p>             The appellant cannot be permitted to blow hot and<br \/>\ncold in the same breath. On the one hand it had chosen not to<br \/>\nfile any petition or application to challenge the transfer and<br \/>\nappointment of Sri Virendra Singh as Principal of the College in<br \/>\n<span class=\"hidden_text\">                                  5<\/span><\/p>\n<p>question and on the other hand not sending the salary bills of<br \/>\nteaching and non-teaching staff with Sri Virendra Singh,<br \/>\nPrincipal of the said college which cannot be permitted under<br \/>\nlaw.\n<\/p>\n<p>       That being the position, we are of the considered opinion<br \/>\nthat the Committee of Management ought to have sent the<br \/>\nsalary bills of the teaching and non-teaching staff under the<br \/>\nPrincipal ship of Sri Virendra Singh and that having not been<br \/>\ndone, the DIOS was fully justified in passing the order of single<br \/>\noperation of the salary account. We, therefore, do not find any<br \/>\nlegal infirmity in the order passed by the learned Single Judge.\n<\/p>\n<p>       The appeal fails and it is, accordingly, dismissed.\n<\/p>\n<p>       However, if the appellants Committee of Management<br \/>\nundertake to send the salary bills of the teaching and non-<br \/>\nteaching staff of the college including the salary bill of Sri<br \/>\nVirendra Singh as Principal of the College and under joint<br \/>\nsignature of the Principal and the Committee of Management<br \/>\nthen after receiving the salary bill the order of single operation<br \/>\nshall be withdrawn by the DIOS as the same has been passed<br \/>\nonly on account of not submitting the salary bills.\n<\/p>\n<p>Order Date :- 23.7.2010<br \/>\nSKM\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court C\/M Brij Hitkari Inter College &#8230; vs State Of U.P.
