JUSTICE DAYA CHAUDHARY\n\nPresent:-    Mr. Jaivir Yadav, Advocate\n             for the appellants.\n                   -----\nORDER:\n<\/pre>\n<p>1.           Delay condoned. Heard on merits.\n<\/p>\n<p>2.           The appellants are aggrieved by judgment of the<\/p>\n<p>learned Single Judge, dismissing their writ petition seeking<\/p>\n<p>direction for permitting them to appear in the departmental<\/p>\n<p>Accountant Examination.\n<\/p>\n<p>3.           The appellants are working as Safai Karamcharis or<\/p>\n<p>Beldars in the office of Municipal Council, Rohtak.            Under the<\/p>\n<p>provisions of Haryana Municipal Departmental Accountant<\/p>\n<p>Examination Rules, 1985, a departmental examination is held for<\/p>\n<p>appointment as Accountant. Rule 2 of the said Rules lays down<\/p>\n<p>the   eligibility   conditions   of     qualification   and   experience.<br \/>\n<span class=\"hidden_text\"> LPA No.747 of 2009                                              2<\/span><\/p>\n<p>Experience required is in dealing with payment of vouchers,<\/p>\n<p>maintenance of cash books, provident fund accounts, budgets<\/p>\n<p>and adjustment etc. in a Government office or in the office of a<\/p>\n<p>local authority. The appellants applied for the said examination,<\/p>\n<p>but they were held not to be eligible. Aggrieved thereby, the writ<\/p>\n<p>petition was filed.\n<\/p>\n<p>4.          Learned Single Judge held that they could not be<\/p>\n<p>treated to have the requisite experience. It was observed:-<\/p>\n<blockquote><p>            &#8220;&#8230;..Concededly, the petitioners are working as<br \/>\n            Beldars and Safai Karamcharis.      Their duties and<br \/>\n            responsibilities as Beldars and Safai Karamchari have<br \/>\n            nothing to do with the payment of vouchers,<br \/>\n            maintenance of cash books, provident fund accounts,<br \/>\n            budgets and adjustments etc. in the office of local<br \/>\n            authority. With the petition, neither any material has<br \/>\n            been annexed nor any averment has been made that<br \/>\n            on the post of Beldar or Safar Karamchari, the<br \/>\n            petitioners are dealing with the payment of vouchers,<br \/>\n            maintenance of cash books, provident fund accounts,<br \/>\n            budgets and adjustment etc. The petitioners are class<br \/>\n            IV employees and they have nothing to do with the<br \/>\n            aforesaid duties and they have no experience in<br \/>\n            dealing with the payments of vouchers, maintenance<br \/>\n            of cash books, provident fund accounts, budgets and<br \/>\n            adjustments etc.&#8221;\n<\/p><\/blockquote>\n<p>5.          We have heard learned counsel for the appellants.<\/p>\n<p>6.          Learned counsel for the appellants submitted that on<\/p>\n<p>account of certain contingencies, the appellants gained such<br \/>\n<span class=\"hidden_text\"> LPA No.747 of 2009                                                     3<\/span><\/p>\n<p>experience,   even    though    they     were      employed     as    Safai<\/p>\n<p>Karamcharis and Beldars and to that effect, certificates were<\/p>\n<p>issued to them by the Municipal Council, Rohtak, but the<\/p>\n<p>Financial   Commissioner       and     Principal    Secretary    to     the<\/p>\n<p>Government rejected the same by assuming that class IV<\/p>\n<p>employees were not eligible.         To support this submission, he<\/p>\n<p>made a reference to letter dated 1.12.2008, Annexure P-4.<\/p>\n<p>Learned counsel for the appellants also submitted that one<\/p>\n<p>person, similarly placed, was considered to be qualified, as per<\/p>\n<p>letter dated 15.9.1992, Annexure P-7.\n<\/p>\n<p>7.          We are unable to accept the submissions.                 Having<\/p>\n<p>regard to nature of jobs for which the appellants were deputed, it<\/p>\n<p>was not possible to hold that they were handling the work of<\/p>\n<p>accounts and gained the requisite experience. Certificates relied<\/p>\n<p>upon do not indicate that they were required to discharge such<\/p>\n<p>duties in any given situation for required period.            As regard<\/p>\n<p>Annexure P-7, we are of the view that merely because some<\/p>\n<p>other person has been allowed to appear, did not confer any right<\/p>\n<p>on the appellants to claim eligibility, in absence of their having the<\/p>\n<p>requisite experience as per rules. No interference was, thus,<\/p>\n<p>called for with the view taken by the Financial Commissioner and<\/p>\n<p>Principal Secretary in the impugned letter dated 27.3.2009,<\/p>\n<p>Annexure P-6.\n<\/p>\n<p>8.          We, thus, do not find any ground to interfere with the<\/p>\n<p>view taken by the learned Single Judge.\n<\/p>\n<p><span class=\"hidden_text\"> LPA No.747 of 2009                                     4<\/span><\/p>\n<p>9.
