                      IN THE HIGH COURT OF JUDICATURE AT PATNA\n                             Cr.Misc. No.40594 of 2010\n                                   MD.ABUL KALAM\n                                       Versus\n                                 THE STATE OF BIHAR\n                                    -----------\n<\/pre>\n
03.     14.03.2011.              Heard.\n<\/p>\n
                                 The allegation against the petitioner<\/p>\n
                      is     that     he    on     account      of     not     getting<\/p>\n
                      Rs.30,000\/- and a motorcycle from the parents<\/p>\n
                      of   his      wife,     killed     her    by    administering<\/p>\n
                      poison.\n<\/p>\n
                                 The contention is that the petitioner<\/p>\n
                      and his wife swallowed poison simultaneously<\/p>\n
                      and both of them were shifted to the hospital<\/p>\n
                      where    the     wife      succumbed     to     the    poisonous<\/p>\n
                      substance and the petitioner survived. This<\/p>\n
                      fact,      it    is     contended        is     contained     in<\/p>\n
                      paragraph-38 of the case diary.<\/p>\n
                                 Regard being had to the above facts,<\/p>\n
                      let the above named petitioner be released<\/p>\n
                      from       custody         on     furnishing           bond   of<\/p>\n
                      Rs.10,000\/-(ten         thousand)        with    two    sureties<\/p>\n
                      of the like amount each to the satisfaction<\/p>\n
                      of   Chief      Judicial        Magistrate,      Bhagalpur    in<\/p>\n
                      Sanhaula P.S.Case No.63 of 2009.<\/p>\n
