On 21st<br \/>\nOctober 2002, the eldest son of the petitioner<br \/>\nnamely Sajid was travelling in an S.T. Bus bearing registration<br \/>\nNo.GJ-18-V-4762, which was being plied between Ambaji and Patan. At<br \/>\nabout 07-00 O&#8217;clock a mob of an unknown persons had attacked the said<br \/>\nS.T. Bus. The said incident took place at a distance of about half<br \/>\nkilometre from village Manwada. In the said incident, Sajid-son of<br \/>\nthe petitioner<br \/>\nwas dragged from the said S.T. Bus and he was beaten up mercilessly<br \/>\nby the said unknown persons in the mob and he succumbed to death.<br \/>\nHence, by way of present petition, the petitioner<br \/>\nhas prayed for compensation of Rs.10 lakhs from the<br \/>\nrespondent-Corporation.\n<\/p>\n<p>3.0\tDuring the course of hearing,<br \/>\nMr.R.A. Rindani, learned<br \/>\nAssistant Government Pleader, has drawn the attention of the<br \/>\nCourt to the order dated 26th October 2004 (Annexure-D)<br \/>\npassed by this Court in Special<br \/>\nCivil Application No.14127 of 2004 preferred by the very<br \/>\npetitioner<br \/>\npraying for the similar type of reliefs. It<br \/>\nwould be beneficial to reproduce the said order as under :\n<\/p>\n<p>\t Mr.N.K. Majmudar, learned counsel<br \/>\nfor the petitioner<br \/>\nseeks permission to withdraw this petition to file appropriate<br \/>\nproceedings before appropriate forum. Permission granted. Petition<br \/>\nstands disposed of as withdrawn.\n<\/p>\n<p>4.0\tThus, in view of aforesaid, when<br \/>\nthe petitioner<br \/>\nhad already approached this Court praying for the similar type of<br \/>\nreliefs as prayed for in this petition and the said petition has been<br \/>\nwithdrawn by the petitioner,<br \/>\nthe petitioner<br \/>\nis estopped from filing such a petition before this Court. The<br \/>\npresent petition<br \/>\nis barred by the principle of res-judicate. Further, it is pertinent<br \/>\nto note that though the petitioner<br \/>\nhad made a representation<br \/>\nto the respondent-State<br \/>\nand though the respondent-State<br \/>\nhas been joined as a party respondent,<br \/>\nthe petitioner<br \/>\nhas not produced any policy of the respondent-State<br \/>\non record. Further, after the said order dated 26th<br \/>\nOctober 2004, though the petitioner<br \/>\nwas to prefer appropriate proceedings before appropriate forum, he<br \/>\nhas chosen to make representation<br \/>\nbefore the respondent-State<br \/>\ninstead of availing the remedy available to him. Therefore also, no<br \/>\ninterference is called for at the hands of this Court and the<br \/>\npetition is required to be dismissed.\n<\/p>\n<p>5.0\tFor the foregoing reasons, the<br \/>\npresent petition fails and is, accordingly, dismissed. Rule is<br \/>\ndischarged with no order as to costs.
