He has<br \/>\n\tcontended that now he is not on the panel of the appellant-Authority<br \/>\n\tand therefore, he cannot appear in the matter. Therefore, this Court<br \/>\n\tcalled Mr.B.T. Rao, learned counsel, who is on the panel of the<br \/>\n\tappellant-Authority. All the papers pertaining to the matter have<br \/>\n\tbeen provided to Mr.Rao and thereafter, he argued the matter.\n<\/p>\n<p>The<br \/>\n\tappellant-original complainant has preferred the present appeal<br \/>\n\tunder Section 378 of the Code of Criminal Procedure, 1973 against<br \/>\n\tthe Judgment and Order of acquittal dated 08th December<br \/>\n\t1992 passed by the learned Judicial Magistrate First Class,<br \/>\n\tUmbergaon, in Criminal Case No.2080 of 1986, by which the learned<br \/>\n\tMagistrate was pleased to acquit the opponent Nos.1 to 5-original<br \/>\n\taccused from the charges levelled against them.\n<\/p>\n<p>The<br \/>\n\tshort facts of the complainant is that the opponent No.1 is the firm<br \/>\n\tmanaged by the opponent Nos.2 to 5. It is the case of the<br \/>\n\tcomplainant that opponent Nos.1 to 5-original accused were covered<br \/>\n\twithin the meaning of Employees Provident Fund Act and Family<br \/>\n\tPension Fund Act, 1952. It is also the case of the complainant that<br \/>\n\tthe opponent Nos.1 to 5 were covered under the Employees Provident<br \/>\n\tFund Scheme, 1971. As per the case of the complainant, according to<br \/>\n\tParagraph Nos.30 and 38 of the Scheme, original accused were bound<br \/>\n\tto deposit the employees&#8217; contribution along with the administrative<br \/>\n\tcharges and and employer&#8217;s contribution or or before 15th<br \/>\n\tof the relevant month. It is the case of the complainant that<br \/>\n\toriginal accused were not deposited the said amount. Therefore, a<br \/>\n\tcomplaint to the said effect was registered with the Court of<br \/>\n\tJudicial Magistrate First Class, Umbergaon for violation of<br \/>\n\tprovisions of Section 14(1)(a) and 14-A of the Act read with<br \/>\n\tParagraph 76-D of the Scheme.\n<\/p>\n<p>Heard<br \/>\n\tMr.B.T. Rao, learned counsel for the appellant and Mr.H.L. Jani,<br \/>\n\tlearned Additional Public Prosecutor appearing on behalf of the<br \/>\n\topponent No.6-State.\n<\/p>\n<p>Mr.Rao<br \/>\n\thas contended that the appeal is of the year 1995 and after 16<br \/>\n\tyears, this appeal has come on Board for hearing. He has read the<br \/>\n\treport of Police Inspector, Umbergaon Police Station and contended<br \/>\n\tthat as per the said report, whereabouts of present opponent Nos.1<br \/>\n\tto 5 are not known. He has also contended that the opponent No.1<br \/>\n\tcompany is closed since long and it was in possession of Bank of<br \/>\n\tBaroda and was sold by the Bank long back. It is also mentioned in<br \/>\n\tthe said report that there are chances that opponent Nos.1 to 5 are<br \/>\n\tsettled abroad. Mr.Rao has also read the statement of one Kunal<br \/>\n\tKrushnakant Pandya, Umbergaon. As stated in statement, Mr.Pandya is<br \/>\n\tat present owner of the said property. He has purchased the said<br \/>\n\tproperty from Parth Agency, who purchased the same from the<br \/>\n\tpossession of Bank of Baroda in auction. Mr.Pandya is unaware about<br \/>\n\twhereabouts of the opponent Nos.1 to 5. Hence, Mr.Rao has contended<br \/>\n\tthat looking to the facts of the case, this appeal may not survive<br \/>\n\tand the Court may pass appropriate order.\n<\/p>\n<p>Mr.Jani<br \/>\n\thas contended that this is a very old appeal, which has now come on<br \/>\n\tboard for hearing. He has also contended that looking to the report<br \/>\n\tproduced on record, company is closed since long and it has been<br \/>\n\tsold by the Bank. He has also contended that whereabouts of opponent<br \/>\n\tNos.1 to 5 are not known to anybody. Therefore, in view of these<br \/>\n\tfacts, Court may pass appropriate order.\n<\/p>\n<p>I<br \/>\n\thave perused the papers produced before me and considered the<br \/>\n\tsubmissions advanced by learned counsel for the parties. I have also<br \/>\n\tgone through the Rojkam.\n<\/p>\n<p>Looking<br \/>\n\tto the papers, it appears that the matter was pending for one year<br \/>\n\tat the stage of evidence before the trial Court. It also appears<br \/>\n\tthat neither the complainant nor the counsel for the complainant<br \/>\n\thave ever bothered to remain present before the trial Court. It also<br \/>\n\tappears from the papers that though complainant had never filed any<br \/>\n\tapplication for adjournments, on several occasions, adjournments<br \/>\n\twere given in the interest of justice. It appears that thereafter as<br \/>\n\tthe complainant was never remained present to produce evidence, at<br \/>\n\tlast, in the interest of justice, the trial Court has dismissed the<br \/>\n\tcomplaint and acquitted the opponent Nos.1 to 5 from the charges<br \/>\n\tlevelled against them.\n<\/p>\n<p>In<br \/>\n\tabove view of the matter, I am of the considered opinion that the<br \/>\n\ttrial Court was completely justified in acquitting the opponent<br \/>\n\tNos.1 to 5-original accused of the charges levelled against them.\n<\/p>\n<p>I<br \/>\n\tam, therefore, in complete agreement with the findings, ultimate<br \/>\n\tconclusion and the resultant order of acquittal recorded by the<br \/>\n\ttrial Court and hence find no reasons<br \/>\n\tto interfere with the same. Hence the appeal is hereby dismissed.<br \/>\n\tThe<br \/>\n\tJudgment and Order of acquittal dated 22nd<br \/>\n\tDecember 1992 passed by the learned Judicial Magistrate First Class,<br \/>\n\tUmbergaon, in Criminal Case No.2080 of 1986, is hereby confirmed.<br \/>\n\tBail bond, if any, shall stand discharged.
