Justice P.N.RAVINDRAN\n\n Dated :11\/06\/2009\n\n O R D E R\n                          P.N.RAVINDRAN, J.\n                     -------------------------------------\n                      W.P.(C)No.26958 of 2008\n                     --------------------------------------\n                         Dated 11th June, 2009\n\n                               JUDGMENT\n<\/pre>\n<p>            Heard Sri.K.A.Balan, the learned counsel appearing for the<\/p>\n<p>petitioner, Sri.P.Santhosh Kumar, the learned Government Pleader<\/p>\n<p>appearing for respondents 1 to 3, Sri.Alexander Thomas, the learned<\/p>\n<p>standing counsel appearing for the Kerala Public Service Commission<\/p>\n<p>and Sri.P.Gopalakrishnan Nair, the learned counsel appearing for the<\/p>\n<p>fifth respondent.\n<\/p>\n<p>            2. The fifth respondent was advised for appointment as<\/p>\n<p>Under Secretary to Government by the Kerala Public Service<\/p>\n<p>Commission on 29.4.1985. The fifth respondent was appointed as a<\/p>\n<p>candidate belonging to Scheduled Tribe under a special recruitment<\/p>\n<p>scheme. At that point of time, the petitioner herein was a minor aged<\/p>\n<p>eight years. In this writ petition, the petitioner contends that the fifth<\/p>\n<p>respondent had secured appointment as Under                   Secretary to<\/p>\n<p>Government claiming to be a member of a Scheduled Tribe by<\/p>\n<p>presenting a caste certificate fraudulently obtained by him. On this<\/p>\n<p>ground, relying on the decisions of the Apex Court in <a href=\"\/doc\/799713\/\">Kumari<\/p>\n<p>Madhuri Patil v. Addl. Commissioner, Tribal Development<\/a><\/p>\n<p>((1994) 6 SCC 241) and <a href=\"\/doc\/109444713\/\">R.Viswanatha Pillai v. State of Kerala<\/p>\n<p><span class=\"hidden_text\">WP<\/span><\/a>(C).No.26958\/2008                  2<\/p>\n<p>((2004) 2 SCC 105), the petitioner contends that the fifth respondent<\/p>\n<p>cannot continue in service and seeks a writ in the nature of mandamus<\/p>\n<p>commanding respondents 1 to 4 to oust the fifth respondent from<\/p>\n<p>service within a time limit to be fixed by this Court.<\/p>\n<p>            3. The pleadings disclose that the Scrutiny Committee<\/p>\n<p>constituted by the Government as per G.O.(P)No.16\/1995\/SCSTDD.<\/p>\n<p>dated 8.5.1995 had enquired into the caste status of the fifth<\/p>\n<p>respondent based on a report submitted by the Vigilance Officer of the<\/p>\n<p>KIRTADS to the effect that the fifth respondent is not a member of a<\/p>\n<p>Scheduled Tribe. The Scrutiny Committee rejected the claim of the<\/p>\n<p>fifth respondent that he belongs to the Uraly community, a Scheduled<\/p>\n<p>Tribe in the State of Kerala. The said order was challenged by the fifth<\/p>\n<p>respondent in O.P.No.11925 of 1998.           It was heard along with<\/p>\n<p>O.P.No.16129 of 1999 filed by a person claiming to be the member of<\/p>\n<p>the Scheduled Tribe Community seeking implementation of the<\/p>\n<p>decision of the Scrutiny Committee.      The writ petitions were heard<\/p>\n<p>together and a learned Single Judge of this Court after an elaborate<\/p>\n<p>analysis of the pleadings and the evidence and the law on the point<\/p>\n<p>held as follows:\n<\/p>\n<blockquote><p>                &#8220;15. In the case at hand, the petitioner has<br \/>\n          been admitted in Standard        I by his parents in<br \/>\n          Kattachira Tribal School with his caste as Malay<br \/>\n          Uraly. The petitioner&#8217;s parents were residing in<br \/>\n          the Tribal colony.       Both of them underwent<br \/>\n          training in a Craft Training Centre for Tribals and<br \/>\n          they were admitted in the Centre as persons<\/p>\n<p><span class=\"hidden_text\">WP(C).No.26958\/2008                3<\/span><\/p>\n<p>          belonging to Uraly (Scheduled Tribe) community.<br \/>\n          This will be evident from Ext.P9.          So, the<br \/>\n          petitioner&#8217;s parents even at their young age were<br \/>\n          claiming that they belong to Uraly (Scheduled<br \/>\n          Tribe) community.     The petitioner was admitted<br \/>\n          by them in the school when he was a minor aged<br \/>\n          about   5   years.     According   to   the official<br \/>\n          respondents, the petitioner&#8217;s grandfather was a<br \/>\n          headman of Kuravas, locally known as `Uraly&#8217; and<br \/>\n          he started making the alleged false claim of being<br \/>\n          a member of the Uraly Scheduled Tribe. It is also<br \/>\n          alleged that he used his residence in the tribal<br \/>\n          settlement as a ground for putting forward his<br \/>\n          claim. The alleged sin dates back to the days of<br \/>\n          petitioner&#8217;s grandfather.     So, admittedly, the<br \/>\n          petitioner&#8217;s claim was not something invented by<br \/>\n          him. The religion or caste of a child is what he is<br \/>\n          told by his parents. He has no free choice in that.<br \/>\n          Since his school records including the S.S.L.C.<br \/>\n          book showed that he is Malay Uraly, he applied for<br \/>\n          the post of Under Secretary as one belonging to<br \/>\n          the Scheduled Tribe.      Since Malay Uraly was<br \/>\n          treated as Uraly, the competent authority (the<br \/>\n          Tahsildar) issued Ext.P22 certificate. A person like<br \/>\n          the petitioner who applies for a post in the public<br \/>\n          service cannot go to the KIRTADS and request<br \/>\n          them to make a genealogical study and tell him<br \/>\n          the correctness of his caste claim and thereafter<br \/>\n          submit an application for employment relying on<br \/>\n          such a certificate. The petitioner has done what<br \/>\n          any other candidate would do, i.e. he relied on the<br \/>\n          caste status mentioned in the school records and<br \/>\n          in the certificate issued by the competent<br \/>\n          authority.   So, he cannot be accused of having<br \/>\n          done anything &#8220;fraudulently&#8221;.       Ext.P52 Act, it<br \/>\n          appears, is not mean to deal with every mistaken<br \/>\n          claim of caste, especially made by a member of<br \/>\n          the SC\/ST.\n<\/p><\/blockquote>\n<blockquote><p>                 16. Anyway, I am not finally pronouncing on<br \/>\n          the jurisdiction of the Scrutiny Committee or the<br \/>\n          Government to take action under Act 11 of 1996<br \/>\n          because so far the concerned authorities have not<br \/>\n          initiated any proceedings under the said Act. The<br \/>\n          petitioner has prayed for a declaration that<br \/>\n          respondents 2 to 4 have no authority or<\/p>\n<p><span class=\"hidden_text\">WP(C).No.26958\/2008                   4<\/span><\/p>\n<p>            jurisdiction to determine the caste status of the<br \/>\n            petitioner under Ext.P52 Act. The contentions of<br \/>\n            the petitioner in this regard are kept open and he<br \/>\n            may urge them, in case the Government or any<br \/>\n            other competent authority proceeds against him<br \/>\n            under Ext.P52. So it is not necessary to finally<br \/>\n            decide whether the provisions of the Act are<br \/>\n            attracted in the case of the petitioner.\n<\/p><\/blockquote>\n<blockquote><p>                  17. The Original Petition is allowed quashing<br \/>\n            Ext.P50. It is declared that the findings in Ext.P7<br \/>\n            will not bind the petitioner. But, this will not stand<br \/>\n            in the way of the Government using the materials<br \/>\n            contained in Ext.P7 in accordance with law to<br \/>\n            launch any fresh action against the petitioner, if<br \/>\n            the same is legally permissible under Ext.P52.<br \/>\n            The Government are restrained from taking any<br \/>\n            action against the petitioner based on Ext.P50 or<br \/>\n            Ext.P51.&#8221;<\/p><\/blockquote>\n<p>              4. In view of the aforesaid findings O.P.No.16129 of 1999<\/p>\n<p>was dismissed. What the petitioner herein seeks now is the reliefs<\/p>\n<p>which had been sought for in O.P.No.16129 of 1999. A reading of<\/p>\n<p>Ext.P6 judgment would show that this Court had in categorical terms<\/p>\n<p>found that neither the fifth respondent nor his parents were guilty of<\/p>\n<p>fraudulent conduct. The decision taken by the Scrutiny Committee<\/p>\n<p>was quashed on the ground that it was issued in violation of the<\/p>\n<p>principles of natural justice. However, while passing Ext.P6 judgment,<\/p>\n<p>this Court had reserved the right of the Government to proceed afresh,<\/p>\n<p>if it is legally permissible for the Government to proceed further with<\/p>\n<p>the matter. This Court also restrained the Government from taking<\/p>\n<p>any action against the fifth respondent based on the report submitted<\/p>\n<p>by the KIRTADS. In this writ petition, what the petitioner seeks is<\/p>\n<p><span class=\"hidden_text\">WP(C).No.26958\/2008                5<\/span><\/p>\n<p>essentially action pursuant to the report submitted by KIRTADS, which<\/p>\n<p>a learned Single Judge of this Court has quashed in Ext.P6 judgment.<\/p>\n<p>            5. The learned counsel appearing for the petitioner<\/p>\n<p>however submits that in view of Section 31 of the Kerala (Scheduled<\/p>\n<p>Castes and Scheduled Tribes) Regulation of Issue of Community<\/p>\n<p>Certificates Act, 1996 as amended by Act 32 of 2008, Ext.P6 judgment<\/p>\n<p>cannot have any effect. In my opinion, the said contention is plainly<\/p>\n<p>untenable.    By section 31 as amended by Act 32 of 2008, the<\/p>\n<p>Legislature has validated the action taken by the Scrutiny Committee<\/p>\n<p>constituted under the Government order dated 8.5.2005, where the<\/p>\n<p>action had been invalidated on the short ground that the Scrutiny<\/p>\n<p>Committee constituted under the Government order dated 8.5.2005<\/p>\n<p>was not competent to take a decision in the matter. In the instant<\/p>\n<p>case, the action taken against the fifth respondent was not set aside<\/p>\n<p>by this Court on the ground that the Scrutiny Committee was not<\/p>\n<p>competent to take a decision. The decision of the Scrutiny Committee<\/p>\n<p>was set aside on the ground that the conduct of the petitioner and his<\/p>\n<p>parents were not fraudulent and that Scrutiny Committee acted in<\/p>\n<p>gross violation of the principles of natural justice. Therefore, in my<\/p>\n<p>considered opinion, the reliance placed by the petitioner on section 31<\/p>\n<p>of the Act as amended by Act 32 of 2008 is plainly untenable.<\/p>\n<p>            6. Paragraph 17 of Ext.P6 judgment also restrains the<\/p>\n<p>Government from proceeding against the fifth respondent based on the<\/p>\n<p><span class=\"hidden_text\">WP(C).No.26958\/2008                 6<\/span><\/p>\n<p>findings of the Scrutiny Committee. Ext.P6 judgment was upheld by a<\/p>\n<p>Division Bench of this Court and also by the Hon&#8217;ble the Supreme<\/p>\n<p>Court. I am bound by the findings and observations of this Court in<\/p>\n<p>Ext.P6 judgment. In the light of the authoritative pronouncement of<\/p>\n<p>this Court which binds the Government also, the petitioner cannot in<\/p>\n<p>my opinion seek any of the reliefs prayed for in this writ petition.<\/p>\n<p>Further, the petitioner was a minor when the fifth respondent was<\/p>\n<p>advised. Even if the fifth respondent is ousted from service, it would<\/p>\n<p>not enable the petitioner to secure employment. He will have to apply<\/p>\n<p>for appointment as and when Kerala Public Service Commission invites<\/p>\n<p>applications. He will have to undergo process of selection and must<\/p>\n<p>get selected before he could claim a right to be considered for<\/p>\n<p>appointment. In my opinion, in the light of the findings of this Court in<\/p>\n<p>Ext.P6 judgment which was rendered in 2002, this writ petition filed in<\/p>\n<p>2008 with full knowledge of the findings and observations therein is<\/p>\n<p>nothing but an abuse of the process of the Court.\n<\/p>\n<p>            The writ petition fails and is accordingly dismissed.
