Later, she filed Cri. Misc. No.3\/2008 under<\/p>\n

No.l86\/2009; _’IlheRsaidbilrgexrision was dismissed on merits.<\/p>\n
Aggriexred by theconcuirrent \ufb01ndings, this petition has been<\/p>\n
 challenging the orders of the Court below.<\/p>\n
  iI’.haifeilheard the learned Counsel for the petitioner<\/p>\n
 and it also the respondent. The point that arise for my<\/p>\n

A i. Whether the interim order of maintenance<\/p>\n
awarding R3900\/– pm to the wife is erroneous<\/p>\n

4. The learned Counsel for the petitioner : ‘
\nthe petitioner is a Senior Citizen and~has no<\/p>\n
the circumstances he submits that the order of.ma_i’riteniance.:<\/p>\n
of Rs.900\/- P.m by the Courtebl\ufb01low il\u00e9biotl\ufb02c and r L’<\/p>\n
illegal. It is aiso his s__ubmissgiQ_ri’..t_hat_V in apetitioh under

 =…c.0ir1cerned, it is relevant to note that wife had \ufb01led the<\/p>\n
petition in the year 1978 and sought an order, wherein a<\/p>\n

meager amount of Rs.150\/– p.rn was awarded  <\/p>\n
was depending on the said amount till the pet_itio–nV    8 <\/p>\n
in the year 2008 ie, after the

ifi’1_()V1’i.(“;’_”,IiAV”c1:’l.i{_.t!8′, aniamount of Rs.150\/– in the year 1978 and<\/p>\n
Rs.9’G0\/.{‘iri.the year 2008 in my considered opinion is not<\/p>\n
.”~–V.is:.1ch arrenhancerrient which requires consideration in a<\/p>\n
 tdpetition under Section 482 Cr.P.C and I do not think that it<\/p>\n
 = possible for a woman to survive only on an amount of<\/p>\n
V Rs.150\/– per month, the maintenance payabie even after<\/p>\n

\nmalicious   this Court held<\/p>\n
that the wife cannot ‘clairn \u00ab\ufb01naintenance so as to cause<\/p>\n
harassririentito aper_son ‘Who—is a senior citizen and is in the<\/p>\n
evening ofll:.i4slli.fe.l’ _ V<\/p>\n
{.71-f”As”–xcouldivvibeilseen from the cause title in this<\/p>\n
 ,__’petition;”\u00abtheivlagegof the petitioner is mentioned as 5′?’ years,<\/p>\n
so also tvheiagelof the wife is mentioned as 57 years. ln such<\/p>\n
Qcircumstiances, it cannot be said that the petitioner is a<\/p>\n
Vsenior citizen and at the same time, the wife is also of the<\/p>\n
same age, it cannot be said that the principle laid down in<\/p>\n
the decision referred to above would be applied to the facts<\/p>\n
on hand. Apart from this, there is no material placed on<\/p>\n
slid<\/p>\n
record to show that there was any malice on the
\nwife in \ufb01ling the application under Section    ll
\nshe got an order of maintenance
\nRs.15O \/ — per month and after, the lapseof abontli
\nshe moved an application for al’terr1ation’and’e<\/p>\n
In the circumstances,  attributed against
\nthe wife in seeking 4′ anvdiifenhancement of<\/p>\n
maintenance.  \u00ab a<\/p>\n
consideration  itlt:at”tl’ie husband is doing business<\/p>\n
and hevhad   aimouint of Rs. 6 lakhs for the marriage<\/p>\n
lV._of  C_hi.ld’ren  also that he was holding sufficient<\/p>\n
 t_la’nds’.l. If-.theset_ circumstances are taken into consideration,<\/p>\n
the,_.<l:;luantum.t_ maintenance that has been awarded on the<\/p>\n
lgtinterim application cannot be said to be on the higher side.<\/p>\n
it v   So far as the maintainability is concerned, though<\/p>\n
  the learned Counsel submitted that the interim application<\/p>\n
 cannot be \ufb01led, it is relevant to note that even under Section<\/p>\n
o\u00e9c<\/p>\n
125 Cr.P.C there is no provision to graiat-.l_giVn:t_er\u00a7ini<\/p>\n
maintenance. It is only the facts and circumstvangcesiwghicih"  i'<\/p>\n
will have to be looked into to
\nmaintenance. Taking into consideration'–._tihe  <iijltr1\u00a7:"'
\nparties a decision has to be takeiilias to
\nproper to award interi:11;~–1naints\u00a2i\u00a2'\ufb01anee. gthelabsence of any
\nprovision when the interim.'mavitiltenanceiis"awarded under
\nSection 125    prohibition to
\ngrant interif\ufb01i   lappylication under Section
\n127 C1:',P.C.;  the contention of the learned
\nCounsel for t the  any substance.\n<\/p>\n
 VVApart”frorr1v this, the wife was getting only an<\/p>\n
 arr1cunt,_of’Rs1i.__50\/– as maintenance since from the year<\/p>\n
‘1’9g’i7.8.iand  into the rising price and money value etc.,<\/p>\n
~g the triat’i.Cot\u00a7rt has used its discretion in granting interim<\/p>\n
ll’x’t.\u00a5xnain_tenlance of Rs.900\/- per month. In that View of the<\/p>\n
.  ivatteir and in the absence of any provision prohibiting the<\/p>\n
it “grant of interim maintenance and taking into consideration<\/p>\n
the circumstances in which the wife has been placed, E do<\/p>\n
