SHAH\n\t\t\n\t\n\n \n\nDate\n: 12\/07\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\nthe petitioners &#8211; State of Gujarat and Special Investigation<br \/>\nTeam, have prayed to quash and set aside the impugned order dated<br \/>\n28\/07\/2010 passed by learned Additional District Judge, Camp at<br \/>\nAhmedabad passed below Exh.1600 in Sessions Case No.69\/2009 with<br \/>\nSessions Case Nos.70\/2009 to 86\/2009.\n<\/p>\n<p>2.\t\tIt<br \/>\nis reported that the trial of the aforesaid cases have already been<br \/>\nconcluded and accused persons, who are convicted have preferred<br \/>\nappeal before this Court as well as against the order of acquittal of<br \/>\nsome of the accused, Special Investigation Team has also preferred<br \/>\nappeal before this Court.\n<\/p>\n<p>3.\t\tIn<br \/>\nview of the above, without further entering into the merits of the<br \/>\ncase and without expressing anything on the impugned order passed<br \/>\nbelow Exh.1600, the present petition is disposed of as having become<br \/>\ninfructuous. However, it will be open for the applicants to initiate<br \/>\nappropriate proceedings at appropriate stage before appropriate<br \/>\nForum\/Court on the basis of the order, that may be passed by the<br \/>\nHon&#8217;ble<br \/>\nSupreme Court in the pending matters before Hon&#8217;ble<br \/>\nSupreme Court.
