{"id":82358,"date":"1999-04-13T00:00:00","date_gmt":"1999-04-12T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/state-through-supdtt-central-vs-charulata-joshi-anr-on-13-april-1999"},"modified":"2018-07-06T03:42:25","modified_gmt":"2018-07-05T22:12:25","slug":"state-through-supdtt-central-vs-charulata-joshi-anr-on-13-april-1999","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/state-through-supdtt-central-vs-charulata-joshi-anr-on-13-april-1999","title":{"rendered":"State Through Supdtt, Central &#8230; vs Charulata Joshi &amp; Anr on 13 April, 1999"},"content":{"rendered":"<div class=\"docsource_main\">Supreme Court of India<\/div>\n<div class=\"doc_title\">State Through Supdtt, Central &#8230; vs Charulata Joshi &amp; Anr on 13 April, 1999<\/div>\n<div class=\"doc_author\">Author: Pattanaik.J.<\/div>\n<div class=\"doc_bench\">Bench: G.B.Pattanaik, M.B.Shah<\/div>\n<pre>           PETITIONER:\nSTATE THROUGH SUPDTT, CENTRAL JAIL,N.DELHI\n\n\tVs.\n\nRESPONDENT:\nCHARULATA JOSHI &amp; ANR.\n\nDATE OF JUDGMENT:\t13\/04\/1999\n\nBENCH:\nG.B.Pattanaik, M.B.Shah\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p>PATTANAIK.J.\n<\/p>\n<p>\tCompeting  rights,  namely,  right   of\t  press\t  to<br \/>\ninterview  a  prisoner in jail and right of jail authorities<br \/>\nprohibiting such interview arise for  consideration  in\t the<br \/>\npresent appeal.\t   One Babloo Srivastava, who is in judicial<br \/>\ncustody and is being tried for\toffence\t under\tSection\t 302<br \/>\nread with  Section  120B had been lodged in Tihar Jail.\t The<br \/>\nnews magazine &#8216;India Today&#8217; moved an application before\t the<br \/>\nAdditional  Sessions  Judge,  Delhi  seeking  permission  to<br \/>\ninterview the under-trial prisoner in  jail.\tThe  learned<br \/>\nSessions  Judge\t by  his  order\t dated\t6.11.95\t granted the<br \/>\npermission sought for.\tBeing  aggrieved  by  the  aforesaid<br \/>\norder  the  prosecuting\t agency\t moved\tthe  High  Court  in<br \/>\nRevision.  By the impugned order dated 1st  May,  1996,\t the<br \/>\nHigh  Court  did not interfere with the order of the learned<br \/>\nSessions Judge granting permission but modified the same  by<br \/>\nissuing the following directions:-\n<\/p>\n<p>\t&#8220;However,   it\t is   made  clear  that\t the<br \/>\n\tinterview   and\/or   photographs  of  Babloo<br \/>\n\tSrivastava  would  be  taken  only   if\t  he<br \/>\n\texpressed his willingness and not otherwise.<br \/>\n\tIf  given,  the\t respondent  newsmagazine is<br \/>\n\texpected to publish  the  interview  with  a<br \/>\n\tsense  of  propriety and balance and without<br \/>\n\toffending the law of contempt of  Courts  or<br \/>\n\timpairing the administration of justice.&#8221;\n<\/p>\n<p>The aforesaid order is being challenged in this appeal.\t The<br \/>\nlearned counsel\t appearing  for\t the  appellant\t strenuously<br \/>\nargued\tthat  the  learned  Additional Sessions Judge had no<br \/>\njurisdiction to issue the permission  in  question  and\t the<br \/>\norder  itself  indicates that the learned Sessions Judge had<br \/>\npassed the order mechanically without application  of  mind.<br \/>\nHe  had\t also  contended  that\tthough\tthe  High  Court had<br \/>\nmodified  the  said  order  yet\t the  right  of\t  the\tJail<br \/>\nauthorities  to\t deny  interview  for  good reasons has been<br \/>\nconceded by this Court in Smt.\tPrabha Dutt.  Vs.  Union  of<br \/>\nIndia  and  others  &#8211;  (1982)  1  Supreme Court Cases 1, and<br \/>\ntherefore, the High Court was not justified in\tissuing\t the<br \/>\nimpugned order.\t  The learned counsel for the respondents on<br \/>\nthe other hand contended that there is no provisions in\t the<br \/>\nJail   Manual\tprohibiting  interviews\t of  the  undertrial<br \/>\nprisoners.  In the absence of such prohibition the Right  of<br \/>\nPress  as  engrafted in Article 19(1)(a) cannot be cutrailed<br \/>\nthough\tthe  learned  counsel  urged  that  while   granting<br \/>\npermission  the\t Court\tmay put such conditions as it thinks<br \/>\nfit in the interest  of\t administration\t of  justice.\t The<br \/>\nlearned Sessions Judge, and therefore, there is no infirmity<br \/>\nwith  the  order  of  the  High Court so as to be interfered<br \/>\nwith.\n<\/p>\n<p>\tAs the outset we take up  the  issue  regarding\t the<br \/>\nauthority   of\t the  learned  Sessions\t Judge\tin  granting<br \/>\npermission.  As it appears, the accused\t is  an\t under-trial<br \/>\nprisoner and the case is pending in the Court of the learned<br \/>\nAdditional  Sessions  Judge  who  had  granted\tthe order of<br \/>\npermission.  The trial of the accused being  pending  before<br \/>\nthe  Additional Sessions Judge it cannot be said that he had<br \/>\nno authority to issue permission to the Press  to  interview<br \/>\nthe under trial inside the jail.  We, therefore, do not find<br \/>\nany substance in the argument of the learned counsel for the<br \/>\nappellant appearing in this Court.\n<\/p>\n<p>\tComing to the second limb of the  objections  raised<br \/>\nby  the\t learned  counsel appearing for the appellant, there<br \/>\ncannot be any dispute with the proposition  that  the  order<br \/>\ngranting permission to the Press to interview an under-trial<br \/>\ncannot\tbe  passed mechanically without application of mind.<br \/>\nIn as mush as the Court granting  permission  will  have  to<br \/>\nweigh  the  competing  interest between the right of a Press<br \/>\nand the right of the Authorities prohibiting such  interview<br \/>\nin the\tinterest  of  administration of justice.  The Court,<br \/>\ntherefore,  before  disposing  of  an  application   seeking<br \/>\npermission  to\tinterview an under-trial in jail must notice<br \/>\nthe jail authorities and find out whether there can  be\t any<br \/>\njustifiable  and  weighty  reasons  denying such interviews.<br \/>\nThe  Court  also  should  try  to  find\t out   whether\t any<br \/>\nrestrictions  or  prohibitions\tare  contained\tin  the Jail<br \/>\nManual.\t The so called permission granted by the Court would<br \/>\nbe subject to the relevant Rules and  Regulations  contained<br \/>\nin  the\t Jail Manual dealing with the rights and liabilities<br \/>\nof fthe under-trial prisoners.\t  In  Smt.    Prabha&#8217;s\tcase<br \/>\n(supra)\t this  Court  had  observed  that the Constitutional<br \/>\nRight to Freedom  of  Speech  and  Expression  conferred  by<br \/>\nArticle\t 19(1)(a)  of  the  Contitution\t which\tincludes the<br \/>\nFreedom of Press is not\t an  absolute  right  and  does\t not<br \/>\nconfer any right on the Press to have an unrestricted access<br \/>\nto means  of information.  The Press is entitled to exercise<br \/>\nits freedom of speech and expression by publishing a  matter<br \/>\nwhich does not invade the rights of other citizens and which<br \/>\ndoes not violate the sovereignty and integrity of India, the<br \/>\nsecurity  of  the State, public order, decency and morality.<br \/>\nThe Court also in the aforesaid case expressed\tthe  opinion<br \/>\nthat  the  Press  must\tfirst  obtain the willingness of the<br \/>\nperson sought to be interviewed and no Court  can  pass\t any<br \/>\norder\tif  the\t person\t to  be\t interviewed  expresses\t his<br \/>\nunwillingness.\tIt  was\t also  indicated  in  the  aforesaid<br \/>\njudgment  that\tthe  so-called\tright  of the Press which it<br \/>\nobtains on the basis of a permisison from the Court would be<br \/>\nsubject to the prohibitions of the Jail Manual.\n<\/p>\n<p>\tIn Sheela Barse Vs.  State of Maharashtra  (1987)  4<br \/>\nSupreme\t Court\tCases  373,  this  Court also considered the<br \/>\nRight of Press under Article  19(1)(a),\t the  Right  of\t the<br \/>\nPrisoners under Article 21 and reasonable restrictions which<br \/>\ncan be\tput  on\t such interviews.  It was also observed that<br \/>\nthe  interviews\t of  fthe  prisoners  become  necessary\t  as<br \/>\notherwise  the\tcorrect information may not be collected but<br \/>\nsuch access has to  be\tcontrolled  and\t regulated  and\t the<br \/>\nPressmen are not entitled to uncontrolled interview.  It was<br \/>\nalso  stated  that  those  who\treceive\t permission  to have<br \/>\ninterviews  will  have\tto  agree  to  abide  by  reasonable<br \/>\nrestrictions as contained in the Jail Manual, and therefore,<br \/>\npermission  granted  by\t thhe  Court  wpi;d  ne\t sibject  to<br \/>\nprovisions contained in the Jail Manual itself.\n<\/p>\n<p>\tBearing\t in  mind  the\tratio  in  the aforesaid two<br \/>\njudgments of this Court if  we\texamine\t the  order  of\t the<br \/>\nlearned\t Additional  Sessions  Judge  it can be said without<br \/>\nhesitation that the said learned Additional  Sessions  Judge<br \/>\ndisposed  of the application seeking permission to interview<br \/>\nby passing a blanket order without  applying  his  mind\t and<br \/>\nwithout even knowing the mind of the authorities and without<br \/>\nbearing\t in  mind  the\tlaw  laid  down by this Court in the<br \/>\naforesaid two decisions.  No Court would pass such a blanket<br \/>\norder mechanically without applying its mind to the relevant<br \/>\nfactors, as the Press does not have an unfettered  right  to<br \/>\ninterview an  under trial prisoner in jail.  When we examine<br \/>\nthe impugned order of the High Court we find that  the\tHigh<br \/>\nCourt  did  bear  in  mind  the\t ratio\tof the aforesaid two<br \/>\ndecisions of  this  Court  and,\t therefore,  while  granting<br \/>\npermission   to\t  interview  the  under-trial  prisoners  it<br \/>\nmodified the blanket order passed by  the  learned  Sessions<br \/>\nJudge  putting such restrictions and conditions as contained<br \/>\nin the impugned order.\tNo grievance, therefore, can be made<br \/>\nto the impugned order of the High Court.  But after  hearing<br \/>\nthe  learned  counsel  for  the parties we may add a further<br \/>\ncondition that the interview which the Press would take will<br \/>\nbe regulated by the provisions contained in Jail Manuals and<br \/>\ntherefore, the Jail Authorities can  modulate  the  same  in<br \/>\naccordance with the provisions contained in the Jail Manual.<br \/>\nIn  the\t Course of hearing it was pointed out to us that the<br \/>\nsaid under-trial prisoner is no longer in Tihar Jail and  we<br \/>\ndo  not\t know  whether\tthe  News  Magazine still intends to<br \/>\ninterview the said under-trial prisoner.  In the  event\t the<br \/>\nMagazine still intends to interview the under-trial prisoner<br \/>\nthen he must approach the appropriate Jail Authorities where<br \/>\nthe  said  under-trial\tprisoner  has  been lodged and those<br \/>\nAuthorities will bear in mind the conditions put by the High<br \/>\nCourt and the observations  made  by  us  in  this  judgment<br \/>\nbefore allowing the interview in question.\n<\/p>\n<p>\tThis  appeal  is  disposed  of\twith  the  aforesaid<br \/>\ndirections and observations.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India State Through Supdtt, Central &#8230; vs Charulata Joshi &amp; Anr on 13 April, 1999 Author: Pattanaik.J.
