Justice V.GIRI\n\n Dated :12\/06\/2009\n\n O R D E R\n                      V.GIRI, J\n                    -------------------\n                 W.P.(C).7950\/2009\n                    --------------------\n        Dated this the 12th day of June, 2009\n\n                    JUDGMENT\n<\/pre>\n<p>      3rd respondent claimed to be a tenant of the<\/p>\n<p>petitioner in respect of a property having an extent<\/p>\n<p>of 500 squre links forming part of a total extent of<\/p>\n<p>12.5 cents of property belonging to the petitioner.<\/p>\n<p>The Land Tribunal allowed the application of the 3rd<\/p>\n<p>respondent against which the petitioner preferred<\/p>\n<p>A.A.39\/1990. The appellate authority issued notice<\/p>\n<p>to the respondents in the appeal. But for several<\/p>\n<p>years in spite of 50 posting dates, as contended by<\/p>\n<p>the petitioner,     appeal was not disposed of.<\/p>\n<p>Petitioner approached this Court in O.P.22955\/1996<\/p>\n<p>aggrieved by the delay in the disposal of the appeal.<\/p>\n<p>Same led to Ext.P2 judgment, giving three months&#8217;<\/p>\n<p>time. It seems that thereafter, now the petitioner<\/p>\n<p>has been informed that the appellate records are<\/p>\n<p>missing.     Hence     this     writ    petition seeking<\/p>\n<p>appropriate reliefs.\n<\/p>\n<p>W.P.(C).7950\/2009<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>2.    Learned Government Pleader submits that the<\/p>\n<p>records were transmitted from the office of the<\/p>\n<p>appellate authority, Alappuzha to the appellate<\/p>\n<p>authority, Thrissur.   It seems that the records are<\/p>\n<p>now missing.     Steps are taken to reconstitute the<\/p>\n<p>records. This shall be done within six months from<\/p>\n<p>the date of receipt of a copy of this judgment.<\/p>\n<p>Submission is recorded.\n<\/p>\n<\/p>\n<p>3.    Once records are reconstituted, appeal shall<\/p>\n<p>be disposed of without further delay, at any rate<\/p>\n<p>within six months from the date of reconstitution of<\/p>\n<p>the records.
