Brief facts of the case are:\nThat on 17-9-06, when the deceased Prashanth\n\nwas travelling in a car bearing registration \n\nMB--1558 on Tumkur - Bangalore road,__Aii--earf\n\ngate, the driver of the car drove the sai'nefviri:..high  * , \n\nin a rash and negligent m=:.m&gt;.~er'i and\" cause'd._xfthe\n\naccident. As a result, the d_e'eeased  s'nst'ain.eti\"g1'ievousf\n\ninjuries and died ongthe 'parents. filed a claim\npetition before  Bfarigalore, seeking\ncompensationgitaf \/ V:V'I'he Tribunal by\nimpugned   award has awarded\n with interest at 6% p.a.\n of compensation awarded by\n\n Tril:'&gt;nnVai'Vthe\"- clairnants are in appeal seeking\n\n . _ enharicement of compensation.\n\n  .'Efs'j__thVere is no dispute regarding death of the\n\ndeceased Prashanth in a road traffic accident, and\n\n3\" x:_li'abi1ity of the insurer of the car, only point remains for\n\nmy consideration in the appeal is:\n\n\n\nWhether the quantum of\ncompensation awarded by the Tribunal is\njust and proper or does it call for\nenhancement?\n\n6. After hearing the learned Counsel for the-Viparti\u00e9es\n\nand perusing the award of the Tribuna1',.n:I  \n\nView that the compensation a\\;v'ardedp_b-:y the\ufb01TT1'iburiai'--wisV 9 j \n\nnot just and proper, it is on the4'1o\\}ver sideand 'therefore\n\nit is deserved to be enhanced:\n\n7. Claimants   oi \"thet: deceased,\nexcept examining  .-~thejV_d\u00bbe_ceased as P.W. 1\nand Area  iof   the deceased\nwash'   I has produced salary\ncertificate    at Ex.P.23, have not\n\nes\u00a7tabiicshed' \" \u00abemployment of the deceased by\n\n 'relevant documents or examining the\n\n\"  Vohfiivthe deceased. It is to be noted, claimants\n\nhiaye\ufb02g stated, the deceased was getting salary of\n\n  ;Rs.1\"1,000\/-- by working as a Computer operator. But\n\n according to the salary certificate Ex. 13.23 produced by\n\nP.W.6 working as an Area Manager in the company\n\n3:\n\n\n\nwhere the deceased was Working, his salary was\nRs.8,000\/-- pm. The Tribunal rightly disbelieving the\nsalary of the deceased, Considering his age as 2?.-_years,\n\nyear of accident as 2006 and nature of  a\n\nComputer Operator, has assessed his\" ii\"_1cof11.\"ee~ \n\nRs.6,000\/' per month. It has\" dedyudcteti:A\u00a7S\u20ac1%_\"of his 7 it\n\nincome towards his personal 'expenses bwlr\ufb01ch i'-.3b'a1's0\n\njust and proper. Mu1tip1ier'e\u00ab.ofi 713' has 'to.\"'be.\u00b0app1ied on\nthe basis of the age 'of  thebdeceased. So\nloss of dependency!'
