No.782 of 2011\n                  Ujjawal Kumar @ Ujjawal Uthap @ Uptal, son of Sri Ram\n      Lalit Prasad Singh, resident of village-Gamharia, P.S.-Majorganj, District-\n      Sitamarhi, presently residing in Officers' Flat, Police Line, Begusarai, P.S.-\n      Begusarai Town, District- Begusarai.\n                                     Versus\n                 The State Of Bihar .\n                                               -----------\n<\/pre>\n<p>3.   25.07.2011                   The accused petitioner has preferred this revision<\/p>\n<p>                     application under Section 53 of the Juvenile Justice (Care and<\/p>\n<p>                     Protection of Children) Act, 2000 against the order dated<\/p>\n<p>                     06.04.2011 passed by the learned Sessions Judge, Begusarai in<\/p>\n<p>                     Cr. Appeal No.18\/2011 by which the order dated 22.12.2010<\/p>\n<p>                     passed by the learned Juvenile Justice Board, Begusarai in<\/p>\n<p>                     Phulwaria P.S. Case No.6\/2010 for the offence punishable under<\/p>\n<p>                     Sections 379\/411 of the I.P.C. has been confirmed.<\/p>\n<p>                                  Heard Mr. Akhileshwar Prasad Singh, learned<\/p>\n<p>                     counsel for the petitioner and Mr. Haque, learned counsel for the<\/p>\n<p>                     State.\n<\/p>\n<p>                                  The main contention of the learned counsel for the<\/p>\n<p>                     petitioner is that the petitioner has been declared juvenile by the<\/p>\n<p>                     learned Juvenile Justice Board. He has been falsely implicated<\/p>\n<p>                     in the case one after another due to enmity. He was granted bail<\/p>\n<p>                     vide order dated 22.07.2010 by this Court in Cr. Revision<\/p>\n<p>                     No.1060 of 2010 in Phulwaria P.S. Case No.6\/10 with condition<\/p>\n<p>                     that during the pendency of that case, if the petitioner is<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>involved in any other case, the bail bond would be cancelled and<\/p>\n<p>he will be taken into custody. Thereafter, the petitioner has been<\/p>\n<p>implicated in Begusarai Town P.S. Case No.359\/10 under<\/p>\n<p>Sections 379\/411 of the I.P.C. As such, his bail bond was<\/p>\n<p>cancelled and he was taken into custody by the learned Juvenile<\/p>\n<p>Justice Board. The petitioner has been implicated in Phulwaria<\/p>\n<p>P.S. Case No.6\/2010. As such, the petitioner has been in custody<\/p>\n<p>in this case since 7.10.2010. It is further submitted that there is<\/p>\n<p>no material on record to show that the release of the petitioner<\/p>\n<p>will bring him into association with known criminal and expose<\/p>\n<p>him to moral, physical and psychological danger and his release<\/p>\n<p>would defeat the ends of justice. It is further submitted that<\/p>\n<p>parents of the petitioner will take care of the petitioner and they<\/p>\n<p>will produce the petitioner in the court as and when required.<\/p>\n<p>             Learned A.P.P. for the State submits that the<\/p>\n<p>petitioner has criminal antecedent and he has violated the<\/p>\n<p>conditions of bail granted by this Court.<\/p>\n<p>             After hearing the learned counsel for both the<\/p>\n<p>parties and on perusal of the materials on record, it appears that<\/p>\n<p>the contention of the learned counsel for the petitioner is correct.<\/p>\n<p>There is no material on record to show that the release of the<\/p>\n<p>petitioner will bring him into association with known criminal<\/p>\n<p>and expose him to moral, physical and psychological danger and<br \/>\n<span class=\"hidden_text\">                        3<\/span><\/p>\n<p>his release would defeat the ends of justice.<\/p>\n<p>               Considering the facts and circumstances stated<\/p>\n<p>above, in my opinion, the impugned order is not fit to be<\/p>\n<p>sustained and the same is set aside. The petitioner above-named<\/p>\n<p>is directed to be released on bail on furnishing bail bond of<\/p>\n<p>Rs.10,000\/-with two sureties of the like amount each to the<\/p>\n<p>satisfaction of learned Juvenile Justice Board, Begusarai in<\/p>\n<p>Phulwaria P.S. Case No.6 of 2010 with the following terms and<\/p>\n<p>conditions :\n<\/p>\n<p>               (i)           Both the bailors will be the father<\/p>\n<p>                             and mother of the petitioner.\n<\/p>\n<p>               (ii)          Father of the petitioner will furnish<\/p>\n<p>                             the cash surety of Rs.10,000\/-.\n<\/p>\n<p>               (iii)         Mother of the petitioner           will<\/p>\n<p>                             produce the petitioner in the court<\/p>\n<p>                             if and when required.\n<\/p>\n<p>               (iv)          The petitioner will not indulge in<\/p>\n<p>                             similar or in any other offence.\n<\/p>\n<p>               (v)           In case of his absence for two<\/p>\n<p>                             consecutive dates or in case of<\/p>\n<p>                             violation of the terms of the bail,<\/p>\n<p>                             his bail bond will be liable to be<\/p>\n<p>                             cancelled by the learned Juvenile<br \/>\n<span class=\"hidden_text\">                      4<\/span><\/p>\n<p>                               Justice Board, Begusarai and the<\/p>\n<p>                               cash amount will be forfeited and<\/p>\n<p>                               he will be taken into custody.\n<\/p>\n<p>              In the result, this application is allowed.<\/p>\n<pre>V.K.
